The parental rights + personal-relations framework of the 2009 Bulgarian Family Code. Семеен кодекс (СК — Family Code 2009) replaced the 1985 socialist-era code, establishing (i) the joint exercise of родителски права (parental rights) at art. 122-123, (ii) the divorce-related residence framework at arts. 124-126, (iii) the personal-relations framework at art. 128, and (iv) the welfare standard at art. 127.

Bulgaria is doctrinally distinctive among SE-European jurisdictions because the 2009 SK art. 124 (3) expressly enumerates the welfare factors the court considers when fixing residence, and art. 128 codifies the лични отношения (personal relations) framework with both grandparent and sibling extensions. The Върховен касационен съд has further developed the интерес на детето welfare standard through Constitutional Court reception of ECHR jurisprudence.

Чл. 122 СК — Носители на родителските права и задължения

(1) Носител на родителски права и задължения по отношение на ненавършилите пълнолетие деца е всеки родител.

(2) Родителите имат равни права и задължения, независимо от това, дали са в брак.

(3) Родителите се разбират помежду си за упражняване на родителските права и задължения. При разногласие те могат да се обърнат към медиатор или да предявят иск пред районния съд по настоящия адрес на детето, който решава спора, след като изслуша родителите, а при необходимост — и детето. Решението може да се обжалва по общия ред.

Чл. 124 СК — Права на детето

(1) Детето има право да бъде отглеждано и възпитавано по начин, който да осигурява неговото нормално физическо, умствено, нравствено и социално развитие.

(2) Детето има право на лични отношения с родителите си.

(3) Детето има право да иска от районния съд по настоящия си адрес защита срещу неоснователно ограничаване на правата по ал. 1 и 2, както и срещу извършване на действия, които въздействат отрицателно на неговите интереси, личност, възпитание и здраве.

Чл. 127 СК — Спорове между родителите

(1) Когато родителите не живеят заедно, те могат да постигнат съгласие относно местоживеенето на детето, упражняването на родителските права, личните отношения с него и издръжката му. Те могат да поискат от районния съд по настоящия адрес на детето да утвърди споразумението им. Споразумението има сила на изпълнително основание по чл. 404, т. 1 от Гражданския процесуален кодекс.

(2) Ако не се постигне споразумение по ал. 1, спорът се решава от районния съд по настоящия адрес на детето, който се произнася относно местоживеенето на детето, упражняването на родителските права, личните отношения с детето и издръжката съгласно чл. 59, 142, 143 и 144. Решението може да се обжалва по общия ред.

Чл. 128 СК — Лични отношения с членовете на разширеното семейство

(1) Дядото и бабата могат да поискат от районния съд по настоящия адрес на детето да определи мерки за лични отношения с него, ако това е в интерес на детето. Това право има и детето.

Art. 122 SK — Bearers of parental rights and obligations

(1) The bearer of parental rights and obligations in respect of minor children is each parent.

(2) Parents have equal rights and obligations, irrespective of whether they are married.

(3) Parents reach agreement among themselves on the exercise of parental rights and obligations. In case of disagreement, they may refer to a mediator or bring an action before the district court at the child's current address, which decides the dispute after hearing the parents and, where necessary, the child. The decision may be appealed under the general procedure.

Art. 124 SK — Rights of the child

(1) The child has the right to be raised and brought up in a manner ensuring its normal physical, mental, moral, and social development.

(2) The child has the right to personal relations with his/her parents.

(3) The child has the right to seek protection from the district court at his/her current address against unjustified restriction of the rights under paragraphs (1) and (2), as well as against the commission of acts that have a negative impact on his/her interests, personality, upbringing, and health.

Art. 127 SK — Disputes between parents

(1) Where parents do not live together, they may reach agreement on the residence of the child, the exercise of parental rights, the personal relations with the child, and the maintenance. They may request the district court at the child's current address to confirm their agreement. The agreement has the force of an enforceable basis under art. 404, item 1 of the Code of Civil Procedure.

(2) If no agreement is reached under paragraph (1), the dispute is decided by the district court at the child's current address, which rules on the residence of the child, the exercise of parental rights, the personal relations, and the maintenance under arts. 59, 142, 143, and 144. The decision may be appealed under the general procedure.

