Suomi Lapsenhuoltolaki (Child Custody Act 1983 + 2019 reform)

TL;DR

Finland's Lapsenhuoltolaki (Laki lapsen huollosta ja tapaamisoikeudesta, 361/1983) was substantially reformed in 2019 (effective 1 December 2019) to introduce vuoroasuminen — alternating residence as a recognized arrangement — and to sharpen the anti-alienation framework. Section 1 codifies the child's right to relationships with both parents; Section 2 obligates each custodian to facilitate the relationship with the other parent. The 2019 reform also expanded mediation options and tightened enforcement under Section 41.

Statutory Framework

Section 1 — Child's Best Interests

The child has a right to a balanced development and well-being, considering individual needs and wishes. The child has a right to maintain a close relationship with both parents.

Section 2 — Cooperation Duty (Yhteistyovelvoite)

Custodians must protect the child's best interests and discuss matters concerning the child. The custodian with whom the child primarily lives has a duty to facilitate the child's relationship with the other parent.

Section 9b — Vuoroasuminen (Alternating Residence) — 2019 Addition

Court may order that the child lives alternately with both parents under a structured schedule. The 2019 reform recognized this as a legitimate arrangement; previously it had been informally practiced but not codified.

Section 10 — Best-Interests Criteria

When deciding custody, residence, and contact, the court must give weight to: - The child's age and stage of development - The child's relationship with both parents - The capacity and willingness of each parent to care for the child - The capacity and willingness of each parent to support the child's relationship with the other parent - The child's expressed wishes (age-appropriate weight)

The fourth factor is Finland's explicit anti-alienation criterion.

Section 41 — Enforcement

Coercive enforcement of custody/contact orders through threat of fine (uhkasakko) and, in extreme cases, physical retrieval (noutaminen). Enforcement under separate Laki lapsen huoltoa ja tapaamisoikeutta koskevan paatoksen taytantoonpanosta (619/1996).

KKO Jurisprudence

KKO 2018:30

Established that the residential parent's persistent obstruction of contact is grounds for residence transfer, even where the child expresses contact refusal — courts must investigate whether refusal reflects induced influence (manipulointi).

KKO 2021:74

Reaffirmed that vuoroasuminen requires both parents' genuine cooperation; where one parent systematically undermines the arrangement, sole residence may be assigned to the cooperative parent.

ECHR Context

Finland party to ECHR since 1990. Strasbourg jurisprudence (Strand Lobben, Improta, K.O. v Norway) treated as binding interpretive authority by KKO.
