Brazilian Lei nº 12.318/2010 — Lei da Alienação Parental¶
TL;DR. Brazil's Lei nº 12.318/2010 (Parental Alienation Law) is the most comprehensive statutory codification of parental alienation as a legal concept anywhere in the world. Enacted 26 August 2010, substantially amended by Lei nº 14.340 of 18 May 2022. Article 2 defines "ato de alienação parental" (act of parental alienation) and enumerates 7 exemplary forms including (I) denigration campaign, (II) obstruction of parental authority, (III) obstruction of contact, (IV) obstruction of family-coexistence right, (V) deliberate withholding of information, (VI) false denunciations against the other parent to obstruct contact, and (VII) abusive change of domicile to obstruct contact. Article 3 declares PA a violation of the child's fundamental right to healthy family coexistence and "abuso moral" (moral abuse) against the child. Articles 4-8 set out the procedural and substantive framework: priority case-handling, urgent provisional measures, biopsicossocial expert evaluation (Art. 5 — 90-day deadline), judicial measures including alteration of custody, change to or inversion of joint custody, suspension of parental authority, and inversion of obligation to transport child (Art. 6). The 2022 reform (Lei 14.340) introduced mandatory child-hearing protocol (Art. 8-A), revoked the original Art. 6(VII) suspension-of-parental-authority remedy, and added flexibility for expert appointment. The Brazilian law is internationally referenced as the leading example of explicit PA statutory codification.

Art. 1º — Disposição¶
Esta Lei dispõe sobre a alienação parental.
Art. 2º — Definição de ato de alienação parental¶
Considera-se ato de alienação parental a interferência na formação psicológica da criança ou do adolescente promovida ou induzida por um dos genitores, pelos avós ou pelos que tenham a criança ou adolescente sob a sua autoridade, guarda ou vigilância para que repudie genitor ou que cause prejuízo ao estabelecimento ou à manutenção de vínculos com este.
Parágrafo único. São formas exemplificativas de alienação parental, além dos atos assim declarados pelo juiz ou constatados por perícia, praticados diretamente ou com auxílio de terceiros:
I — realizar campanha de desqualificação da conduta do genitor no exercício da paternidade ou maternidade;
II — dificultar o exercício da autoridade parental;
III — dificultar contato de criança ou adolescente com genitor;
IV — dificultar o exercício do direito regulamentado de convivência familiar;
V — omitir deliberadamente a genitor informações pessoais relevantes sobre a criança ou adolescente, inclusive escolares, médicas e alterações de endereço;
VI — apresentar falsa denúncia contra genitor, contra familiares deste ou contra avós, para obstar ou dificultar a convivência deles com a criança ou adolescente;
VII — mudar o domicílio para local distante, sem justificativa, visando a dificultar a convivência da criança ou adolescente com o outro genitor, com familiares deste ou com avós.
Art. 3º — Natureza jurídica do ato de alienação parental¶
A prática de ato de alienação parental fere direito fundamental da criança ou do adolescente de convivência familiar saudável, prejudica a realização de afeto nas relações com genitor e com o grupo familiar, constitui abuso moral contra a criança ou o adolescente e descumprimento dos deveres inerentes à autoridade parental ou decorrentes de tutela ou guarda.
Art. 4º — Procedimento + medidas provisórias¶
Declarado indício de ato de alienação parental, a requerimento ou de ofício, em qualquer momento processual, em ação autônoma ou incidentalmente, o processo terá tramitação prioritária, e o juiz determinará, com urgência, ouvido o Ministério Público, as medidas provisórias necessárias para preservação da integridade psicológica da criança ou do adolescente, inclusive para assegurar sua convivência com genitor ou viabilizar a efetiva reaproximação entre ambos, se for o caso.
