The welfare paramountcy + violence-screen in Norwegian family law. Barnelova § 48 establishes that avgjerder om foreldreansvar, kvar barnet skal bu fast og samvær (decisions on parental responsibility, residence, and contact) shall be made først og fremst (first and foremost) on the basis of what is best for the child. Avgjerder om foreldreansvar, om kvar barnet skal bu fast og om samvær, og handsaminga av slike saker, skal først og fremst rette seg etter det som er best for barnet.

Ved avgjerda skal det takast omsyn til at barnet ikkje må bli utsett for vald eller på anna vis bli handsama slik at den fysiske eller psykiske helsa vert utsett for skade eller fare.

§ 48 — The paramount consideration of the child's best interests

Decisions on parental responsibility (foreldreansvar), on where the child shall reside permanently, and on contact (samvær), and the processing of such matters, shall first and foremost be directed by what is best for the child (best for barnet).

In the decision, regard shall be taken (takast omsyn) to the fact that the child must not be subjected to violence (vald) or otherwise be treated in such a way that the child's physical or mental health is exposed to injury or danger (skade eller fare).

Why this matters for PA

  • The først og fremst paramountcy formulation. Først og fremst rette seg etter det som er best for barnet. Decisions shall first and foremost be directed by what is best for the child. This is the Norwegian welfare-paramountcy formulation — operationally equivalent to the UK paramount consideration, the Swedish avgörande, and the German am besten entspricht. The first-and-foremost phrasing positions welfare as the structural starting point of decision-making.

  • DV findings against the targeted parent can engage the screen (the standard application)
  • Sustained alienating conduct by the resident parent can engage the screen (the symmetric application — endangering the child's psychological health)
  • The Norwegian Høgsterett has confirmed the symmetric application — see HR-2019-1948-A and the broader Strand Lobben line.
  • The procedural prong — handsaminga av slike saker. Handsaminga av slike saker — the processing of such matters. This is doctrinally important: § 48 paramountcy applies not only to substantive decisions but also to the handsaminga (processing) of the case. In PA-pattern cases this means procedural choices (which expert to appoint, whether to engage sakkunnig, how to hear the child) must themselves be welfare-paramountcy-compliant.
  • The structural relationship with the Strand Lobben line. The Norwegian Høgsterett's reception of Strand Lobben v Norway (ECtHR, GC 2019) reshaped the operational application of § 48 — particularly on the procedural-prong dimension.
