Barnets bästa skall vara avgörande för alla frågor om vårdnad, boende och umgänge.

Vid bedömningen av vad som är bäst för barnet skall det fästas avseende särskilt vid

– risken för att barnet eller någon annan i familjen utsätts för övergrepp eller att barnet olovligen förs bort eller hålls kvar eller annars far illa, och

– barnets behov av en nära och god kontakt med båda föräldrarna.

Hänsyn skall tas till barnets vilja med beaktande av barnets ålder och mognad.

6 kap. 2a § Parental Code — Best interests of the child

The best interests of the child shall be decisive (avgörande) for all questions concerning custody, residence, and contact.

In assessing what is best for the child, particular regard shall be had to:

– the risk that the child or someone else in the family is subjected to abuse (övergrepp), or that the child is unlawfully removed or retained or otherwise comes to harm (far illa), and

– the child's need for a close and good contact (nära och god kontakt) with both parents.

Regard shall be had to the child's wishes (vilja) with consideration to the child's age and maturity (ålder och mognad).

Why this matters for PA

  • Avgörande paramountcy formulation. Barnets bästa skall vara avgörande. The child's best interests shall be decisive (avgörande). This is one of the strongest welfare-paramountcy formulations in European family law — avgörande is doctrinally stronger than "paramount consideration" (UK/IE), "leitender Gesichtspunkt" (AT), or "am besten entspricht" (DE).
