The parental responsibility + contact framework of the 2005 Slovak Family Act. Zákon o rodine (Family Act 36/2005 Z. z.) replaced the previous 1963 Family Act, establishing (i) the post-divorce regulation of parental rights at § 24, (ii) the striedavá osobná starostlivosť (alternating personal care) framework at § 24 (2) + (3), (iii) the styk (contact) framework at § 25, and (iv) the modification framework at § 28.

Slovakia is doctrinally distinctive among CEE jurisdictions because the 2005 Zákon o rodine § 24 (2) expressly codifies the striedavá osobná starostlivosť (alternating personal care) as a court-orderable structural option — making Slovakia one of the earliest CEE jurisdictions to expressly codify alternating-care as a residence-allocation option, predating the equivalent Czech Pl. ÚS 26/2014 jurisprudence.

§ 24 Zákona o rodine — Práva a povinnosti rodičov k maloletému dieťaťu po rozvode

(1) V rozhodnutí, ktorým sa rozvádza manželstvo rodičov maloletého dieťaťa, súd upraví výkon ich rodičovských práv a povinností k maloletému dieťaťu na čas po rozvode, najmä určí, komu maloleté dieťa zverí do osobnej starostlivosti, kto ho bude zastupovať a spravovať jeho majetok. Súčasne určí, ako má rodič, ktorému nebolo maloleté dieťa zverené do osobnej starostlivosti, prispievať na jeho výživu, alebo schváli dohodu rodičov o výške výživného.

(2) Ak sú obidvaja rodičia spôsobilí dieťa vychovávať a ak majú o osobnú starostlivosť o dieťa obidvaja rodičia záujem, súd môže zveriť dieťa do striedavej osobnej starostlivosti obidvoch rodičov, ak je to v záujme dieťaťa a ak budú takto lepšie zaistené potreby dieťaťa. Ak so striedavou osobnou starostlivosťou súhlasí aspoň jeden z rodičov dieťaťa, súd musí skúmať, či bude striedavá osobná starostlivosť v záujme dieťaťa.

(4) Súd pri rozhodovaní o výkone rodičovských práv a povinností alebo pri schvaľovaní dohody rodičov rešpektuje právo maloletého dieťaťa na zachovanie jeho vzťahu k obidvom rodičom a vždy prihliadne na záujem maloletého dieťaťa, najmä na jeho citové väzby, vývinové potreby, stabilitu budúceho výchovného prostredia a ku schopnosti rodiča dohodnúť sa na výchove dieťaťa s druhým rodičom. Súd dbá, aby bolo rešpektované právo dieťaťa na výchovu a starostlivosť zo strany obidvoch rodičov a aby bolo rešpektované právo dieťaťa na udržovanie pravidelného, rovnocenného a rovnoprávneho osobného styku s obidvomi rodičmi.

§ 25 Zákona o rodine — Styk rodičov s maloletým dieťaťom

(1) Dohoda o styku rodičov s maloletým dieťaťom nemusí byť súčasťou rozhodnutia o rozvode. Ak rodičia neuzavrú dohodu, súd upraví styk rodičov s maloletým dieťaťom v rozhodnutí o rozvode; to neplatí, ak je to v rozpore so záujmom maloletého dieťaťa.

(2) Ak je to potrebné v záujme maloletého dieťaťa, súd obmedzí styk maloletého dieťaťa s rodičom alebo ho zakáže.

(3) Ak je to potrebné v záujme maloletého dieťaťa a ak to vyžadujú pomery v rodine, súd upraví styk dieťaťa aj s blízkymi osobami.

§ 28 Zákona o rodine — Obsah rodičovských práv a povinností

(1) Súčasťou rodičovských práv a povinností sú najmä

a) sústavná a dôsledná starostlivosť o výchovu, zdravie, výživu a všestranný vývoj maloletého dieťaťa,

b) zastupovanie maloletého dieťaťa,

c) správa majetku maloletého dieťaťa.

(2) Rodičovské práva a povinnosti majú obaja rodičia. Pri ich výkone sú povinní chrániť záujmy maloletého dieťaťa.

(3) Rodičovské práva a povinnosti vykonávajú rodičia po vzájomnej dohode. Ak sa rodičia nedohodnú o podstatných veciach týkajúcich sa výkonu rodičovských práv a povinností, najmä o vysťahovaní maloletého dieťaťa do cudziny, o štátnom občianstve maloletého dieťaťa, o udelení súhlasu na poskytovanie zdravotnej starostlivosti a o príprave na budúce povolanie, rozhodne na návrh niektorého z rodičov súd.

English working translation

§ 24 Family Act — Rights and obligations of parents toward the minor child after divorce

(1) In the decision dissolving the marriage of parents of a minor child, the court regulates the exercise of their parental rights and obligations toward the minor child for the period after divorce, in particular determining to whom the minor child is entrusted to personal care, who will represent the child and manage the child's property. At the same time, the court determines how the parent to whom the minor child is not entrusted to personal care will contribute to maintenance, or confirms the parents' agreement on the amount of maintenance.

(2) Where both parents are capable of raising the child and where both parents have an interest in personal care of the child, the court may entrust the child to alternating personal care (striedavá osobná starostlivosť) of both parents where this is in the interest of the child and where the child's needs will thus be better secured. Where at least one of the parents agrees with alternating personal care, the court must examine whether alternating personal care will be in the interest of the child.

