The contact-rights framework in Polish family law. Poland is doctrinally distinctive among the Central-Eastern European jurisdictions because the 2009 reform expressly codified contact as both prawo i obowiązek (right and obligation) of the parent — closing the structural gap where the targeted parent could be passive in the face of alienation. The framework also expressly enumerates seven categories of contact at art. 113¹, providing structural flexibility for court orders responsive to PA-pattern cases.

Art. 113 KRO — Prawo i obowiązek kontaktów

§ 1. Niezależnie od władzy rodzicielskiej rodzice oraz ich dziecko mają prawo i obowiązek utrzymywania ze sobą kontaktów.

§ 2. Kontakty z dzieckiem obejmują w szczególności przebywanie z dzieckiem (odwiedziny, spotkania, zabieranie dziecka poza miejsce jego stałego pobytu) i bezpośrednie porozumiewanie się, utrzymywanie korespondencji, korzystanie z innych środków porozumiewania się na odległość, w tym ze środków komunikacji elektronicznej.

Art. 113¹ KRO — Forma kontaktów ustalana przez sąd

§ 1. Jeżeli dziecko przebywa stale u jednego z rodziców, sposób utrzymywania kontaktów z dzieckiem przez drugiego z nich rodzice określają wspólnie, kierując się dobrem dziecka i biorąc pod uwagę jego rozsądne życzenia; w braku porozumienia rozstrzyga sąd opiekuńczy.

§ 2. Przepisy § 1 stosuje się odpowiednio, jeżeli dziecko nie przebywa u żadnego z rodziców, a pieczę nad nim sprawuje opiekun lub gdy zostało umieszczone w pieczy zastępczej.

Art. 113² KRO — Ograniczenie utrzymywania kontaktów

§ 1. Jeżeli wymaga tego dobro dziecka, sąd opiekuńczy ograniczy utrzymywanie kontaktów rodziców z dzieckiem.

§ 2. Sąd opiekuńczy może w szczególności:

1) zakazać spotykania się z dzieckiem;

2) zakazać zabierania dziecka poza miejsce jego stałego pobytu;

3) zezwolić na spotykanie się z dzieckiem tylko w obecności drugiego z rodziców albo opiekuna, kuratora sądowego lub innej osoby wskazanej przez sąd;

4) ograniczyć kontakty do określonych sposobów porozumiewania się na odległość;

5) zakazać porozumiewania się na odległość.

Art. 113³ KRO — Zakaz kontaktów

Jeżeli utrzymywanie kontaktów rodziców z dzieckiem poważnie zagraża dobru dziecka lub je narusza, sąd zakaże ich utrzymywania.

Art. 113⁶ KRO — Obowiązek niedziałania niewłaściwie

Przepisy niniejszego oddziału stosuje się odpowiednio do kontaktów rodzeństwa, dziadków, powinowatych w linii prostej, a także innych osób, jeżeli sprawowały one przez dłuższy czas pieczę nad dzieckiem.

Art. 113 KRO — Right and obligation of contact

§ 1. Irrespective of parental authority (władza rodzicielska), parents and their child have the right and the obligation (prawo i obowiązek) to maintain contact with one another.

§ 2. Contact with the child includes in particular being with the child (visits, meetings, taking the child outside of his/her place of permanent residence) and direct communication, maintaining correspondence, using other means of distance communication, including means of electronic communication.

Art. 113¹ KRO — Form of contact determined by the court

§ 1. Where the child permanently resides with one of the parents, the manner of maintaining contact with the child by the other parent is determined by the parents jointly, guided by the welfare of the child (dobro dziecka) and taking into account the child's reasonable wishes (rozsądne życzenia); failing agreement, the guardianship court decides.

§ 2. The provisions of § 1 apply accordingly where the child does not reside with either parent and is in the care of a guardian or has been placed in substitute care.

Art. 113² KRO — Restriction of contact

§ 1. Where the welfare of the child so requires, the guardianship court shall restrict the maintenance of contact between the parents and the child.

§ 2. The guardianship court may in particular:

1) prohibit meetings with the child;

2) prohibit taking the child outside his/her place of permanent residence;

3) permit meetings with the child only in the presence of the other parent or guardian, court-appointed curator, or other person designated by the court;

4) restrict contact to specific means of distance communication;

5) prohibit distance communication.

Art. 113³ KRO — Prohibition of contact

Where the maintenance of contact between the parents and the child seriously endangers (poważnie zagraża) or violates the welfare of the child, the court shall prohibit it.

Art. 113⁶ KRO — Cooperation duty (extension to other relatives)

The provisions of this section apply accordingly to contact with siblings, grandparents, in-laws in a direct line, and other persons, where they have cared for the child for an extended period.

Why this matters for PA

  • This is doctrinally important — contact is not limited to physical presence. In PA-pattern cases this means even where physical contact is restricted, the electronic-communication channel remains structurally protected.
  • The court's adjudication framework (art. 113¹ § 1). W braku porozumienia rozstrzyga sąd opiekuńczy. In the absence of agreement, the guardianship court decides. The standard is dobro dziecka (welfare of the child) + rozsądne życzenia (reasonable wishes) of the child. The rozsądne qualifier is critical in PA-pattern cases — wishes must be reasonable, which permits the court to disregard wishes that are the product of alienating influence.

  • 1° prohibition of meetings
  • 2° prohibition of off-residence
  • 3° supervised contact (in presence of other person)

  • This is the Polish structural graduated-restriction ladder. In PA-pattern cases the court can fashion proportionate intermediate measures rather than binary contact/no-contact decisions.
  • The poważnie zagraża threshold for prohibition (art. 113³). Poważnie zagraża dobru dziecka lub je narusza. Seriously endangers or violates the welfare. This is a high threshold — poważnie (seriously) is structurally stronger than the German Kindeswohlgefährdung threshold or the UK harm-test. Total prohibition under art. 113³ requires demonstrated serious endangerment, not aggregated welfare-suboptimality.
  • The grandparents extension (art. 113⁶). Stosuje się odpowiednio do kontaktów rodzeństwa, dziadków, powinowatych w linii prostej. The framework applies to siblings, grandparents, in-laws in direct line. This is doctrinally important in PA-pattern cases — the alienating parent's typical exclusion of the targeted-parent extended family engages art. 113⁶, providing a parallel structural protection.

  • The competent court is the sąd rejonowy (district court) acting as sąd opiekuńczy (guardianship court) — typically the wydział rodzinny i nieletnich (family and juveniles division)
  • Proceedings are non-contentious under the Kodeks postępowania cywilnego (Code of Civil Procedure)
  • The kurator sądowy (court-appointed curator) provides welfare assessment and supervised-contact oversight
  • The child is heard under KPC art. 216¹ — capacity-based standard
