The parental supervision + contact framework of the 2014 Hungarian Civil Code. The new Polgári Törvénykönyv (Ptk) recodified Hungarian family law as Book IV (Családjog), consolidating the previous 1952 Family Law Act. The §§ 4:167-4:181 cluster establishes (i) joint exercise of szülői felügyelet (parental supervision) at § 4:167, (ii) the welfare standard at § 4:171, and (iii) the kapcsolattartás (contact) framework at §§ 4:178-181.

Hungary is doctrinally distinctive among CEE jurisdictions because the 2014 Ptk § 4:181 (5) expressly codifies a parental cooperation duty with reference to contact — making Hungarian law one of the structurally most contact-protective frameworks in CEE. The Kúria has further developed the gyermek érdeke welfare standard through Constitutional Court jurisprudence.

§ 4:167 Ptk — A szülői felügyelet közös gyakorlása¶
(1) A különélő szülők a gyermek sorsát érintő lényeges kérdésekben közösen gyakorolják jogaikat akkor is, ha a szülői felügyeletet a szülők megállapodása vagy a bíróság döntése alapján az egyik szülő gyakorolja, kivéve, ha a gyermekétől különélő szülő felügyeleti jogát a bíróság e tekintetben korlátozta vagy megvonta.
(2) A gyermek sorsát érintő lényeges kérdésnek tekintendő a kiskorú gyermek nevének meghatározása és megváltoztatása, a szülőjével azonos lakóhelyének vagy tartózkodási helyének, illetve huzamos időtartamú vagy letelepedés céljából történő külföldi tartózkodási helyének kijelölése, állampolgárságának megváltoztatása és iskolájának, életpályájának megválasztása.
§ 4:171 Ptk — Szülői felügyelet gyakorlásának rendezése¶
(1) A különélő szülők megállapodásának hiányában a bíróság a gyermek érdekét mérlegelve dönt arról, hogy a szülői felügyeletet melyik szülő gyakorolja.
(2) A bíróság a szülői felügyelet gyakorlására azt a szülőt jogosítja fel, akinél a gyermek testi, értelmi és erkölcsi fejlődése biztosítottabb. Ha a szülőnél történő elhelyezés a gyermek érdekét veszélyezteti, a bíróság a gyermeket másnál is elhelyezheti, feltéve hogy ez a személy a nála történő elhelyezést maga is kéri.
(4) A bíróság a szülők közös kérelmére közös szülői felügyeletet rendelhet el, ha a szülők megegyeznek a gyermek elhelyezésében és a kapcsolattartásban.
§ 4:178 Ptk — A kapcsolattartás joga és kötelezettsége¶
(1) A gyermeknek joga, hogy különélő szülőjével személyes és közvetlen kapcsolatot tartson fenn.
(2) A gyermekétől különélő szülő — ha a bíróság vagy a gyámhatóság eltérően nem rendelkezik — jogosult és köteles gyermekével kapcsolatot tartani, a gyermeket nevelő szülő vagy más személy köteles a zavartalan kapcsolattartást biztosítani.
§ 4:181 Ptk — A kapcsolattartás rendezése és módja¶
(1) A különélő szülők megegyezésének hiányában a kapcsolattartásról — a szülői felügyelet gyakorlására vonatkozó döntés vagy a gyermek harmadik személynél történő elhelyezése iránti perben — a bíróság, egyéb esetekben a gyámhatóság dönt. A kapcsolattartásról a házassági vagy az élettársi vagyonjogi perben akkor is dönt a bíróság, ha azt nem kérik, de a felek között nincs e tárgyban megállapodás.
(5) Ha a kapcsolattartásra jogosult vagy a kapcsolattartásra köteles személy a kapcsolattartást szabályozó egyezséget vagy határozatot megszegi, akkor az okozott kárért a polgári jogi felelősség szabályai szerint felel. A kapcsolattartás végrehajtásával kapcsolatos eljárás a gyámhatóság hatáskörébe tartozik.

