The cuidado personal + RDR framework of the Chilean Civil Code, as reformed by Ley 20.680 of 2013 ("Ley Amor de Papá"). The 2013 reform replaced the preferencia materna (maternal preference) of pre-reform art. 225 with a corresponsabilidad parental (shared parental responsibility) framework, and codified the relación directa y regular (RDR — direct and regular relationship) as the structural contact provision at art. 229.

Chile is doctrinally distinctive among Latin American jurisdictions because the 2013 reform's elimination of preferencia materna combined with the express corresponsabilidad + RDR codification produced one of the most structurally egalitarian post-separation frameworks in the region. The 2024 Ley 21.675 (Ley Antonia) further reinforced welfare-protective measures in family-law proceedings.

Art. 225 — Cuidado personal

Si los padres viven separados podrán determinar de común acuerdo que el cuidado personal de los hijos corresponda al padre, a la madre o a ambos en forma compartida. El acuerdo se otorgará por escritura pública o acta extendida ante cualquier oficial del Registro Civil, que deberá ser subinscrita al margen de la inscripción de nacimiento del hijo dentro de los treinta días subsiguientes a su otorgamiento. Este acuerdo establecerá la frecuencia y libertad con que el padre o madre que no tiene el cuidado personal mantendrá una relación directa y regular con los hijos y podrá revocarse o modificarse cumpliendo las mismas solemnidades.

El cuidado personal compartido es un régimen de vida que procura estimular la corresponsabilidad de ambos padres que viven separados, en la crianza y educación de los hijos comunes, mediante un sistema de residencia que asegure su adecuada estabilidad y continuidad.

A falta del acuerdo del inciso primero, los hijos continuarán bajo el cuidado personal del padre o madre con quien estén conviviendo.

En cualesquiera de los casos establecidos en este artículo, cuando las circunstancias lo requieran y el interés superior del hijo lo haga conveniente, el juez podrá atribuir el cuidado personal del hijo al otro de los padres, o radicarlo en uno solo de ellos, si por acuerdo existiere alguna forma de ejercicio compartido. Lo anterior debe entenderse sin perjuicio de lo dispuesto en el artículo 226.

En ningún caso el juez podrá fundar exclusivamente su decisión en la capacidad económica de los padres.

Siempre que el juez atribuya el cuidado personal del hijo a uno de los padres, deberá establecer, de oficio o a petición de parte, en la misma resolución, la frecuencia y libertad con que el otro padre o madre que no tiene el cuidado personal mantendrá una relación directa y regular con los hijos, considerando su interés superior.

Art. 227 — Procedimiento

En las materias a que se refieren los artículos precedentes, el juez oirá a los hijos y a los parientes. Las resoluciones que se dicten, una vez ejecutoriadas, se subinscribirán al margen de la inscripción de nacimiento del hijo.

El juez podrá apremiar en la forma señalada en el artículo 543 del Código de Procedimiento Civil, a quien fuere condenado por resolución judicial que cause ejecutoria, a hacer entrega del hijo y no lo hiciere o se negare a hacerlo en el plazo señalado por el tribunal.

Art. 229 — Relación directa y regular

El padre o madre que no tenga el cuidado personal del hijo tendrá el derecho y el deber de mantener con él una relación directa y regular, la que ejercerá con la frecuencia y libertad acordada con quien lo tiene a su cargo, o, en su defecto, con las que el juez estimare conveniente para el hijo.

Se entiende por relación directa y regular aquella que propende a que el vínculo familiar entre el padre o madre que no ejerce el cuidado personal y su hijo se mantenga a través de un contacto periódico y estable. Para su determinación, el juez considerará:

a) La edad del hijo.

b) La vinculación afectiva entre el hijo y su padre o madre, según corresponda, y la relación con sus parientes cercanos.

c) El régimen de cuidado personal del hijo que se haya acordado o determinado.

d) Cualquier otro elemento de relevancia en consideración al interés superior del hijo.

Sea que se decrete judicialmente el régimen de relación directa y regular o en la aprobación de acuerdos de los padres en estas materias, el juez deberá asegurar la mayor participación y corresponsabilidad de éstos en la vida del hijo, estableciendo las condiciones que fomenten una relación sana y cercana.

El padre o madre que ejerza el cuidado personal del hijo no obstaculizará el régimen de relación directa y regular que se establezca a favor del otro padre, conforme a lo preceptuado en este artículo.

Art. 225 — Personal care

If the parents live separately, they may determine by mutual agreement that the personal care of the children corresponds to the father, the mother, or both in shared form. The agreement shall be granted by public deed or act extended before any Civil Registry officer, which must be sub-registered in the margin of the child's birth registration within the thirty days following its grant. This agreement shall establish the frequency and freedom with which the parent who does not have personal care shall maintain a direct and regular relationship with the children and may be revoked or modified by the same solemnities.

Shared personal care (cuidado personal compartido) is a life regime that seeks to stimulate the shared responsibility (corresponsabilidad) of both parents who live separately, in the upbringing and education of common children, through a residence system that ensures their adequate stability and continuity.

In the absence of agreement under the first paragraph, the children shall continue under the personal care of the father or mother with whom they are cohabiting.

In any of the cases established in this article, where the circumstances require it and the superior interest of the child makes it convenient, the judge may attribute the personal care of the child to the other parent, or radicate it in only one of them, if there is some form of shared exercise by agreement. The foregoing must be understood without prejudice to the provisions of art. 226.

In no case may the judge base his/her decision exclusively on the economic capacity of the parents.

