Spain — LO 8/2021 (LOPIVI) proposed hardening reform (2026)

TL;DR. Spain is strengthening, not softening, its statutory prohibition on the "síndrome de alienación parental" (SAP) construct. On 5 May 2026 the Council of Ministers approved (in first reading) a draft reform of Ley Orgánica 8/2021 (LOPIVI). The reform, as reported by Spanish press covering the Consejo de Ministros press briefing, expressly prohibits "SAP or any of its reformulations" and bars reports based on such approaches in any judicial or administrative procedure. What the 2021 statute already does

LO 8/2021 (LOPIVI), art. 11.3 already contains the world's most explicit statutory rejection of SAP as a construct: it directs public authorities not to admit "planteamientos teóricos o criterios sin aval científico que presuman interferencia o manipulación adulta, como el llamado síndrome de alienación parental." Art. 26.1.a) reinforces that positive-parenting frameworks may not be linked to "situaciones sin aval científico como el síndrome de alienación parental." The prohibition has been in force since 25 June 2021. Its practical effect has been to close the door on court-appointed evaluators presenting SAP-diagnostic frameworks as expert opinion in Spanish family proceedings.

What the 2026 reform proposes

According to Spanish press reporting the Consejo de Ministros briefing of 5 May 2026, the draft reform of LO 8/2021 tightens the 2021 prohibition in three ways:

  1. Coverage of reformulations. Where the 2021 text names "el llamado síndrome de alienación parental," the 2026 draft is reported to name "SAP or any of its reformulations" — explicitly capturing the successor labels ("alienating behaviour," "child rejection," "resist-refuse dynamics" as diagnostic-frame usage, etc.) that critics argue reintroduce SAP under new terminology.
  2. Extension to all administrative + judicial procedures. The 2021 prohibition is framed around administrative + judicial proceedings related to acreditación de la violencia; the 2026 draft extends the prohibition to any procedure in which SAP or a reformulation could influence a decision affecting a child.
  3. Reports and expert testimony. The draft is reported to bar reports "based on such approaches" from being received in evidence — moving from a prohibition on considering SAP to a prohibition on the underlying report.

Timeline

  • 2021-06-04: LO 8/2021 enacted (BOE-A-2021-9347). Prohibition in force from 25 June 2021.
  • 2023–2025: Enforcement pattern observed in Spanish family courts — SAP-based expert reports declined by trial courts; some Tribunal Supremo (TS) reasoning affirming the prohibition where challenged.
  • 2026-05-05: Consejo de Ministros first-reading approval of the draft reform (Anteproyecto de Ley). The bill enters the second-reading + Cortes Generales process from that date.
  • 2026-Q3/Q4 (expected): Anteproyecto to be presented to the Cortes Generales.
  • Not yet: BOE publication of the final enacted reform. Update this entry once the BOE reference is available.

Why this matters for the corpus

Spain and Brazil sit at the two ends of the "statutory PA codification" question in 2025-2026:

  • Brazil (Lei 12.318/2010) — the codified-PA archetype — is under active repeal since December 2025 (see statutes/brazil-lei-12318-repeal-status-2025-2026.md).
  • Spain (LO 8/2021) — the codified-SAP-inadmission archetype — is being hardened, with the 2026 draft reform extending the prohibition to reformulations and expert reports.

Together, the two 2026 legislative trajectories are the strongest available evidence that the "statutorily codified PA vs. statutorily prohibited SAP" divide is deepening, not converging. Corpus content on the international-comparative question should be current with both trajectories.
