The child's-advocate provision in German family-procedure law. FamFG § 158 establishes the framework for appointment of a Verfahrensbeistand — the German equivalent of a guardian ad litem, curatore speciale del minore (Italy), or curador del menor (Spain). The Verfahrensbeistand represents the child's interests as a procedural party where these may diverge from the parents' positions. In PA litigation the Verfahrensbeistand is doctrinally critical because alienating-conduct cases are structurally characterised by divergence between the child's true interests and the child's expressed positions (which may be the product of alienating influence).
§ 158 FamFG is the procedural anchor that — together with § 156 (Hinwirken auf Einvernehmen) and § 159 (Anhörung des Kindes) — forms the German Familiengericht's procedural framework for child-welfare-focused proceedings.

§ 158 FamFG — Bestellung eines Verfahrensbeistands¶
(1) Das Gericht hat dem minderjährigen Kind in Kindschaftssachen, die seine Person betreffen, einen fachlich und persönlich geeigneten Verfahrensbeistand zu bestellen, soweit dies zur Wahrnehmung der Interessen des Kindes erforderlich ist.
(2) Die Bestellung ist stets erforderlich, wenn
die teilweise oder vollständige Entziehung der Personensorge nach den §§ 1666 und 1666a des Bürgerlichen Gesetzbuchs in Betracht kommt,
der Ausschluss des Umgangsrechts nach § 1684 des Bürgerlichen Gesetzbuchs in Betracht kommt,
eine Verbleibensanordnung nach § 1632 Absatz 4 oder § 1682 des Bürgerlichen Gesetzbuchs in Betracht kommt.
(3) Die Bestellung ist in der Regel erforderlich, wenn das Interesse des Kindes zu dem seiner gesetzlichen Vertreter in erheblichem Gegensatz steht.
(4) Die Bestellung des Verfahrensbeistands endet mit Aufhebung, Rechtskraft der Entscheidung oder mit dem sonstigen Abschluss des Verfahrens. Das Gericht hebt die Bestellung auf, wenn der Verfahrensbeistand dies beantragt und einer Entlassung keine erheblichen Gründe entgegenstehen.
(5) Die Bestellung eines Verfahrensbeistands oder deren Aufhebung sowie die Ablehnung einer derartigen Maßnahme sind nicht selbständig anfechtbar.

§ 158 FamFG — Appointment of a guardian ad litem¶
(1) The court shall appoint for the minor child, in children's-matters proceedings concerning the child's person, a professionally and personally suitable guardian ad litem in so far as this is necessary for the safeguarding of the child's interests.
(2) Appointment is always required where
partial or complete removal of personal-care responsibility under §§ 1666 and 1666a of the Civil Code is contemplated,
exclusion of the contact right under § 1684 of the Civil Code is contemplated,
a continued-stay order under § 1632 paragraph 4 or § 1682 of the Civil Code is contemplated.
(3) Appointment is, as a rule, required where the child's interest stands in significant opposition to that of the child's legal representatives.
(4) The appointment of the guardian ad litem terminates with revocation, the legal force of the decision, or other conclusion of the proceedings. The court revokes the appointment where the guardian ad litem so applies and there are no significant grounds opposing release.
(5) The appointment of a guardian ad litem, the revocation thereof, and the refusal of such a measure, are not separately appealable.
Why this matters for PA¶
- Subsection (3) — the PA-trigger threshold. Die Bestellung ist in der Regel erforderlich, wenn das Interesse des Kindes zu dem seiner gesetzlichen Vertreter in erheblichem Gegensatz steht. Where the child's interest stands in significant opposition to that of the legal representatives, the Verfahrensbeistand is, as a rule, required. In alienating-conduct cases this threshold is regularly engaged: the child's expressed-view (often product of alienating influence) diverges from the child's welfare-interest, and the alienating parent's position diverges from the welfare-assessment professional's view. The Verfahrensbeistand operates as the procedural representative of the child's welfare, not of the child's expressed view.
- Subsection (2) — mandatory cases. Where the court is contemplating:
- § 1666/§ 1666a removal of parental authority (Kindeswohlgefährdung remedies)
- § 1684 contact-right exclusion
- § 1632(4) / § 1682 continued-stay orders
- appointment is mandatory (stets erforderlich). In sustained alienating-conduct cases where any of these remedies is on the table, the Verfahrensbeistand is procedurally required.
- The fachlich-persönlich-geeignet requirement. Fachlich und persönlich geeignet — the Verfahrensbeistand must be both professionally and personally suitable. The standard is interpreted by the BGH to require specialist family-law/child-welfare expertise. In PA-pattern cases, this typically means a Verfahrensbeistand with specific training in alienating-conduct assessment.
- The Verfahrensbeistand vs the child's expressed view. The Verfahrensbeistand's role is to represent the child's interests, including taking and conveying the child's expressed wishes — but is not bound by those wishes where they conflict with welfare assessment. The Verfahrensbeistand can present a position to the court that differs from the child's expressed preferences where welfare assessment so requires.
- Subsection (5) — non-appealability. Die Bestellung … sind nicht selbständig anfechtbar. The appointment decision is not separately appealable. This is procedural protection against the parents using appeals as a delaying tactic; the Verfahrensbeistand's role can be challenged only through the substantive proceedings.
Procedural application¶
- The Verfahrensbeistand is appointed by the Familiengericht on initiation of proceedings where the threshold under subsection (2) or (3) is met
- The Verfahrensbeistand has full party status — receives all filings, attends hearings, can examine witnesses
- The Verfahrensbeistand conducts direct interviews with the child (typically at neutral venue, often supported by the Jugendamt) and reports to the court
- Costs are borne by the court (state-funded) under § 158 (7) — there is no charge to parents for the Verfahrensbeistand
Use in alienating-conduct cases¶
