The operational triad of Swedish family law in custody and contact disputes. Chapter 6 of the Föräldrabalken (Parental Code) is the governing statutory framework; § 2a establishes the barnets bästa (child's best interests) paramountcy principle as the decisive criterion; § 5 sets out the cooperation-ability test the court applies when allocating custody; § 15 governs the child's right to contact with a non-residential parent. These three provisions together form the statutory architecture within which Swedish föräldraalienation (parental alienation) cases are litigated.

Kap 6 § 2a — Barnets bästa¶
Barnets bästa ska vara avgörande för alla frågor om vårdnad, boende och umgänge.
Vid bedömningen av vad som är bäst för barnet ska det fästas avseende särskilt vid
- risken för att barnet eller någon annan i familjen utsätts för övergrepp eller att barnet olovligen förs bort eller hålls kvar eller annars far illa, och
- barnets behov av en nära och god kontakt med båda föräldrarna.
Hänsyn ska tas till barnets vilja med beaktande av barnets ålder och mognad.
Kap 6 § 5 — Vårdnadsbeslut¶
Står barnet under vårdnad av båda föräldrarna eller en av dem och vill någon av dem få ändring i vårdnaden, ska rätten besluta att vårdnaden ska vara gemensam eller anförtro vårdnaden åt en av föräldrarna.
Vid bedömningen av om vårdnaden ska vara gemensam eller anförtros åt en av föräldrarna ska rätten fästa avseende särskilt vid föräldrarnas förmåga att sätta barnets behov främst och ta ett gemensamt ansvar i frågor som gäller barnet. Rätten ska också fästa avseende vid om någon av föräldrarna har gjort sig skyldig till övergrepp mot barnet eller den andra föräldern, någon annan i familjen eller mot någon som familjen står i nära relation till.
Är båda föräldrarna emot gemensam vårdnad, ska den dock inte beslutas.
Frågor om ändring i vårdnaden enligt första stycket prövas på talan av en av föräldrarna eller båda. I mål om äktenskapsskillnad får rätten utan yrkande anförtro vårdnaden åt en av föräldrarna, om gemensam vårdnad är uppenbart oförenlig med barnets bästa.
Kap 6 § 15 — Umgänge¶
Barnet ska ha rätt till umgänge med en förälder som det inte bor tillsammans med.
Umgänget kan ske genom att barnet och föräldern träffar varandra eller genom att de har annan kontakt.
Barnets föräldrar har ett gemensamt ansvar för att barnets behov av umgänge med en förälder som barnet inte bor tillsammans med så långt möjligt tillgodoses. Den förälder som barnet bor tillsammans med ska lämna sådana upplysningar om barnet som kan främja umgänget, om inte särskilda skäl talar mot det. Om barnet ska resa till den andra föräldern svarar denna förälder för resekostnaderna, om det inte finns skäl att fördela kostnaderna på annat sätt.

Ch 6 § 2a — The child's best interests¶
The child's best interests shall be decisive for all questions of custody, residence and contact.
In assessing what is best for the child, particular regard shall be paid to
- the risk that the child or some other member of the family is subjected to abuse, or that the child is unlawfully removed or retained, or otherwise harmed; and
- the child's need for close and good contact with both parents.
Account shall be taken of the child's will, having regard to the child's age and maturity.
Ch 6 § 5 — Custody decision¶
If the child is in the custody of both parents or of one of them and one of them wishes to obtain a change in custody, the court shall decide that custody shall be joint or shall entrust custody to one of the parents.
In assessing whether custody shall be joint or entrusted to one of the parents, the court shall pay particular regard to the parents' ability to put the child's needs first and to take joint responsibility in matters concerning the child. The court shall also have regard to whether either parent has committed abuse against the child or against the other parent, against some other member of the family, or against someone with whom the family has a close relationship.
If both parents oppose joint custody, it shall not be decided.
Questions on change in custody under the first paragraph are determined on the application of one or both parents. In proceedings concerning divorce, the court may, without an application, entrust custody to one of the parents if joint custody is manifestly incompatible with the child's best interests.
Ch 6 § 15 — Contact¶
The child shall have the right to contact with a parent with whom the child does not live.
Contact may take place by the child and parent meeting each other, or by other means of communication between them.
