The three foundational provisions of Finnish family law. Lapsenhuoltolaki (HOL — Act on Child Custody and Right of Access) establishes (i) the content of lapsen huolto (custody/parental responsibility) at § 1, (ii) the court's decision-making framework on custody + tapaamisoikeus (access right) at § 9, and (iii) the child's opinion consideration at § 10. The 2019 reform (laki 190/2019) introduced significant operational changes including the vieraannuttaminen (alienation) recognition and the vuoroasuminen (alternating residence) framework.

Finland is doctrinally distinctive among the Nordic jurisdictions because the 2019 reform expressly addressed the vieraannuttaminen (parental alienation) phenomenon in the official preparatory works (HE 88/2018 vp) and codified specific welfare considerations responsive to it — making Finland one of the few European jurisdictions with express legislative recognition of alienating-conduct patterns.

§ 1 — Lapsen huollon sisältö¶
Lapsen huollon tarkoituksena on turvata lapsen tasapainoinen kehitys ja hyvinvointi lapsen yksilöllisten tarpeiden ja toivomusten mukaisesti. Huollon tulee turvata myönteiset ja läheiset ihmissuhteet erityisesti lapsen ja hänen vanhempiensa välillä. Myös muita lapselle tärkeitä ihmissuhteita on vaalittava.
Lapselle tulee turvata hyvä hoito ja kasvatus sekä lapsen ikään ja kehitystasoon nähden tarpeellinen valvonta ja huolenpito. Lapselle on pyrittävä antamaan turvallinen ja virikkeitä antava kasvuympäristö sekä lapsen taipumuksia ja toivomuksia vastaava koulutus.
Lasta tulee suojella kaikenlaiselta ruumiilliselta ja henkiseltä väkivallalta, huonolta kohtelulta ja hyväksikäytöltä.
Lasta tulee kasvattaa siten, että lapsi saa osakseen ymmärtämystä, turvaa ja hellyyttä. Lasta ei saa alistaa, kurittaa ruumiillisesti eikä kohdella muulla tavoin loukkaavasti. Lapsen itsenäistymistä sekä kasvamista vastuullisuuteen ja aikuisuuteen tulee tukea ja edistää.
§ 9 — Päätös lapsen huollosta ja tapaamisoikeudesta¶
Tuomioistuin voi päättää lapsen huollosta ja tapaamisoikeudesta vanhempien sopimuksen mukaisesti tai erikseen siitä, että:
1) lapsen huolto uskotaan molemmille vanhemmille yhteisesti;
2) lapsen huolto uskotaan yksin toiselle vanhemmista;
3) lapsen huolto uskotaan vanhempien ohella tai sijasta yhdelle tai useammalle henkilölle, joka on antanut tähän suostumuksensa;
4) lapsi asuu toisen vanhempansa luona, jos vanhemmat eivät asu yhdessä;
5) lapsi asuu vuorotellen kummankin vanhempansa luona (vuoroasuminen); taikka
6) lapsella on oikeus pitää yhteyttä ja tavata vanhempaansa, jonka luona lapsi ei asu.
Asiassa, joka koskee lapsen huoltoa tai tapaamisoikeutta, on ensisijaisesti otettava huomioon lapsen etu. Tätä arvioitaessa on kiinnitettävä huomiota erityisesti siihen, miten huolto ja tapaamisoikeus parhaiten toteutuvat vastaisuudessa.
§ 10 — Lapsen mielipide¶
Lapsen huoltoa ja tapaamisoikeutta koskeva asia on ratkaistava ennen kaikkea lapsen edun mukaisesti. Tässä tarkoituksessa on erityisesti kiinnitettävä huomiota siihen, miten huolto ja tapaamisoikeus parhaiten toteutuvat vastaisuudessa.
Lapsen huoltoa ja tapaamisoikeutta koskevassa asiassa on selvitettävä lapsen omat toivomukset ja mielipide sikäli kuin se on lapsen ikään ja kehitystasoon nähden mahdollista. Lapsen mielipide on selvitettävä hienovaraisesti ja ottaen huomioon lapsen kehitysaste sekä siten, että tästä ei aiheudu haittaa lapsen ja hänen vanhempiensa välisille suhteille.

