Art. 337-ter — Provvedimenti riguardo ai figli

Primo comma. Il figlio minore ha il diritto di mantenere un rapporto equilibrato e continuativo con ciascuno dei genitori, di ricevere cura, educazione, istruzione e assistenza morale da entrambi e di conservare rapporti significativi con gli ascendenti e con i parenti di ciascun ramo genitoriale.

Secondo comma. Per realizzare la finalità indicata dal primo comma, nei procedimenti di cui all'articolo 337 bis, il giudice adotta i provvedimenti relativi alla prole con esclusivo riferimento all'interesse morale e materiale di essa. Valuta prioritariamente la possibilità che i figli minori restino affidati a entrambi i genitori oppure stabilisce a quale di essi i figli sono affidati, determina i tempi e le modalità della loro presenza presso ciascun genitore, fissando altresì la misura e il modo con cui ciascuno di essi deve contribuire al mantenimento, alla cura, all'istruzione e all'educazione dei figli. Prende atto, se non contrari all'interesse dei figli, degli accordi intervenuti tra i genitori, in particolare qualora raggiunti all'esito di un percorso di mediazione familiare. Adotta ogni altro provvedimento relativo alla prole, ivi compreso, in caso di temporanea impossibilità di affidare il minore ad uno dei genitori, l'affidamento familiare. All'attuazione dei provvedimenti relativi all'affidamento della prole provvede il giudice del merito e, nel caso di affidamento familiare, anche d'ufficio o su richiesta del pubblico ministero.

Terzo comma. La responsabilità genitoriale è esercitata da entrambi i genitori. Le decisioni di maggiore interesse per i figli relative all'istruzione, all'educazione, alla salute e alla scelta della residenza abituale del minore sono assunte di comune accordo tenendo conto delle capacità, dell'inclinazione naturale e delle aspirazioni dei figli. In caso di disaccordo la decisione è rimessa al giudice. Limitatamente alle decisioni su questioni di ordinaria amministrazione, il giudice può stabilire che i genitori esercitino la responsabilità genitoriale separatamente. Qualora il genitore non si attenga alle condizioni dettate, il giudice valuterà detto comportamento anche al fine della modifica delle modalità di affidamento.

Quarto comma. Salvo accordi diversi liberamente sottoscritti dalle parti, ciascuno dei genitori provvede al mantenimento dei figli in misura proporzionale al proprio reddito; il giudice stabilisce, ove necessario, la corresponsione di un assegno periodico al fine di realizzare il principio di proporzionalità, da determinare considerando:

1) le attuali esigenze del figlio.

2) il tenore di vita goduto dal figlio in costanza di convivenza con entrambi i genitori.

3) i tempi di permanenza presso ciascun genitore.

4) le risorse economiche di entrambi i genitori.

5) la valenza economica dei compiti domestici e di cura assunti da ciascun genitore.

Quinto comma. L'assegno è automaticamente adeguato agli indici ISTAT in difetto di altro parametro indicato dalle parti o dal giudice.

Sesto comma. Ove le informazioni di carattere economico fornite dai genitori non risultino sufficientemente documentate, il giudice dispone un accertamento della polizia tributaria sui redditi e sui beni oggetto della contestazione, anche se intestati a soggetti diversi.

Article 337-ter — Provisions concerning the children

First paragraph. The minor child has the right to maintain a balanced and continuous relationship with each parent, to receive care, education, instruction and moral assistance from both, and to preserve significant relationships with the ascendants and with the relatives of each parental line.

Second paragraph. To achieve the aim indicated in the first paragraph, in the proceedings referred to in article 337-bis, the court shall adopt the provisions concerning the children with exclusive reference to their moral and material interest. The court shall as a matter of priority evaluate the possibility that the minor children remain entrusted to both parents [i.e. joint custody — affido condiviso], or alternatively shall determine to which of them the children are entrusted; determining the times and modalities of their presence with each parent, and fixing the measure and manner by which each parent shall contribute to the maintenance, care, education and instruction of the children. The court shall take note, if not contrary to the children's interest, of the agreements reached between the parents — in particular where reached at the end of a family-mediation process. The court shall adopt any other provision concerning the children, including, in case of temporary impossibility of entrusting the minor to one of the parents, family fostering (affidamento familiare). Implementation of the provisions concerning custody shall be undertaken by the trial court and, in the case of family fostering, also of the court's own motion or upon request of the public prosecutor.

Third paragraph. Parental responsibility shall be exercised by both parents. Decisions of greater interest for the children concerning education, instruction, health and the choice of habitual residence of the minor shall be taken by common agreement, taking account of the capacities, natural inclination and aspirations of the children. In case of disagreement the decision shall be referred to the court. Limited to decisions on matters of ordinary administration, the court may establish that the parents exercise parental responsibility separately. Where a parent fails to comply with the conditions set, the court shall evaluate that conduct also for the purpose of modifying the custody arrangements.

Fourth, fifth, sixth paragraphs: maintenance provisions (proportional to income with five criteria), automatic ISTAT-index adjustment, and judicial tax-police investigation power for undocumented income claims.


Why article 337-ter matters for parental-alienation analysis

Article 337-ter is the operative statutory anchor for PA-relevant Italian family-court analysis. Three of its provisions are particularly significant:

  • First paragraph — child's right to balanced and continuous relationship with each parent: this is Italy's explicit codification of the bigenitorialità principle (bigenitoriality / dual-parentality). It is framed as a child's right rather than a parental entitlement — which is the correct doctrinal framing for PA analysis (alienating-pattern conduct deprives the child of a substantive right, not merely the target parent of an interest). The further clause preserving "significant relationships with the ascendants and the relatives of each parental line" is also notable — it includes grandparents and extended family in the protected relational network.

  • Second paragraph — joint-custody priority (Valuta prioritariamente la possibilità che i figli minori restino affidati a entrambi i genitori): the Italian court must first evaluate joint custody (affido condiviso) before considering exclusive custody. Exclusive custody (affido esclusivo) is the residual exception, available only where joint custody does not respond to the child's superior interest. The Corte di Cassazione has developed substantial jurisprudence holding that PA-pattern conduct by one parent can justify departure from joint custody to exclusive custody in favour of the target parent — see e.g., Cass. civ. sez. I, 8 aprile 2019, n. 9764 and subsequent decisions.

  • Third paragraph — non-compliance ⇒ modification trigger (Qualora il genitore non si attenga alle condizioni dettate, il giudice valuterà detto comportamento anche al fine della modifica delle modalità di affidamento): this is the direct enforcement and consequence provision. Sustained non-compliance with judicially-set custody conditions is an explicit statutory trigger for modification of the custody arrangement. In PA-context litigation this is the canonical hook for seeking transfer of primary custody from the alienating parent to the target parent.

The Riforma Cartabia (D.Lgs. 149/2022, in force 28 February 2023) reformulated the second paragraph to incorporate explicit mediation-outcome agreements as a court-approval pathway, and to consolidate the public-prosecutor's role in implementation of family-fostering orders.

Connection to ECHR positive-obligations doctrine

Italy's history with the ECtHR on Article 8 positive-obligations cases — the Italian triptych of Lombardo v Italy (2013), Bondavalli v Italy (2015), Improta v Italy (2017), and Strumia v Italy (2016) — has been deeply shaped by article 337-ter framework. Strasbourg has held Italy in violation where Italian family courts failed to use available enforcement powers under article 337-ter against sustained PA-pattern obstruction. The cases are foundational for the European positive-obligations doctrine; subsequent Italian Cassazione jurisprudence has tightened domestic enforcement responsiveness.
