Jurisdictional context¶

Germany has crossed an institutional inflection point on the so-called Parental Alienation construct (PAS / Eltern-Kind-Entfremdung) between 2023 and 2026. The apex reference is BVerfG 17.11.2023 — 1 BvR 1076/23, in which the First Senate characterised PAS / Eltern-Kind-Entfremdung as an uberkommene und fachwissenschaftlich als widerlegt geltende construct and held that an Umgangsregelung cannot be justified by a one-sided PAS-framing without a Gesamtwurdigung anchored in the Kindeswohl. This is the highest-rank German constitutional-court signal against PAS-as-diagnosis to date (see case-study:bverfg-1-bvr-1076-23-germany-2023). The BVerfG explicitly drew on the Deutsches Jugendinstitut (DJI)-anchored Zimmermann / Fichtner / Walper / Lux / Kindler (2023) ZKJ critique 'Verdorbener Wein in neuen Schlauchen' as scientific authority — meaning the critique-camp scholars are the BVerfG's own cited authority, not a minority position.

The constitutional line has since been reinforced by OLG Frankfurt am Main 05.01.2026 — 7 UF 88/25, which both labelled PAS a pseudowissenschaftliche Hypothese and imposed Sachverstandigen-Mindestanforderungen (multimodaler Ansatz, no one-sided selection of interview partners) for any Gutachten touching alleged alienation dynamics (see case-study:olg-frankfurt-7-uf-88-25-germany-2026). The statutory baseline remains §§ 1684 BGB (Umgangsforderungspflicht / Wohlverhaltensgebot) and 1696 BGB (Abanderung fur triftige Grunde), with FamFG §159 on the Kindesanhorung and the BGH 1980 / 2009 line treating Umgangsausschluss as ultima ratio. Practitioner regulation runs through Approbation als Psychologische:r oder Arztliche:r Psychotherapeut:in (PsychThG-Reform 2020), Kammerregistrierung bei der jeweiligen Landes-Psychotherapeutenkammer, and — for forensic Sachverstandige — Fachpsycholog:in fur Rechtspsychologie BDP/DGPs.

Three historical / institutional caveats anchor the directory. First, the Cochemer Modell (Familiengericht Cochem-Zell 1992, Richter Jurgen Rudolph) was integrated conceptually into the 2009 FamFG-Reform, but Cochem-Zell itself discontinued the Modell after Rudolph's 2008 retirement — it survives as an exportable label, not as a living local practice. Second, PETRA — the operational vehicle of the recognition camp's most cited contemporary German voice, Stefan Rucker — operates from PETRA Projekt GmbH & Co. KG based in Bremen and NOT from the Universitat Bremen; the Universitat Bremen Senat publicly disputed the framing 'PETRA Arbeitsgruppe an der Universitat Bremen' in 2024 and requested correction. Third, the Bundesarbeitsgemeinschaft Eltern und Kind (BAG-EUK) named in activist literature is not Vereinsregister-verifiable at directory standard. The Istanbul-Konvention Art. 31 and the GREVIO Germany Baseline Report 2022 form the supranational anchor of the critique camp.

Structural findings¶

Germany 2023-26 has crossed an institutional inflection point on the PAS construct: the BVerfG 17.11.2023 — 1 BvR 1076/23 ruling, combined with the DJI-anchored Zimmermann / Fichtner / Walper / Lux / Kindler (2023) ZKJ critique and the OLG Frankfurt 7 UF 88/25 (5.1.2026) Sachverstandigen-Mindestanforderungen, has moved the critique camp from minority position to institutional mainstream. The German PA-clinical scene is structurally inverted compared with most other PASG-active jurisdictions: the recognition camp is counter-mainstream, the critique camp is institutional core.
Critique-camp scholars are the BVerfG's own cited authority: the Zimmermann / Fichtner / Walper / Lux / Kindler (2023) ZKJ team is not an external commentariat but the scientific reference the Federal Constitutional Court itself relied on. This makes German critique-camp clinicians uniquely well-anchored relative to peers in other EU jurisdictions.
The recognition camp's older anchors (Boch-Galhau, Kodjoe, Andritzky, Jopt) operate without an institutional university-clinic base. The contemporary recognition-camp lead voice, Stefan Rucker, operates from PETRA Projekt GmbH & Co. KG (private vehicle) — NOT from the Universitat Bremen, whose Senat publicly disputed the 'PETRA Arbeitsgruppe an der Universitat Bremen' framing in 2024 and requested correction.
Jorg Fichtner is critique-camp, not recognition-camp — frequently miscategorised by external observers because of his forensic Sachverstandigen practice; he is in fact a co-signatory of the central ZKJ 2023 critique article cited by the BVerfG.
Cochem-Zell no longer practices the Cochemer Modell — model was discontinued at the Cochem Familiengericht after Rudolph's 2008 retirement and survives as an exportable method label only.
No individual German forensic Sachverstandige is repeatedly positively-named in post-2023 OLG PA case-law: the case-law trend is the systematic criticism of Gutachter-qualifications in PA-framed custody-transfer recommendations, codified by OLG Frankfurt 7 UF 88/25 (2026).
Reinhart Wolff is excluded from the directory on safeguarding grounds (publicly documented historical position sympathetic to child-adult sexual contact disqualifies him from a child-protection-aligned PA directory). Listed in excluded[] with primary-source pointer.
