The responsabilidad parental + cuidado personal compartido framework of the 2015 Argentine Civil and Commercial Code (CCyC). The CCyC replaced the 1869 Vélez Sarsfield Code, establishing (i) the definition of responsabilidad parental at art. 638, (ii) the joint-exercise default at art. 641, (iii) the cuidado personal allocation framework at arts. 651-653, (iv) the post-separation cuidado personal compartido default at art. 651, (v) the deber de información (information duty) at art. 655, and (vi) the welfare standard at art. 706.

Argentina is doctrinally distinctive among Latin American jurisdictions because the 2015 CCyC art. 651 expressly codifies cuidado personal compartido indistinto (joint and indistinct personal care) as the structural post-separation default — making Argentina one of the few jurisdictions globally with express statutory shared-care default rather than judicial discretion.

Art. 638 CCyC — Responsabilidad parental

La responsabilidad parental es el conjunto de deberes y derechos que corresponden a los progenitores sobre la persona y bienes del hijo, para su protección, desarrollo y formación integral mientras sea menor de edad y no se haya emancipado.

Art. 641 CCyC — Ejercicio de la responsabilidad parental

El ejercicio de la responsabilidad parental corresponde:

a) en caso de convivencia con ambos progenitores, a éstos. Se presume que los actos realizados por uno cuentan con la conformidad del otro, con excepción de los supuestos contemplados en el artículo 645, o que medie expresa oposición;

b) en caso de cese de la convivencia, divorcio o nulidad de matrimonio, a ambos progenitores. Se presume que los actos realizados por uno cuentan con la conformidad del otro, con las excepciones del inciso anterior. Por voluntad de los progenitores o por decisión judicial, en interés del hijo, el ejercicio se puede atribuir a sólo uno de ellos, o establecerse distintas modalidades;

c) en caso de muerte, ausencia con presunción de fallecimiento, privación de la responsabilidad parental o suspensión del ejercicio de un progenitor, al otro;

d) en caso de hijo extramatrimonial con un solo vínculo filial, al único progenitor;

e) en caso de hijo extramatrimonial con doble vínculo filial, si uno se estableció por declaración judicial, al otro progenitor. En interés del hijo, los progenitores de común acuerdo o el juez pueden decidir el ejercicio conjunto o establecer distintas modalidades.

Art. 651 CCyC — Reglas generales del cuidado personal

A pedido de uno o ambos progenitores o de oficio, el juez debe otorgar, como primera alternativa, el cuidado compartido del hijo con la modalidad indistinta, excepto que no sea posible o resulte perjudicial para el hijo.

Art. 652 CCyC — Derecho y deber de comunicación

En el supuesto de cuidado atribuido a uno de los progenitores, el otro tiene el derecho y el deber de fluida comunicación con el hijo.

Art. 655 CCyC — Plan de parentalidad

Los progenitores pueden presentar un plan de parentalidad que contenga:

a) lugar y tiempo en que el hijo permanece con cada progenitor;

b) responsabilidades que cada uno asume;

c) régimen de vacaciones, días festivos y otras fechas significativas para la familia;

d) régimen de relación y comunicación con el hijo cuando éste reside con el otro progenitor.

El plan de parentalidad propuesto por los progenitores puede ser modificado por ellos en función de las necesidades del grupo familiar y del hijo en sus diferentes etapas.

Los progenitores deben procurar la participación del hijo en el plan de parentalidad y en su modificación.

Art. 706 CCyC — Principios generales de los procesos de familia

El proceso en materia de familia debe respetar los principios de tutela judicial efectiva, inmediación, buena fe y lealtad procesal, oficiosidad, oralidad y acceso limitado al expediente.

a) Las normas que rigen el procedimiento deben ser aplicadas de modo de facilitar el acceso a la justicia, especialmente tratándose de personas vulnerables, y la resolución pacífica de los conflictos.

b) Los jueces ante los cuales tramitan estas causas deben ser especializados y contar con apoyo multidisciplinario.

c) La decisión que se dicte en un proceso en que están involucrados niños, niñas o adolescentes, debe tener en cuenta el interés superior de esas personas.

English working translation

Art. 638 CCyC — Parental responsibility

Parental responsibility is the set of duties and rights that correspond to the parents over the person and property of the child, for the child's protection, development, and integral formation while the child is a minor and has not become emancipated.

Art. 641 CCyC — Exercise of parental responsibility

The exercise of parental responsibility corresponds:

a) in case of cohabitation with both parents, to them. It is presumed that acts performed by one have the agreement of the other, except in the cases of art. 645 or where there is express opposition;

b) in case of cessation of cohabitation, divorce, or annulment, to both parents. It is presumed that acts performed by one have the agreement of the other, with the exceptions of the previous paragraph. By the will of the parents or by judicial decision in the interest of the child, exercise may be attributed to only one of them or different modalities may be established;

c) in case of death, absence with presumption of decease, deprivation of parental responsibility, or suspension of exercise of one parent, to the other;

d) in case of extramatrimonial child with only one filial link, to the only parent;

e) in case of extramatrimonial child with double filial link, where one was established by judicial declaration, to the other parent. In the interest of the child, the parents by mutual agreement or the judge may decide joint exercise or establish different modalities.