Art. 128 SK — Personal relations with extended-family members

(1) Grandparents may request the district court at the child's current address to determine measures for personal relations with the child, where this is in the interest of the child. The child also has this right.

Why this matters for PA

  • Equal rights and obligations irrespective of marriage (art. 122 (2)). Родителите имат равни права и задължения, независимо от това, дали са в брак. This is the structural Bulgarian parallel to the post-Zaunegger reforms in DACH jurisdictions — unmarried parents are not structurally disadvantaged. In PA-pattern cases involving unmarried parents this provides equal-standing protection for the targeted parent.
  • The agreement-or-mediation pathway (art. 122 (3)). Родителите се разбират помежду си … При разногласие те могат да се обърнат към медиатор или да предявят иск. Parents reach agreement; in case of disagreement they may refer to a mediator or bring an action. This is the structural mediation-first design — the Bulgarian framework expressly identifies медиатор (mediator) as the first-tier dispute-resolution pathway before judicial litigation.
  • The child's right to personal relations (art. 124 (2)). Детето има право на лични отношения с родителите си. The child has the right to лични отношения (personal relations) with his/her parents. The лични отношения framing is doctrinally broader than mere contact — it encompasses the relational-substantive interest. In PA-pattern cases this provides structural protection against framings that contact is logistical visitation rather than substantive relationship.
  • The child's standing to seek protection (art. 124 (3)). Детето има право да иска от районния съд … защита срещу неоснователно ограничаване … срещу извършване на действия, които въздействат отрицателно на неговите интереси, личност, възпитание и здраве. The child has the right to seek court protection against unjustified restriction of the rights and against the commission of acts that have a negative impact on his/her interests, personality, upbringing, and health. This is doctrinally distinctive — the child has independent standing to seek protection. In PA-pattern cases this provides:
  • Structural protection against alienating-parent obstruction of the targeted-parent relationship (engaging the "negative impact on personality" prong)
  • Independent procedural pathway for the child where the targeted parent is unable to litigate effectively
  • Statutory anchor for guardian ad litem engagement in PA-pattern proceedings
  • The cooperation duty (art. 122 (3) first sentence). Родителите се разбират помежду си за упражняване на родителските права и задължения. Parents reach agreement among themselves on the exercise of parental rights. The cooperation duty is the operational anchor — sustained alienating conduct that prevents разбиране помежду си engages the court's intervention jurisdiction.
  • The settlement-as-executable-basis mechanism (art. 127 (1)). Споразумението има сила на изпълнително основание по чл. 404, т. 1 от Гражданския процесуален кодекс. The settlement has the force of an enforceable basis under the Code of Civil Procedure. This is doctrinally important — court-confirmed agreements are immediately enforceable, providing structural protection against post-settlement frustration by the alienating parent.
  • The four-factor adjudication framework (art. 127 (2)). Where no agreement is reached, the court rules on:

  • This is the Bulgarian structural decision-framework. In PA-pattern cases all four factors are typically engaged.
  • The grandparents extension (art. 128). Дядото и бабата могат да поискат … мерки за лични отношения. Grandparents may request measures for personal relations. The детето също има това право (the child also has this right) clause is doctrinally distinctive — codifying the child's independent right to seek grandparent contact. In PA-pattern cases where the alienating parent typically excludes the targeted-parent extended family, art. 128 provides structural protection.

Procedural application

  • The competent court is the районен съд (district court) at the child's настоящ адрес (current address) for parental-rights + personal-relations proceedings
  • Дирекция "Социално подпомагане" (Social Assistance Directorate — DSP) provides welfare assessment via Отдел "Закрила на детето" (Child Protection Department)
  • The child is heard under art. 15 of Закона за закрила на детето (Child Protection Act) — capacity-based standard, age 10 as practical floor for direct hearing
  • Медиация under Закон за медиацията is structurally available as first-tier dispute resolution
  • Appellate review to the окръжен съд (regional court) + cassation to the Върховен касационен съд

Use in alienating-conduct cases
