The three structural pillars of Danish family law. § 11 — Fælles forældremyndighed¶
Var der fælles forældremyndighed ved separation eller skilsmisse, fortsætter denne. Familieretten kan dog efter anmodning ophæve den fælles forældremyndighed, hvis der er holdepunkter for at antage, at forældrene ikke kan samarbejde om barnets forhold til barnets bedste.
§ 21 — Samvær¶
Stk. 1. Barnets forbindelse med begge forældre søges bevaret ved, at barnet har ret til samvær med den forælder, som det ikke har bopæl hos.
Stk. 2. Forældrene har et fælles ansvar for, at barnet har samvær med den forælder, det ikke har bopæl hos.
Stk. 3. Familieretshuset eller familieretten kan efter anmodning fastsætte omfanget og udøvelsen af samværet og kan fastsætte de nødvendige bestemmelser i forbindelse hermed. Afgørelsen træffes efter barnets bedste, og der skal blandt andet tages hensyn til
1) barnets forhold til begge forældre,
2) barnets egne synspunkter alt efter alder og modenhed,
3) barnets tryghed og trivsel, og
4) forældrenes evne til at samarbejde om barnets forhold.

§ 4 — The best interests of the child¶
Decisions under the Act shall be made on the basis of what is best for the child (bedst for barnet).
§ 11 — Joint parental responsibility¶
Where there was joint parental responsibility (fælles forældremyndighed) at separation or divorce, this continues. The Family Court may, however, upon application, terminate the joint parental responsibility where there are holdepunkter (substantial grounds) for assuming that the parents cannot cooperate on the child's affairs to the child's best interests.
§ 21 — Contact¶
(1) The child's connection with both parents (forbindelse med begge forældre) is sought to be preserved by the child having a right to contact (ret til samvær) with the parent with whom the child does not have its residence (bopæl).
(2) The parents have a joint responsibility (fælles ansvar) that the child has contact with the parent with whom the child does not have its residence.
(3) The Familieretshuset (Family Law House) or the Family Court may, upon application, fix the scope and exercise of contact and may make the necessary provisions in connection therewith. The decision is made according to the child's best interests, and regard shall be had among other things to:
1) the child's relationship with both parents,
2) the child's own views according to age and maturity,
3) the child's security and well-being (tryghed og trivsel),
4) the parents' capacity to cooperate (evne til at samarbejde) on the child's affairs.
Why this matters for PA¶
- The barnets bedste paramountcy (§ 4). Afgørelser efter loven skal træffes ud fra, hvad der er bedst for barnet. Decisions are made on what is best for the child. This is the structural Danish parallel to other Nordic and DACH paramountcy provisions, but doctrinally significant for its simplicity — § 4 establishes the unqualified primacy of the welfare standard without elaboration, leaving operational content to §§ 11, 19, 21 and the jurisprudence.
- The fælles forældremyndighed default (§ 11). Var der fælles forældremyndighed ved separation eller skilsmisse, fortsætter denne. Joint parental responsibility continues after separation by default. The Familieretten may only ophæve (terminate) joint responsibility where there are holdepunkter (substantial grounds) that the parents cannot cooperate to the child's best interests. The til barnets bedste qualifier is critical — sustained alienating conduct can satisfy the substantial-grounds test, because cooperation failure that serves alienation operates against the child's interests.
- The child's right framing (§ 21 (1)). Barnet har ret til samvær. The child has a right to contact — not the parent. This is doctrinally distinctive in Nordic family law and operationally powerful in PA-pattern cases:
- Contact-denial cannot be justified solely on the alienating parent's preference
- The targeted parent's application is structurally a vindication of the child's right
- The alienating parent's framing of contact as the child's choice is rebuttable — the right exists irrespective of the child's expressed preference
- The fælles ansvar codification (§ 21 (2)). Forældrene har et fælles ansvar for, at barnet har samvær. The parents have a joint responsibility that contact occurs. This is doctrinally distinctive: it codifies the resident parent's duty to actively facilitate contact — not merely to refrain from obstruction. In PA-pattern cases this provides the doctrinal foundation for findings of breach where the resident parent has passively or actively allowed contact to lapse.
- The four operative considerations (§ 21 (3)). The contact-fixing decision considers:
- Barnets forhold til begge forældre — child's relationship with both parents (engaged where alienating conduct has disrupted the relationship)
- Barnets egne synspunkter alt efter alder og modenhed — child's own views according to age and maturity (capacity-based, not fixed-age)
- Barnets tryghed og trivsel — security and well-being (welfare-protective consideration)
- Forældrenes evne til at samarbejde — parents' capacity to cooperate (PA-pattern findings engage this directly)

The Familieretshuset operates as the unified front-door for separation/custody matters — providing structured intake, mediation, and dispute-resolution before adversarial Familieretten litigation. In PA-pattern cases the Familieretshuset can identify high-conflict cases for expedited transfer to the Familieretten, and can engage børnesagkyndig rådgivning (child-specialist counselling) as an intermediate intervention.
Procedural application¶
- The Familieretshuset (Family Law House) handles initial intake under Familieretshusloven
- High-conflict cases transfer to the Familieretten (Family Court — division of the byretten)
- Appellate review to the landsretten + Højesteret (Supreme Court) are available

Use in alienating-conduct cases¶

- Apex-tier: ophæve joint forældremyndighed under § 11
- The 2019 reform's højkonflikt (high-conflict) screening was specifically designed to accelerate intervention in PA-pattern cases