(4) The court, in deciding on the exercise of parental rights and obligations or in confirming the parents' agreement, respects the right of the minor child to maintain the relationship to both parents and always takes into account the interest of the minor child, in particular his/her emotional bonds, developmental needs, stability of the future educational environment, and the capacity of the parent to agree with the other parent on the upbringing of the child. The court ensures (dbá) that the child's right to upbringing and care from both parents is respected and that the child's right to maintain regular, equivalent, and equal-right personal contact with both parents is respected.

§ 25 Family Act — Contact of parents with the minor child

(1) The agreement on contact of parents with the minor child need not be part of the divorce decision. Where parents do not conclude an agreement, the court regulates contact of parents with the minor child in the divorce decision; this does not apply where this is contrary to the interest of the minor child.

(2) Where it is necessary in the interest of the minor child, the court restricts the contact of the minor child with a parent or prohibits it.

(3) Where it is necessary in the interest of the minor child and where it is required by the circumstances in the family, the court also regulates contact of the child with close persons (blízke osoby).

§ 28 Family Act — Content of parental rights and obligations

(1) Parental rights and obligations include in particular:

a) continuous and consistent care for the upbringing, health, maintenance, and all-round development of the minor child,

b) representation of the minor child,

c) management of property of the minor child.

(2) Parental rights and obligations belong to both parents. In their exercise, they are obliged to protect the interests of the minor child.

(3) Parental rights and obligations are exercised by parents by mutual agreement. Where parents do not reach agreement on substantial matters concerning the exercise of parental rights and obligations, in particular on moving the minor child abroad, citizenship, granting consent to medical care, and preparation for future profession, the court decides on the application of one of the parents.

Why this matters for PA

  • The striedavá osobná starostlivosť structural option (§ 24 (2)). Súd môže zveriť dieťa do striedavej osobnej starostlivosti obidvoch rodičov. The court may entrust the child to alternating personal care of both parents. This is doctrinally distinctive — the 2005 Family Act expressly codified striedavá starostlivosť as a court-orderable structural option, predating the equivalent Czech Pl. ÚS 26/2014 jurisprudence. The triggers are:
  • Obidvaja rodičia spôsobilí dieťa vychovávať — both parents capable of raising
  • Obidvaja rodičia záujem — both parents have interest
  • V záujme dieťaťa — in the child's interest
  • Lepšie zaistené potreby dieťaťa — child's needs better secured
  • The single-parent-consent trigger (§ 24 (2) third sentence). Ak so striedavou osobnou starostlivosťou súhlasí aspoň jeden z rodičov dieťaťa, súd musí skúmať, či bude striedavá osobná starostlivosť v záujme dieťaťa. Where at least one parent agrees with alternating care, the court must examine whether it will be in the child's interest. This is doctrinally important in PA-pattern cases — even where the alienating parent opposes alternating care, the targeted parent's request alone triggers mandatory court examination. The court cannot summarily reject striedavá starostlivosť on alienating-parent opposition.
  • The dbá court-duty formula (§ 24 (4)). Súd dbá, aby bolo rešpektované právo dieťaťa na výchovu a starostlivosť zo strany obidvoch rodičov. The court ensures (dbá) that the child's right to upbringing and care from both parents is respected. The dbá (ensures) framing is doctrinally distinctive — it codifies an active court duty, not merely a discretionary consideration. The structural Slovak parallel to:

  • The schopnosti rodiča dohodnúť sa factor (§ 24 (4)). Schopnosti rodiča dohodnúť sa na výchove dieťaťa s druhým rodičom. The capacity of the parent to agree with the other parent on the upbringing of the child. This is the express cooperation-capacity factor — alienating conduct demonstrates a structural deficit in this capacity. In PA-pattern cases this provides direct doctrinal anchor for treating sustained alienating conduct as engaging the welfare-relevant factor.
  • The pravidelného, rovnocenného a rovnoprávneho framing (§ 24 (4)). Pravidelného, rovnocenného a rovnoprávneho osobného styku. Regular, equivalent, and equal-right personal contact. The three-adjective framing is doctrinally strong:
  • Pravidelného (regular) — operational continuity
  • Rovnocenného (equivalent) — substantive parity
  • Rovnoprávneho (equal-right) — formal equality
  • This is one of the most contact-protective formulations in CEE law — providing structural foundation for both-parent contact arrangements responsive to PA-pattern findings.
  • The court-regulation default (§ 25 (1)). Ak rodičia neuzavrú dohodu, súd upraví styk rodičov s maloletým dieťaťom v rozhodnutí o rozvode. Where parents do not conclude an agreement, the court regulates contact in the divorce decision. The structural default is judicial regulation — courts proactively fix contact arrangements in divorce proceedings.
  • The blízke osoby extension (§ 25 (3)). Súd upraví styk dieťaťa aj s blízkymi osobami. The court regulates contact of the child with close persons. The blízke osoby (close persons) framing is broader than grandparents — it encompasses any persons in close family relationship. In PA-pattern cases where the alienating parent typically excludes the targeted-parent extended family, art. 25 (3) provides structural protection.
  • The substantial-matters enumeration (§ 28 (3)). Where parents do not agree on substantial matters, the court decides. The enumeration includes:
  • Vysťahovanie do cudziny — moving abroad
  • Štátne občianstvo — citizenship
  • Súhlas na poskytovanie zdravotnej starostlivosti — consent to medical care
  • Príprava na budúce povolanie — preparation for future profession
  • This codifies the substantive-matter framework — alienating-parent unilateral decisions on enumerated matters can be displaced by court application.

  • The competent court is the okresný súd (district court) for parental-responsibility + contact proceedings