Parágrafo único (redação dada pela Lei nº 14.340, de 2022). Assegurar-se-á à criança ou ao adolescente e ao genitor garantia mínima de visitação assistida no fórum em que tramita a ação ou em entidades conveniadas com a Justiça, ressalvados os casos em que há iminente risco de prejuízo à integridade física ou psicológica da criança ou do adolescente, atestado por profissional eventualmente designado pelo juiz para acompanhamento das visitas.
Art. 5º — Perícia psicológica ou biopsicossocial¶
Havendo indício da prática de ato de alienação parental, em ação autônoma ou incidental, o juiz, se necessário, determinará perícia psicológica ou biopsicossocial.
§ 1º O laudo pericial terá base em ampla avaliação psicológica ou biopsicossocial, conforme o caso, compreendendo, inclusive, entrevista pessoal com as partes, exame de documentos dos autos, histórico do relacionamento do casal e da separação, cronologia de incidentes, avaliação da personalidade dos envolvidos e exame da forma como a criança ou adolescente se manifesta acerca de eventual acusação contra genitor.
§ 2º A perícia será realizada por profissional ou equipe multidisciplinar habilitados, exigido, em qualquer caso, aptidão comprovada por histórico profissional ou acadêmico para diagnosticar atos de alienação parental.
§ 3º O perito ou equipe multidisciplinar designada para verificar a ocorrência de alienação parental terá prazo de 90 (noventa) dias para apresentação do laudo, prorrogável exclusivamente por autorização judicial baseada em justificativa circunstanciada.

Na ausência ou insuficiência de serventuários responsáveis pela realização de estudo psicológico, biopsicossocial ou qualquer outra espécie de avaliação técnica exigida por esta Lei ou por determinação judicial, a autoridade judiciária poderá proceder à nomeação de perito com qualificação e experiência pertinentes ao tema, nos termos dos arts. 156 e 465 da Lei nº 13.105, de 16 de março de 2015 (Código de Processo Civil).
Art. 6º — Medidas judiciais¶
Caracterizados atos típicos de alienação parental ou qualquer conduta que dificulte a convivência de criança ou adolescente com genitor, em ação autônoma ou incidental, o juiz poderá, cumulativamente ou não, sem prejuízo da decorrente responsabilidade civil ou criminal e da ampla utilização de instrumentos processuais aptos a inibir ou atenuar seus efeitos, segundo a gravidade do caso:
I — declarar a ocorrência de alienação parental e advertir o alienador;
II — ampliar o regime de convivência familiar em favor do genitor alienado;
III — estipular multa ao alienador;
IV — determinar acompanhamento psicológico e/ou biopsicossocial;
V — determinar a alteração da guarda para guarda compartilhada ou sua inversão;
VI — determinar a fixação cautelar do domicílio da criança ou adolescente;
VII — (revogado pela Lei nº 14.340, de 2022) [originally: declarar a suspensão da autoridade parental].
Parágrafo único. Caracterizado mudança abusiva de endereço, inviabilização ou obstrução à convivência familiar, o juiz também poderá inverter a obrigação de levar para ou retirar a criança ou adolescente da residência do genitor, por ocasião das alternâncias dos períodos de convivência familiar.
Art. 7º — Preferência na atribuição/alteração da guarda¶
A atribuição ou alteração da guarda dar-se-á por preferência ao genitor que viabiliza a efetiva convivência da criança ou adolescente com o outro genitor nas hipóteses em que seja inviável a guarda compartilhada.
Art. 8º — Mudança de domicílio + competência¶
A alteração de domicílio da criança ou adolescente é irrelevante para a determinação da competência relacionada às ações fundadas em direito de convivência familiar, salvo se decorrente de consenso entre os genitores ou de decisão judicial.
Art. 8-A — Oitiva de crianças e adolescentes (incluído pela Lei nº 14.340, de 2022)¶
Sempre que necessário o depoimento ou a oitiva de crianças e de adolescentes em casos de alienação parental, eles serão realizados obrigatoriamente nos termos da Lei nº 13.431, de 4 de abril de 2017, sob pena de nulidade processual.