The child's parents have a joint responsibility for ensuring that the child's need for contact with the parent with whom the child does not live is met as far as possible. The parent with whom the child lives shall provide such information about the child as may further the contact, unless particular grounds tell against it. If the child is to travel to the other parent, that parent shall bear the travel costs unless there are grounds for apportioning the costs differently.
Why this matters for PA¶
- § 2a — single paramountcy principle. Sweden does not balance the child's best interests against parental rights; § 2a makes the child's best interests decisive (avgörande) for all custody, residence and contact decisions. The two-factor enumeration that follows — (a) risk of abuse / abduction / harm and (b) the child's need for close contact with both parents — explicitly elevates both-parent contact to a primary child-welfare factor. This is doctrinally significant: in PA litigation, the targeted parent's argument that contact-frustration harms the child has direct statutory support in § 2a (b).
- § 5 second paragraph — the cooperation test as the PA-screening provision. Föräldrarnas förmåga att sätta barnets behov främst och ta ett gemensamt ansvar — the parents' ability to put the child's needs first and take joint responsibility. This is the operative test in Swedish PA litigation: where one parent demonstrably cannot put the child's needs above the parental conflict (i.e. engages in alienating conduct), the court treats this as a custody-allocation factor against that parent under § 5. The Högsta domstolen (HD) has applied this in NJA 2007 s.382 and NJA 2017 s.557 — sustained inability to cooperate is itself a custody-allocation ground.
- § 5 third paragraph — the asymmetric joint-custody bar. Är båda föräldrarna emot gemensam vårdnad, ska den dock inte beslutas. If both parents oppose joint custody, joint custody must not be ordered. Note the asymmetry: one parent's opposition is NOT a bar; the bar only operates where BOTH oppose. This deliberately prevents an alienating parent from blocking joint custody simply by stating opposition — the court must still order joint custody where the cooperation-test under § 5 is met, even over one parent's objection.
- § 15 third paragraph — the cooperation duty operationalised. Barnets föräldrar har ett gemensamt ansvar för att barnets behov av umgänge med en förälder som barnet inte bor tillsammans med så långt möjligt tillgodoses. Both parents bear joint responsibility for ensuring contact occurs. The provision goes further: Den förälder som barnet bor tillsammans med ska lämna sådana upplysningar om barnet som kan främja umgänget — the resident parent MUST provide information about the child that promotes the contact. Withholding information (a common subtler-alienation tactic) breaches § 15 directly.
- § 5 + 2a interaction in alienation cases. Where alienating conduct is established, the court has two operative tools: (a) under § 5, reallocate custody to the targeted parent if the alienating parent fails the cooperation test; (b) under § 2a, treat the alienating conduct as a § 2a (a) form of "annars far illa" (otherwise harmed) child-welfare risk factor. The Högsta domstolen has not adopted SAP/PAS as a syndromal framework — Swedish jurisprudence treats alienation as a conduct pattern triggering the existing statutory tests, not as a separate diagnostic category.
Procedural application¶
- First instance: tingsrätt (district court); appeal to hovrätt (court of appeal); ultimate appeal to Högsta domstolen with leave (prövningstillstånd).
- Pre-litigation mediation: parents must attempt samarbetssamtal (cooperation talks) through the socialtjänst (social services) before petitioning under FB ch 6 § 18 — except in DV-protective cases.
- Custody assessment: socialnämndens utredning (social services investigation) is the standard evidential pathway; the familjerättsbyrå (family-rights office) within each municipality conducts the investigation and reports to the court.
- The child is heard (barnets hörande) from age 7 onwards as a matter of practice; the child's will is given increasing weight with age and maturity per § 2a final paragraph, but is not determinative — it remains a welfare assessment.
Use in alienating-conduct cases¶
- NJA 2006 s.26 — Högsta domstolen held that a parent's sustained inability to cooperate with the other parent in the child's interest weighs heavily against that parent in custody allocation
- NJA 2007 s.382 — single-custody allocated to the non-alienating parent where the alienating parent had demonstrably failed the § 5 cooperation test over a sustained period
- NJA 2017 s.557 — reaffirmed the § 5 cooperation-test framework; rejected SAP-syndrome framing as not necessary to the analysis
These authorities establish the Swedish operative position: alienating-conduct is litigated through the existing statutory tests under §§ 2a + 5, with custody reallocation under § 5 as the principal remedy in established cases.