§ 1 — Content of custody¶
The purpose of the custody of a child is to safeguard the balanced development and well-being of the child according to his/her individual needs and wishes. Custody shall safeguard positive and close human relationships (myönteiset ja läheiset ihmissuhteet), in particular between the child and his/her parents. Other important human relationships of the child shall also be cherished.
The child shall be ensured good care and upbringing and the supervision and care necessary according to his/her age and stage of development. The child shall be provided with a safe and stimulating upbringing environment and an education corresponding to his/her aptitudes and wishes.
The child shall be protected from all kinds of physical and mental violence, ill-treatment, and exploitation.
The child shall be brought up so that the child receives understanding, security, and affection. The child shall not be subjected to subordination, physical punishment, or other offensive treatment. The child's growing independence and maturation toward responsibility and adulthood shall be supported and promoted.
§ 9 — Decision on custody and access¶
The court may decide on the custody of the child and on access in accordance with the parents' agreement or separately so that:
1) the custody of the child is entrusted to both parents jointly;
2) the custody of the child is entrusted solely to one parent;
3) the custody of the child is entrusted to one or more persons in addition to or instead of the parents, who have consented thereto;
4) the child resides with one parent, if the parents do not live together;
5) the child resides alternately with each of his/her parents (vuoroasuminen — alternating residence); or
6) the child has a right to maintain contact and meet the parent with whom the child does not reside.
In a matter concerning the custody or access of the child, the interest of the child (lapsen etu) shall be primarily taken into account. In assessing this, particular regard shall be had to how custody and access can best be realised in the future (parhaiten toteutuvat vastaisuudessa).
§ 10 — The child's opinion¶
A matter concerning the custody or access of the child shall be decided above all according to the interest of the child. For this purpose, particular regard shall be had to how custody and access can best be realised in the future.
In a matter concerning the custody or access of the child, the child's own wishes and opinion shall be ascertained insofar as this is possible according to the child's age and stage of development. The child's opinion shall be ascertained delicately (hienovaraisesti) and taking into account the child's stage of development, and in such a manner that it does not cause harm to the relationships between the child and his/her parents.
Why this matters for PA¶
- The myönteiset ja läheiset ihmissuhteet codification (§ 1 first paragraph). Huollon tulee turvata myönteiset ja läheiset ihmissuhteet erityisesti lapsen ja hänen vanhempiensa välillä. Custody shall safeguard positive and close human relationships, in particular between the child and his/her parents. This is doctrinally distinctive — § 1 expressly codifies the welfare interest in both-parent close relationships as the purpose of custody. In PA-pattern cases this provides the doctrinal foundation for treating disruption of the child-targeted-parent relationship as engaging the welfare standard.
- The protection from mental violence (§ 1 third paragraph). Lasta tulee suojella kaikenlaiselta ruumiilliselta ja henkiseltä väkivallalta. The child shall be protected from all kinds of physical and mental violence. The 2019 reform's preparatory works (HE 88/2018 vp) expressly identified vieraannuttaminen (alienation) as a form of henkinen väkivalta (mental violence) engaging this provision. This is one of the most operationally explicit PA-recognition statutory anchors in European law.
- The vuoroasuminen alternative (§ 9 (1) Z 5). The 2019 reform introduced vuoroasuminen (alternating residence) as an explicit § 9 option — codifying what was previously practiced informally. This is doctrinally important because it gives the court explicit statutory authority to order alternating residence, which can operate as both an intermediate intervention and a structural rebalancing in PA-pattern cases.
- The lapsen etu primacy + future-orientation (§ 9 second paragraph). Ensisijaisesti otettava huomioon lapsen etu … miten huolto ja tapaamisoikeus parhaiten toteutuvat vastaisuudessa. The interest of the child is primarily considered, and regard is had to how custody and access can best be realised in the future. The vastaisuudessa (in the future) clause is doctrinally significant — it codifies prospective welfare assessment, requiring the court to consider future realisability of custody/access arrangements. In PA-pattern cases the alienating parent's likely future conduct is structurally relevant.
- The child's opinion ascertainment standard (§ 10 second paragraph). Hienovaraisesti ja … siten, että tästä ei aiheudu haittaa lapsen ja hänen vanhempiensa välisille suhteille. The child's opinion shall be ascertained delicately and in such a manner that it does not cause harm to the relationships between the child and his/her parents. This is doctrinally distinctive — it codifies a relational-protection standard in child hearing, recognising that the manner of hearing can harm the parental relationships. In PA-pattern cases this provides the structural foundation for careful, expert-led child hearings rather than direct adversarial questioning that could entrench alienating influence.
- The capacity-based standard. Sikäli kuin se on lapsen ikään ja kehitystasoon nähden mahdollista. The opinion is ascertained insofar as this is possible according to the child's age and stage of development. This is the Finnish capacity-based standard — no fixed age threshold. In PA-pattern cases the kehitystaso (stage of development) consideration provides analytical space for assessing whether the child's stated views are autonomous or alienation-induced.
- The 2019 reform's vieraannuttaminen recognition. Although the term vieraannuttaminen (alienation) does not appear in the statutory text itself, the preparatory works (HE 88/2018 vp s. 17, 22) expressly identified alienating conduct as engaging the lapsen etu + myönteiset ja läheiset ihmissuhteet + henkinen väkivalta framework. The Korkein oikeus (Supreme Court) has subsequently applied this preparatory-works recognition in jurisprudence including KKO 2020:79.
