The sole-custody provision in Italian family law — the principal exception to the shared-custody (affidamento condiviso) default established by art. 337-ter CC. Art. 337-quater operates as the operational route by which a court allocates exclusive affidamento to one parent where shared custody is contrary to the child's interest — including, in alienating-conduct cases, where the alienating parent's conduct establishes the welfare-incompatibility threshold.
The provision has a distinctive structural feature: the second paragraph includes an express anti-weaponisation sanction — where an application for sole custody is manifestamente infondata (manifestly unfounded), the court may take that into account in adverse measures against the applying parent.

Art. 337-quater — Affidamento a un solo genitore e opposizione all'affidamento condiviso¶
Il giudice può disporre l'affidamento dei figli ad uno solo dei genitori qualora ritenga con provvedimento motivato che l'affidamento all'altro sia contrario all'interesse del minore.
Ciascuno dei genitori può, in qualsiasi momento, chiedere l'affidamento esclusivo quando sussistono le condizioni indicate al primo comma. Il giudice, se accoglie la domanda, dispone l'affidamento esclusivo al genitore istante, facendo salvi, per quanto possibile, i diritti del minore previsti dal primo comma dell'articolo 337-ter. Se la domanda risulta manifestamente infondata, il giudice può considerare il comportamento del genitore istante ai fini della determinazione dei provvedimenti da adottare nell'interesse dei figli, rimanendo ferma l'applicazione dell'articolo 96 del codice di procedura civile.
Il genitore cui sono affidati i figli in via esclusiva, salva diversa disposizione del giudice, ha l'esercizio esclusivo della responsabilità genitoriale su di essi; egli deve attenersi alle condizioni determinate dal giudice. Salvo che non sia diversamente stabilito, le decisioni di maggiore interesse per i figli sono adottate da entrambi i genitori. Il genitore cui i figli non sono affidati ha il diritto ed il dovere di vigilare sulla loro istruzione ed educazione e può ricorrere al giudice quando ritenga che siano state assunte decisioni pregiudizievoli al loro interesse.

Art. 337-quater — Sole custody to one parent and opposition to shared custody¶
The judge may order sole custody (affidamento) to only one of the parents where he or she considers, by reasoned order, that custody to the other parent would be contrary to the child's interest.
Each parent may, at any time, request sole custody where the conditions indicated in the first paragraph subsist. The judge, if granting the application, orders sole custody to the applying parent, preserving so far as possible the rights of the child set out in the first paragraph of article 337-ter. If the application proves manifestly unfounded, the judge may consider the conduct of the applying parent for the purposes of determining the measures to be adopted in the child's interest, without prejudice to the application of article 96 of the Code of Civil Procedure.
The parent to whom sole custody is granted, unless the judge orders otherwise, has the exclusive exercise of responsabilità genitoriale over the children; he or she must comply with the conditions determined by the judge. Unless otherwise established, decisions on matters of greater interest for the children are taken by both parents. The parent to whom the children are not entrusted has the right and duty to oversee their instruction and education, and may apply to the judge where he or she considers that decisions prejudicial to the children's interest have been taken.
Why this matters for PA¶
- The default is shared custody; art. 337-quater is the exception. Italian law since the 2006 reform operates on a shared-custody (affidamento condiviso) default established by art. 337-ter CC. Art. 337-quater is the operational route by which the default is displaced — but only on the basis of a reasoned order finding that shared custody is contrary to the child's interest.
- The second-paragraph anti-weaponisation sanction. The second paragraph contains an express provision against manifestamente infondata applications. Where a parent applies for sole custody on grounds the court determines to be manifestly unfounded — for example, false or exaggerated allegations against the other parent — the court may take the conduct of the applying parent into account in determining custody and other measures. This is doctrinally significant for PA litigation: it provides express statutory authority for treating false-allegation tactics as evidence against the applying parent.
- Art. 96 CPC cross-reference. Rimanendo ferma l'applicazione dell'articolo 96 del codice di procedura civile — the express reference to art. 96 CPC (responsibility for procedural abuse, including punitive damages for vexatious litigation) extends the sanction to costs and damages. A parent advancing manifestly unfounded sole-custody applications can be ordered to compensate the other parent under the procedural-abuse framework.
- Operational use in sustained-PA cases. In the most severe sustained-alienation cases, art. 337-quater is the route to allocating exclusive custody to the targeted (non-alienating) parent. Where the welfare assessment establishes that the alienating parent's conduct makes shared custody contrary to the child's interest, the court can use art. 337-quater to displace the default. Cass. ord. n. 23804/2022 is the leading authority on the conduct-pattern showing required.
- Third-paragraph preservation of non-custodial parent's role. Even where sole custody is allocated, the non-custodial parent retains the right and duty to oversee instruction and education and may apply to the judge where they consider that prejudicial decisions are being taken. This is the doctrinal floor: sole custody does not extinguish parental engagement; it allocates day-to-day decision-making authority.
Procedural application¶
- The competent court is the Tribunale per i Minorenni (until the Riforma Cartabia transition) or the new Tribunale della Famiglia post-transition.
- The CTU (consulente tecnico d'ufficio) typically conducts the welfare assessment that underpins the contrario all'interesse del minore finding — see expert evidence comparative.
- The curatore speciale del minore represents the child's interests where the parents' conflict makes joint representation inappropriate.
- The art. 337-quater determination is reasoned (con provvedimento motivato) — the court must give reasons for displacing the shared-custody default. This is appealable on the standard of reasonableness.