Whenever the judge attributes personal care of the child to one of the parents, he/she shall establish, ex officio or upon request of party, in the same resolution, the frequency and freedom with which the other parent who does not have personal care shall maintain a direct and regular relationship with the children, considering their superior interest.

Art. 227 — Procedure

In the matters referred to in the preceding articles, the judge shall hear the children and the relatives. The resolutions issued, once executed, shall be sub-registered in the margin of the child's birth registration.

The judge may compel, in the form specified in art. 543 of the Civil Procedure Code, whoever has been condemned by judicial resolution that causes execution to deliver the child and does not do so or refuses to do so within the period specified by the tribunal.

Art. 229 — Direct and regular relationship

The father or mother who does not have personal care of the child shall have the right and the duty (el derecho y el deber) to maintain with him/her a direct and regular relationship, which shall be exercised with the frequency and freedom agreed with whomever has the child in his/her charge, or, in default, with those that the judge deems convenient for the child.

Direct and regular relationship shall be understood as that which tends (propende) for the family bond between the parent who does not exercise personal care and his/her child to be maintained through periodic and stable contact. For its determination, the judge shall consider:

a) The age of the child.

b) The affective bond between the child and the father or mother, as applicable, and the relationship with his/her close relatives.

c) The personal-care regime of the child that has been agreed or determined.

d) Any other element of relevance considering the superior interest of the child.

Whether the regime of direct and regular relationship is judicially decreed or in the approval of parents' agreements on these matters, the judge shall ensure the greatest participation and shared responsibility of both in the life of the child, establishing the conditions that foster a healthy and close relationship.

The parent who exercises personal care of the child shall not obstruct (no obstaculizará) the regime of direct and regular relationship established in favor of the other parent, in accordance with what is prescribed in this article.

Why this matters for PA

  • Elimination of preferencia materna + corresponsabilidad codification (art. 225 second paragraph). El cuidado personal compartido es un régimen de vida que procura estimular la corresponsabilidad de ambos padres. Shared personal care is a life regime that seeks to stimulate the shared responsibility (corresponsabilidad) of both parents. The 2013 reform expressly removed the preferencia materna that had governed pre-reform art. 225 — eliminating the structural gender presumption. In PA-pattern cases this is doctrinally important: there is no maternal preference to overcome where the alienating parent happens to be the mother.
  • The shared-care option as life regime, not formal allocation. Régimen de vida que procura estimular la corresponsabilidad. The framing as a life regime (régimen de vida) is doctrinally distinctive — cuidado personal compartido in Chile is operational shared parenting, not just legal-status allocation. The residence system must ensure adecuada estabilidad y continuidad (adequate stability and continuity).
  • The default fallback (art. 225 third paragraph). A falta del acuerdo … los hijos continuarán bajo el cuidado personal del padre o madre con quien estén conviviendo. Where no agreement is reached, children continue with the parent with whom they are cohabiting. This is doctrinally important in PA-pattern cases: the alienating parent's de facto residential occupation is not displaced absent court order — but the interés superior clause in the fourth paragraph permits the court to reallocate where circumstances require.
  • The interés superior trigger for transfer (art. 225 fourth paragraph). Cuando las circunstancias lo requieran y el interés superior del hijo lo haga conveniente, el juez podrá atribuir el cuidado personal del hijo al otro de los padres. Where circumstances require and the superior interest of the child makes it convenient, the judge may attribute personal care to the other parent. This is the operational PA-pattern remedy — sustained alienating conduct can constitute the circumstances requiring transfer.
  • The economic-capacity exclusion (art. 225 fifth paragraph). En ningún caso el juez podrá fundar exclusivamente su decisión en la capacidad económica de los padres. In no case may the judge base the decision exclusively on economic capacity. This is doctrinally significant in PA-pattern cases because alienating parents often invoke economic-stability framings to defeat shared-care or transfer applications.
  • The mandatory RDR fixing (art. 225 sixth paragraph). Siempre que el juez atribuya el cuidado personal del hijo a uno de los padres, deberá establecer … la frecuencia y libertad con que el otro padre o madre … mantendrá una relación directa y regular. Where the judge attributes personal care to one parent, he/she must establish (deberá) the frequency and freedom of RDR for the other parent. The mandatory framing means RDR is automatic — the targeted parent does not need a separate application.

  • The propende-to-vínculo-familiar definition (art. 229 second paragraph). Aquella que propende a que el vínculo familiar entre el padre o madre que no ejerce el cuidado personal y su hijo se mantenga a través de un contacto periódico y estable. The definition frames RDR as that which tends toward maintenance of the family bond through periodic and stable contact. The vínculo familiar (family bond) framing is doctrinally significant — RDR is about relational substance, not visitation logistics.
  • The four-factor determination framework (art. 229 second paragraph a-d). Age, affective bond, personal-care regime, and any other relevant element considering interés superior. In PA-pattern cases, factor (b) vinculación afectiva and factor (d) interés superior are operationally engaged.
  • The greatest-participation court duty (art. 229 third paragraph). El juez deberá asegurar la mayor participación y corresponsabilidad de éstos en la vida del hijo.   • The express non-obstruction duty (art. 229 fourth paragraph). El padre o madre que ejerza el cuidado personal del hijo no obstaculizará el régimen de relación directa y regular. The cohabiting parent shall not obstruct (no obstaculizará) the RDR regime. This is the doctrinally distinctive Chilean anti-alienation provision — codifying the resident parent's express duty not to obstruct contact. The no obstaculizará phrasing is structurally similar to:

The judge may compel (apremiar) delivery of the child. The apremio (judicial coercion) mechanism is doctrinally distinctive — providing structural enforcement for non-delivery breaches.
