The parental authority + personal relationships framework of the 2011 Romanian Civil Code. The Noul Cod Civil (NCC) recodified Romanian family law into Book II of the Civil Code, consolidating the previous Codul Familiei (Family Code 1953). Romania is doctrinally distinctive among CEE jurisdictions because the 2011 NCC art. 396 explicitly codifies the exercise în comun (joint exercise) of authority as the structural default after divorce — and the 2024 amendments to arts. 483-512 further strengthened the cooperation framework with express alienation-recognition language.

Art. 264 — Ascultarea copilului

(1) În procedurile administrative sau judiciare care îl privesc, ascultarea copilului care a împlinit vârsta de 10 ani este obligatorie. Cu toate acestea, poate fi ascultat și copilul care nu a împlinit vârsta de 10 ani, dacă autoritatea competentă consideră că acest lucru este necesar pentru soluționarea cauzei.

(2) Dreptul de a fi ascultat presupune posibilitatea copilului de a cere și a primi orice informație, potrivit cu vârsta sa, de a-și exprima opinia și de a fi informat asupra consecințelor pe care le poate avea aceasta, dacă este respectată, precum și asupra consecințelor oricărei decizii care îl privește.

(3) Orice copil poate cere să fie ascultat, potrivit prevederilor alin. (1) și (2). Respingerea cererii de către autoritatea competentă trebuie motivată.

Art. 396 — Raporturile dintre părinții divorțați și copiii lor minori

(1) Instanța de tutelă hotărăște, odată cu pronunțarea divorțului, asupra raporturilor dintre părinții divorțați și copiii lor minori, ținând seama de interesul superior al copiilor, de concluziile raportului de anchetă psihosocială, precum și, dacă este cazul, de învoiala părinților, pe care îi ascultă.

Art. 397 — Exercitarea autorității părintești de către ambii părinți

După divorț, autoritatea părintească revine în comun ambilor părinți, afară de cazul în care instanța decide altfel.

Art. 401 — Drepturile părintelui separat de copil

(1) În cazurile prevăzute la art. 400, părintele sau, după caz, părinții separați de copilul lor au dreptul de a avea legături personale cu acesta.

(2) În caz de neînțelegere între părinți, instanța de tutelă decide cu privire la modalitățile de exercitare a acestui drept. Ascultarea copilului este obligatorie, dispozițiile art. 264 fiind aplicabile.

Art. 487 — Conținutul autorității părintești

Părinții au dreptul și îndatorirea de a crește copilul, îngrijind de sănătatea și dezvoltarea lui fizică, psihică și intelectuală, de educația, învățătura și pregătirea profesională a acestuia, potrivit propriilor lor convingeri, însușirilor și nevoilor copilului; ei sunt datori să dea copilului orientarea și sfaturile necesare exercitării corespunzătoare a drepturilor pe care legea le recunoaște acestuia.

Art. 505 — Îndatoririle copilului față de părinți + ascultarea

(1) Copilul datorează respect părinților săi indiferent de vârsta sa.

(2) Copilul care nu a împlinit vârsta de 14 ani trebuie să trăiască la părinții săi. Cu toate acestea, dacă există motive temeinice, instanța de tutelă poate încuviința ca copilul să aibă o locuință deosebită de cea a părinților săi. Ascultarea copilului este obligatorie, dispozițiile art. 264 fiind aplicabile.

Art. 264 — Hearing the child

(1) In administrative or judicial proceedings concerning him/her, the hearing of the child who has reached the age of 10 years is mandatory (obligatorie). Nonetheless, the child who has not reached the age of 10 may also be heard, where the competent authority considers it necessary for the resolution of the case.

(2) The right to be heard presupposes the possibility for the child to seek and receive any information appropriate to his/her age, to express his/her opinion, and to be informed about the consequences his/her opinion may have if respected, as well as about the consequences of any decision concerning him/her.

(3) Any child may request to be heard under paragraphs (1) and (2). The rejection of the request by the competent authority must be reasoned (motivată).

Art. 396 — Relations between divorced parents and their minor children

(1) The guardianship court decides, at the same time as the divorce decree, on the relations between the divorced parents and their minor children, taking into account the superior interest of the children, the conclusions of the psychosocial inquiry report, and, where appropriate, the agreement of the parents, whom it hears.

Art. 397 — Exercise of parental authority by both parents

After divorce, parental authority returns jointly (revine în comun) to both parents, except where the court decides otherwise.

Art. 401 — Rights of the parent separated from the child

(1) In the cases provided for in art. 400, the parent (or, as appropriate, the parents) separated from their child have the right to personal relations (legături personale) with the child.

(2) In case of disagreement between the parents, the guardianship court decides on the manner of exercise of this right. The hearing of the child is mandatory, the provisions of art. 264 being applicable.

Art. 487 — Content of parental authority

Parents have the right and obligation (dreptul și îndatorirea) to raise the child, caring for his/her health and physical, psychological, and intellectual development, for his/her education, learning, and professional training, according to their own convictions, the child's characteristics and needs; they are obliged to give the child the orientation and advice necessary for the proper exercise of the rights that the law recognises to him/her.

Art. 505 — Duties of the child + hearing

(1) The child owes respect to his/her parents regardless of age.

(2) The child who has not reached the age of 14 years must live with his/her parents. Nonetheless, where there are substantial grounds (motive temeinice), the guardianship court may authorise the child to have a residence different from that of the parents. The hearing of the child is mandatory, the provisions of art. 264 being applicable.

Why this matters for PA

  • The joint exercise default post-divorce (art. 397). După divorț, autoritatea părintească revine în comun ambilor părinți. After divorce, parental authority returns jointly to both parents. This is doctrinally significant: the structural default in Romanian law is în comun (joint), not sole. The court may decide otherwise only on welfare grounds. In PA-pattern cases this provides structural protection against alienating-parent applications for sole authority — în comun is the starting point that must be displaced.
  • The right-to-personal-relations framing (art. 401 (1)). Părintele … au dreptul de a avea legături personale cu acesta. The parent separated from the child has the right to personal relations. The legături personale (personal relations) framing is structurally broader than "contact" — it encompasses all forms of parent-child connection. In PA-pattern cases this means contact-frustration engages a fundamental right analysis, not merely a discretionary contact-arrangement.
  • The mandatory hearing standard (art. 264 + 401 (2) + 505 (2)). Ascultarea copilului … este obligatorie. The hearing of the child is mandatory (above age 10, or below age 10 where necessary). The reasoning-rejection requirement (motivată) is doctrinally distinctive — courts cannot dismiss hearing applications without express reasoning. In PA-pattern cases this provides:
  • Structural protection for testing whether the child's expressed wishes are autonomous
  • Mandatory engagement with the child's perspective even where the alienating parent objects

  • The 2024 amendments to arts. 483-512.