Art. 651 CCyC — General rules of personal care

At the request of one or both parents or ex officio, the judge must (debe) grant, as the first alternative (como primera alternativa), shared care of the child with the indistinct modality (modalidad indistinta), except where it is not possible or would be prejudicial to the child.

Art. 652 CCyC — Right and duty of communication

In the case of care attributed to one of the parents, the other has the right and the duty (el derecho y el deber) of fluid communication (fluida comunicación) with the child.

Art. 655 CCyC — Parenting plan

The parents may present a parenting plan (plan de parentalidad) containing:

a) place and time in which the child stays with each parent;

b) responsibilities that each assumes;

c) regime of vacations, holidays, and other significant family dates;

d) regime of relationship and communication with the child when the child resides with the other parent.

The parenting plan proposed by the parents may be modified by them according to the needs of the family group and of the child in his/her different stages.

The parents must procure the child's participation in the parenting plan and in its modification.

Art. 706 CCyC — General principles of family processes

Family-matter proceedings shall respect the principles of effective judicial protection, immediacy, good faith and procedural loyalty, officiosity, orality, and limited access to the file.

a) The procedural rules shall be applied in a manner that facilitates access to justice, especially in the case of vulnerable persons, and the peaceful resolution of conflicts.

b) The judges before whom these matters proceed shall be specialised and have multidisciplinary support.

c) The decision rendered in a process in which children, girls, or adolescents are involved shall take into account the superior interest of those persons.

Why this matters for PA

  • The cuidado personal compartido indistinto default (art. 651). A pedido de uno o ambos progenitores o de oficio, el juez debe otorgar, como primera alternativa, el cuidado compartido del hijo con la modalidad indistinta. The judge must (debe) grant, as the first alternative, shared care of the child with the indistinct modality. This is the doctrinally distinctive Argentine feature — express statutory shared-care default, not judicial discretion. The debe + primera alternativa phrasing means the court must consider shared care first, with departure requiring specific reasoning that it is not possible or prejudicial. In PA-pattern cases this provides structural protection against alienating-parent applications for sole care.
  • The indistinct-modality framing. Modalidad indistinta — indistinct modality. This is doctrinally important: shared care under Argentine law does not require fixed-time alternation but operates as indistinct (interchangeable, fluid) sharing of care responsibilities. This is doctrinally protective in PA-pattern cases because it does not require precise 50/50 time-sharing to engage shared-care protections.
  • The ex officio trigger (art. 651). A pedido de uno o ambos progenitores o de oficio. At the request of one or both parents or ex officio. The court can engage shared-care analysis on its own motion — even where neither parent has expressly requested it. In PA-pattern cases this is structurally important: the alienating parent's framing of the case as a sole-care application does not foreclose shared-care analysis.
  • The dual-prong communication duty (art. 652). El otro tiene el derecho y el deber de fluida comunicación con el hijo. The other parent has the right and the duty of fluid communication. The right-and-duty framing is the structural Argentine parallel to:

  • The fluida comunicación (fluid communication) standard is doctrinally distinctive — it is broader than "contact" or "visitation," encompassing all forms of parent-child connection. In PA-pattern cases this provides structural protection against framings that limit "contact" to physical visitation.
  • The plan de parentalidad framework (art. 655). The CCyC expressly codifies the parenting plan as a structural instrument. The plan can address:
  • Time/place allocation
  • Responsibilities of each parent
  • Vacation/holiday regime
  • Communication regime when child is with other parent
  • This is doctrinally important because it codifies the structural negotiation framework — in PA-pattern cases the plan-de-parentalidad process provides a structured pathway for addressing alienating-conduct findings through restructured arrangements.
  • The child's participation in plan formation (art. 655 last sentence). Los progenitores deben procurar la participación del hijo en el plan de parentalidad. Parents must procure the child's participation in the parenting plan. This is doctrinally distinctive — the child has a structural role in plan formation, not merely a passive subject. In PA-pattern cases this provides structural framework for engaging the child's authentic preferences (with capacity-based testing for autonomy vs alienation-induced framing).
  • The specialised + multidisciplinary court requirement (art. 706 b). Los jueces ante los cuales tramitan estas causas deben ser especializados y contar con apoyo multidisciplinario. Family judges must be specialised and have multidisciplinary support. This is doctrinally distinctive — Argentina expressly codifies the specialised-court requirement at the procedural-principles level. In PA-pattern cases this provides structural foundation for multidisciplinary engagement with welfare assessment.
  • The interés superior framework (art. 706 c). La decisión que se dicte en un proceso en que están involucrados niños, niñas o adolescentes, debe tener en cuenta el interés superior de esas personas. Decisions involving children/adolescents must take into account the superior interest of those persons. The debe tener en cuenta (must take into account) is the structural welfare-paramountcy formulation under the CCyC.