§ 4:167 Ptk — Joint exercise of parental supervision¶
(1) Parents living separately jointly exercise their rights in matters essentially affecting the child's fate (gyermek sorsát érintő lényeges kérdések), even where parental supervision is exercised by one parent under agreement of the parents or court decision, unless the court has restricted or withdrawn the supervision right of the parent living separately from the child in this respect.
(2) Matters essentially affecting the child's fate include: determination and change of the minor child's name, designation of the child's residence or place of stay at the parent (or extended/foreign residence for settlement purposes), change of nationality, and choice of the child's school and life path.
§ 4:171 Ptk — Regulation of the exercise of parental supervision¶
(1) In the absence of agreement between the parents living separately, the court decides which parent shall exercise parental supervision, weighing the interest of the child (gyermek érdekét mérlegelve).
(2) The court entrusts the exercise of parental supervision to the parent with whom the child's physical, intellectual, and moral development is more secured. Where placement with the parent endangers the child's interest, the court may place the child with another person, provided that this person also applies for the placement.
(4) Upon the joint application of the parents, the court may order joint parental supervision (közös szülői felügyelet), where the parents agree on the child's placement and on contact.
§ 4:178 Ptk — Right and obligation of contact¶
(1) The child has the right (a gyermeknek joga) to maintain personal and direct contact with the parent living separately.
(2) The parent living separately from the child — unless the court or the guardianship authority (gyámhatóság) decides otherwise — is entitled and obliged (jogosult és köteles) to maintain contact with his/her child; the parent or other person raising the child is obliged to ensure undisturbed contact (zavartalan kapcsolattartást biztosítani).
§ 4:181 Ptk — Regulation and manner of contact¶
(1) In the absence of agreement between the parents living separately, the court decides on contact — in proceedings on the exercise of parental supervision or on the child's placement with a third person — and in other cases the guardianship authority decides. The court also decides on contact in matrimonial or cohabitation property law proceedings even where it is not requested, where there is no agreement between the parties on this subject.
(5) Where the person entitled to contact or the person obliged to maintain contact breaches the contact-regulating settlement or decision, this person is liable for the damage caused under the rules of civil law liability. The proceedings related to the enforcement of contact fall within the competence of the guardianship authority.
Why this matters for PA¶
- The joint exercise of essential matters (§ 4:167 (1)). A különélő szülők a gyermek sorsát érintő lényeges kérdésekben közösen gyakorolják jogaikat. Parents living separately jointly exercise their rights in matters essentially affecting the child's fate, even where one parent is the day-to-day primary carer. This is doctrinally significant: even in sole-supervision arrangements, the non-resident parent retains joint authority over lényeges kérdések (essential matters) by default. In PA-pattern cases this provides structural protection against the alienating parent's unilateral decision-making on school, healthcare, name changes, and international residence.
- The lényeges kérdések enumeration (§ 4:167 (2)). The Ptk expressly enumerates the essential matters — name, residence, foreign residence, nationality, school, life path. This is the doctrinal foundation for the targeted parent's structural standing in PA-pattern cases — the alienating parent cannot lawfully change the child's school, nationality, or residence without joint consent (or court override).
- The biztosítottabb fejlődés test (§ 4:171 (2)). Annál a szülőnél, akinél a gyermek testi, értelmi és erkölcsi fejlődése biztosítottabb. The parent with whom the child's physical, intellectual, and moral development is more secured. This is the Hungarian custody-allocation standard — biztosítottabb (more secured) is a comparative standard, not an absolute threshold. In PA-pattern cases the alienating parent's conduct demonstrates insufficient securing of the child's erkölcsi fejlődés (moral development) — sustained alienating conduct is a moral-development deficit engaging § 4:171 (2).
- The right framing for the child (§ 4:178 (1)). A gyermeknek joga, hogy különélő szülőjével személyes és közvetlen kapcsolatot tartson fenn. The child has the right to maintain personal and direct contact with the parent living separately. This is doctrinally distinctive — Hungarian law expressly frames contact as the child's right (not just the parent's right), providing structural protection against alienating-parent framings.
- The jogosult és köteles framing for the non-resident parent (§ 4:178 (2)). Jogosult és köteles — entitled and obliged. The non-resident parent has both the right and the obligation to maintain contact. This is the structural parallel to:

- Norwegian barneloven § 42 second paragraph plikt
- The köteles (obliged) framing closes the structural gap where the targeted parent could be alleged to have abandoned the relationship — passivity in the face of alienation is not lawful.
- The undisturbed contact duty (§ 4:178 (2)). A gyermeket nevelő szülő vagy más személy köteles a zavartalan kapcsolattartást biztosítani. The parent or other person raising the child is obliged to ensure undisturbed contact. This is the structural Hungarian Wohlverhaltensklausel equivalent — codifying the resident parent's affirmative duty to ensure (biztosítani) undisturbed (zavartalan) contact. In PA-pattern cases this provides the doctrinal foundation for findings of breach where the resident parent has obstructed contact or failed to facilitate it.
- The civil-liability framework (§ 4:181 (5)). Az okozott kárért a polgári jogi felelősség szabályai szerint felel. The breaching party is liable for damage under civil-law liability rules. This is doctrinally distinctive — Hungarian law expressly codifies civil damages liability for contact-order breaches. In PA-pattern cases this provides a structural enforcement mechanism beyond the typical fine/coercive-measures framework of comparable European jurisdictions.
- The guardianship-authority enforcement role (§ 4:181 (5) end). A kapcsolattartás végrehajtásával kapcsolatos eljárás a gyámhatóság hatáskörébe tartozik. The enforcement of contact falls within the competence of the gyámhatóság (guardianship authority). This is the Hungarian structural enforcement model — administrative rather than purely civil-litigation, providing structurally faster and less adversarial enforcement than the comparable German Familiengerichtsvollstreckung framework.
