Slovensko Zakon o rodine 36/2005

TL;DR

Slovakia's Family Act 36/2005 Z. z. (effective 1 April 2005) replaced the 1963 socialist-era code. Sections 28-40 govern parental rights. Section 29 obligates both parents to refrain from any conduct damaging the other's relationship with the child. Stridava starostlivost (alternating custody) was codified in 2010. Najvyssi sud has built jurisprudence treating systematic contact obstruction as grounds for residence transfer.

Statutory Framework

Section 28 — Parental Rights

Parental rights and obligations encompass care, upbringing, supervision, representation, and management of the child's property.

Section 29 — Cooperation + Anti-Alienation Duty

Both parents must ensure proper upbringing and act in mutual agreement on essential matters. The 2016 amendment strengthened the anti-alienation reading.

Section 36 — Custody After Separation

Court determines: sole custody, alternating (stridava starostlivost), or joint (spolocna starostlivost). Stridava codified 2010.

Section 38 — Best-Interests Catalogue

Includes each parent's willingness to support the child's relationship with the other parent.

Section 25 — Right to Contact

Non-residential parent has right to contact (styk); residential parent must facilitate.

CMP §§ 376-385 — Enforcement

Fines (poriadkova pokuta) and custody reassignment in extreme cases.

Najvyssi sud Jurisprudence

  • NS SR 4 Cdo 248/2018: contact obstruction is grounds for residence transfer
  • NS SR 6 Cdo 191/2021: stridava requires genuine cooperation; uncooperative parent loses
  • US SR I. US 119/2021: positive Article 8 obligation to enforce contact

  • Ribic v Slovakia (2014): violation for failure to enforce contact
  • Slovak courts cite Strand Lobben v Norway extensively

Comparative Note

Slovak + Czech family law share pre-1993 Czechoslovak heritage. Both recognize stridava. Czech NOZ 2012 unified family into civil code; Slovakia retains standalone Family Act.
