The parental-responsibility + contact framework of the 2014 Czech Civil Code. The Nový občanský zákoník (NOZ) recodified Czech family law as Part Two of the Civil Code (Family Law), consolidating what was previously the separate Zákon o rodině (Family Law Act 94/1963). Czech law is doctrinally distinctive among Central European jurisdictions because the 2014 NOZ § 907 expressly enumerates three residence options including střídavá péče (alternating care) as a structural option — and Czech Constitutional Court jurisprudence (Ústavní soud) has developed the zájem dítěte welfare standard into one of the strongest in CEE.

§ 865 NOZ — Obsah rodičovské odpovědnosti¶
(1) Rodičovská odpovědnost zahrnuje povinnosti a práva rodičů, která spočívají v péči o dítě, zahrnující zejména péči o jeho zdraví, jeho tělesný, citový, rozumový a mravní vývoj, v ochraně dítěte, v udržování osobního styku s dítětem, v zajišťování jeho výchovy a vzdělání, v určení místa jeho bydliště, v jeho zastupování a spravování jeho jmění; vzniká narozením dítěte a zaniká, jakmile dítě nabude plné svéprávnosti.
§ 884 NOZ — Vzájemné povinnosti rodičů a dítěte¶
(1) Rodiče mají rozhodující úlohu ve výchově dítěte. Rodiče mají být všestranně příkladem svým dětem, zejména pokud se jedná o způsob života a chování v rodině.
(2) Výchovné prostředky lze použít pouze v podobě a míře, která je přiměřená okolnostem, neohrožuje zdraví dítěte ani jeho rozvoj a nedotýká se lidské důstojnosti dítěte.
§ 888 NOZ — Styk dítěte s rodičem¶
Dítě, které je v péči jen jednoho rodiče, má právo stýkat se s druhým rodičem v rozsahu, který je v zájmu dítěte, stejně jako tento rodič má právo stýkat se s dítětem, ledaže soud takový styk omezí nebo zakáže.
§ 891 NOZ — Povinnosti a práva ohledně styku¶
(1) Rodiče se ve výchově dítěte mají dohodnout. Rodič, který má dítě v péči, a druhý rodič spolu musejí jednat v zájmu dítěte a respektovat se navzájem.
(2) Rodič, který má dítě v péči, je povinen umožnit styk dítěte s druhým rodičem v souladu se zájmem dítěte. Pokud je to potřebné v zájmu dítěte, soud styk dítěte s rodičem omezí nebo zakáže.
§ 907 NOZ — Rozhodnutí o péči o dítě po rozvodu¶
(1) Soud může svěřit dítě do péče jednoho z rodičů, nebo do střídavé péče, nebo do společné péče; soud může dítě svěřit i do péče jiné osoby než rodiče, je-li to potřebné v zájmu dítěte. Při rozhodování o svěření do péče soud rozhoduje tak, aby rozhodnutí odpovídalo zájmu dítěte. Soud přitom bere ohled na osobnost dítěte, zejména na jeho vlohy a schopnosti ve vztahu k vývojovým možnostem a životním poměrům rodičů, jakož i na citovou orientaci a zázemí dítěte, na výchovné schopnosti každého z rodičů, na stávající a očekávanou stálost výchovného prostředí, v němž má dítě napříště žít, na citové vazby dítěte k jeho sourozencům, prarodičům, popřípadě dalším příbuzným i nepříbuzným osobám.
(2) Soud vezme v úvahu, kdo doposud o dítě řádně pečoval a řádně dbal o jeho citovou, rozumovou a mravní výchovu, jakož i v jakém prostředí má dítě bydlet.
(3) Soud dbá, aby bylo respektováno právo dítěte na péči obou rodičů a udržování pravidelného osobního styku s nimi, právo druhého rodiče, jemuž dítě nebude svěřeno, na pravidelnou informaci o dítěti, dále soud bere zřetel rovněž k citové vazbě dítěte k druhému z rodičů, k jeho sourozencům, prarodičům, popřípadě k dalším příbuzným.
English working translation¶
§ 865 NOZ — Content of parental responsibility¶
(1) Parental responsibility encompasses the duties and rights of parents that consist in care for the child, including in particular care for the child's health, physical, emotional, intellectual, and moral development; in protection of the child; in maintaining personal contact with the child; in ensuring the child's upbringing and education; in determining the child's place of residence; in representing the child and managing the child's property; it arises with the birth of the child and ceases when the child acquires full legal capacity.
§ 884 NOZ — Mutual duties of parents and child¶
(1) Parents have the decisive role in the child's upbringing. Parents shall be all-round examples to their children, in particular in their way of life and conduct within the family.
(2) Educational measures may be used only in a form and to a degree which is proportionate to the circumstances, does not endanger the child's health or development, and does not affect the child's human dignity.
