What this means if your child is being withheld from you in Germany¶
If contact has just stopped, the operative law is BGB § 1684 — the child has a Recht auf Umgang (right of contact) with both parents, and each parent has a Pflicht zum Umgang (duty of contact). The same section gives the Familiengericht (Family Court) power to make Umgangsregelungen (contact orders) and to enforce them via FamFG § 89 (Ordnungsmittel — fine or arrest).
Procedural pathway. File an Antrag auf Regelung des Umgangs at the Familiengericht of the child's habitual residence (örtliche Zuständigkeit per FamFG § 152). A Verfahrensbeistand (children's procedural guardian per FamFG § 158) will normally be appointed; this is the structural counter-balance to alienating-parent influence. The Jugendamt (youth welfare office under SGB VIII) is heard but not the decision-maker.
A critical 2023 inflection point. The Bundesverfassungsgericht's Beschluss of 17 November 2023 (1 BvR 1076/23) characterised the Parental Alienation Syndrome (PAS) construct as "überkommen und wissenschaftlich nicht haltbar bzw. widerlegt" (outdated and scientifically untenable or refuted). German family courts now reject PA-syndrome framing in expert reports. This means: do not ask your court for a PAS-Diagnose; instead document the alienating behaviours themselves (refusal of handovers, blocked phone contact, denigration, parental-loyalty conflict) and ask the court to apply BGB § 1684 / § 1696 directly. Recent practice is consistent with OLG Frankfurt, Beschluss vom 5.1.2026 — 7 UF 88/25, which applied the BVerfG reasoning to a concrete case.
If the other parent ignores a court-made Umgangsregelung, apply for Vollstreckung under FamFG § 89 — the court can impose an Ordnungsgeld up to €25,000 or Ordnungshaft. Documentation of each missed contact is critical; keep contemporaneous notes, screenshots of messages, and any third-party witnesses (school, club). The §1696 BGB Abänderung threshold ("triftige, das Wohl des Kindes nachhaltig berührende Gründe") is what your court will apply to vary an existing order.
Get local counsel. Family law in Germany is Anwaltszwang (mandatory representation) at the OLG level and strongly recommended at the AG level. The Deutscher Familiengerichtstag maintains specialist directories. Verfahrenskostenhilfe (legal aid) is available where income-tested. Mediation under the Cochem-style practice still exists but is no longer institutionally continuous — and the Istanbul Convention art. 31 + 2022 GREVIO report have criticised cooperation-imperative models that under-weight evidence of violence.