Article 2 — Definition of parental alienation¶
An act of parental alienation is considered to be the interference in the psychological formation of the child or adolescent promoted or induced by one of the parents, by grandparents or by those who have the child or adolescent under their authority, guardianship or supervision, such that the child repudiates a parent or that causes harm to the establishment or maintenance of bonds with that parent.
Sole paragraph. The following are exemplary forms of parental alienation, in addition to acts so declared by the judge or established by expert evaluation, practiced directly or with the help of third parties:
I. Carrying out a campaign of disqualification of the parent's conduct in the exercise of paternity or maternity; II. Obstructing the exercise of parental authority; III. Obstructing contact of the child or adolescent with the parent; IV. Obstructing the exercise of the regulated right of family coexistence; V. Deliberately omitting personally relevant information about the child or adolescent from the parent, including educational, medical, and changes of address; VI. Presenting false denunciations against the parent, against that parent's relatives, or against grandparents, to obstruct or hinder coexistence with the child or adolescent; VII. Changing domicile to a distant location, without justification, aimed at hindering coexistence of the child or adolescent with the other parent, that parent's relatives or grandparents.
Article 3 — Legal nature of parental alienation¶
The practice of an act of parental alienation violates the fundamental right of the child or adolescent to healthy family coexistence, harms the development of affection in relationships with the parent and the family group, constitutes "moral abuse" (abuso moral) against the child or adolescent, and breach of duties inherent in parental authority or arising from guardianship or custody.
Article 6 — Judicial measures (key provisions)¶
Once typical acts of parental alienation or any conduct hindering coexistence with a parent are characterized, the judge may, cumulatively or not, according to the gravity of the case: I. Declare the occurrence of parental alienation and warn the alienator; II. Expand the family-coexistence regime in favor of the alienated parent; III. Stipulate fines against the alienator; IV. Order psychological and/or biopsicossocial monitoring; V. Order alteration of custody to joint custody or inversion of custody; VI. Order provisional fixation of the child's domicile; VII. (revoked 2022 — originally: suspension of parental authority).
Sole paragraph. Where abusive change of address, infeasibility or obstruction of family coexistence is characterized, the judge may also invert the obligation to bring or take the child or adolescent from the parent's residence during alternation periods.
Article 7 — Custody preference¶
The attribution or alteration of custody shall be by preference given to the parent who facilitates effective coexistence of the child or adolescent with the other parent, in cases where joint custody is unfeasible.
Why Lei 12.318/2010 matters globally for parental-alienation analysis¶
The Brazilian Lei 12.318/2010 is the most explicit and comprehensive PA-recognition statute anywhere in the world. Globally cited in PA-recognition advocacy as the leading example of explicit statutory codification.

Brazil's definition focuses on the OBJECTIVE conduct (interference in psychological formation) and OUTCOME (child's repudiation of parent OR harm to bond), avoiding diagnostic-syndrome controversies. Article 8-A (2022 addition) — mandatory child-hearing protocol: child testimony in PA cases must be conducted per Lei 13.431/2017 (anti-secondary-victimization framework) on pain of procedural nullity. Procedural rights of the child are strengthened.
Critique and international debate¶
The Brazilian PA Law has been internationally controversial. Recognition-camp commentators view it as the global gold standard for PA legal codification. Critique-camp commentators (including various Brazilian academics, women's-rights organizations, and the UN Special Rapporteur on Violence Against Women) have raised concerns that the law has been deployed against legitimate safeguarding allegations, particularly by mothers raising abuse concerns. The 2022 reforms (Lei 14.340) responded in part to these concerns by: (i) revoking the original Art. 6(VII) parental-authority-suspension remedy; (ii) introducing the Art. 8-A mandatory protected child-hearing protocol; (iii) requiring the visitation-assistance regime to be conducted in forensic-aware venues. International advocacy continues on both sides.