§ 888 NOZ — Contact of the child with the parent¶
The child who is in the care of only one parent has the right to maintain contact with the other parent to the extent that is in the interest of the child, as does the parent have the right to maintain contact with the child, unless the court restricts or prohibits such contact.
§ 891 NOZ — Duties and rights regarding contact¶
(1) Parents shall reach agreement on the upbringing of the child. The parent who has the child in his/her care and the other parent shall act in the interest of the child and respect each other.
(2) The parent who has the child in his/her care is obliged to enable the child's contact with the other parent in accordance with the interest of the child. Where necessary in the interest of the child, the court restricts or prohibits the contact of the child with a parent.
§ 907 NOZ — Decision on care of the child after divorce¶
(1) The court may entrust the child to the care of one parent, or to alternating care (střídavá péče), or to joint care (společná péče); the court may also entrust the child to the care of a person other than a parent, where this is necessary in the interest of the child. In deciding on the entrustment of care, the court decides in such a way that the decision corresponds to the interest of the child. The court has regard to the personality of the child, in particular his/her dispositions and abilities in relation to developmental possibilities and the living conditions of the parents, as well as to the emotional orientation and background of the child, to the educational abilities of each parent, to the existing and expected stability of the educational environment in which the child is to live henceforth, and to the emotional bonds of the child with his/her siblings, grandparents, and possibly other related and unrelated persons.
(2) The court takes into account who has hitherto properly cared for the child and properly looked after the child's emotional, intellectual, and moral upbringing, as well as the environment in which the child is to live.
(3) The court ensures that the child's right to care from both parents and to maintain regular personal contact with them is respected, and the right of the other parent (to whom the child will not be entrusted) to regular information about the child; the court further takes into account the emotional bond of the child to the other parent, to his/her siblings, grandparents, and possibly other relatives.
Why this matters for PA¶
- The right + duty framing (§ 865 (1)). Rodičovská odpovědnost includes udržování osobního styku s dítětem — maintaining personal contact with the child — as part of the substantive content of parental responsibility. This is doctrinally important: contact is not a separate parental entitlement but a constitutive element of parental responsibility. In PA-pattern cases the alienating parent's frustration of contact engages a deficit in the substantive content of their parental responsibility, not merely a peripheral breach.
- The respektovat se navzájem cooperation duty (§ 891 (1)). Rodič, který má dítě v péči, a druhý rodič spolu musejí jednat v zájmu dítěte a respektovat se navzájem. The parent who has the child in care and the other parent must act in the interest of the child and respect each other. This is the Czech structural parallel to:

- Austrian Wohlverhaltensgebot ABGB § 159
- The respektovat se navzájem (respect each other) phrasing is doctrinally significant — it codifies the mutual respect component of cooperation, providing structural foundation for PA-pattern findings where the alienating parent's conduct demonstrates disrespect for the targeted parent's role.
- The umožnit styk duty (§ 891 (2)). Rodič, který má dítě v péči, je povinen umožnit styk dítěte s druhým rodičem v souladu se zájmem dítěte. The resident parent is obliged to enable (povinen umožnit) the child's contact with the other parent. This codifies an affirmative facilitation duty — the resident parent must enable contact, not merely refrain from obstructing it. In PA-pattern cases this provides structural foundation for findings that passive non-facilitation constitutes breach.
- The střídavá péče alternative (§ 907 (1)). The 2014 NOZ expressly enumerates three care-allocation options: jeden z rodičů (one parent), střídavá péče (alternating care), or společná péče (joint care). The Czech Ústavní soud's Nález Pl. ÚS 26/2014 + subsequent Pl. ÚS 23/2008 line has developed the doctrine that střídavá péče is the structurally preferred option absent specific contraindication — making the Czech framework one of the most explicitly shared-residence-favoring in Europe.
- The § 907 enumerated welfare factors. Subsection (1) enumerates the welfare factors:
- Child's personality, dispositions, abilities
- Emotional orientation and background
- Parents' výchovné schopnosti (educational abilities) — engages PA-pattern findings
- Stability of educational environment
- Emotional bonds with siblings, grandparents, other relatives
- The výchovné schopnosti factor engages PA-pattern conduct findings — sustained alienating conduct demonstrates a deficit in the alienating parent's výchovné schopnosti.
- The § 907 (3) right-to-both-parents formula. Soud dbá, aby bylo respektováno právo dítěte na péči obou rodičů a udržování pravidelného osobního styku s nimi. The court ensures (dbá) that the child's right to care from both parents and to maintain regular personal contact is respected. This is one of the strongest both-parent-care formulations in CEE — codified as a structural court duty (dbá), not a discretionary consideration.
- The Ústavní soud zájem dítěte doctrine. The Czech Constitutional Court has developed the zájem dítěte (interest of the child) welfare standard into one of the strongest in CEE, including the explicit recognition that zájem dítěte requires the court to engage with PA-pattern findings as an independent welfare-relevant consideration — see Pl. ÚS 26/2014 + I. ÚS 3304/13.
