Jurisdictional context¶
France's institutional landscape on the so-called Parental Alienation construct (syndrome d'aliénation parentale / SAP / aliénation parentale) is structured by a single political-judicial sequence running from 2023 through late 2024. The CIIVISE 2023 Rapport final — Violences sexuelles faites aux enfants : on vous croit extensively documented SAP allegations as a defensive technique deployed in family-court proceedings against mothers disclosing domestic or sexual violence; loi n° 2024-233 du 18 mars 2024 then tightened the procedural framework where intrafamily violence is alleged; and in November 2024 juge Édouard Durand was not reappointed to the reconstituted CIIVISE under Sébastien Boueilh's presidency. The three events form one political sequence whose net effect is to harden the critique-camp institutional position while politicising the personnel who carried it — without, however, restoring any institutional legitimacy to SAP as a diagnostic category. MIVILUDES has on multiple occasions, in its annual reports, issued signaux de vigilance regarding SAP-style framings (this is a vigilance signal, not a ban — the common shorthand 'MIVILUDES a interdit le SAP' is a paraphrase error).
No French autorité publique endorses SAP as a diagnostic category. The Haute Autorité de Santé (HAS) has issued no recommandation de bonne pratique validating SAP; the Académie nationale de médecine has issued no endorsement; the Société Française de Psychiatrie de l'Enfant et de l'Adolescent et des Disciplines Associées (SFPEADA) has issued no position paper endorsing SAP; and the Conseil National de la Protection de l'Enfance (CNPE) has not endorsed the construct. Statutory baseline runs through Code civil arts. 373-2 and 373-2-11, which vest wide discretion in the juge aux affaires familiales (JAF), with expertises judiciaires a routine instrument; first-line departmental child-protection is handled by the Cellule de recueil des informations préoccupantes (CRIP) under CASF art. L226-3. Practitioner regulation runs through the Conseil national de l'Ordre des médecins (CNOM) for physicians/psychiatrists, the titre de psychologue protected by loi n° 85-772 du 25 juillet 1985 (ADELI / RPPS registration), and the FFPP for the federated psychology professions.
The French recognition camp is civil-society-anchored rather than institutionally-anchored: its central NGO is ACALPA (Association Contre l'Aliénation Parentale, founded and presided by Olga Odinetz, Lyon), which functions as the recognition-camp's plaidoyer and colloque organiser. The critique camp, by contrast, is embedded across CIIVISE, the Délégation aux droits des femmes of the Assemblée nationale, MIPROF (Mission interministérielle pour la protection des femmes victimes de violences), CNPE, the victimologie clinical-academic field founded by Gérard Lopez, and — for the contrôle coercitif paradigm now displacing SAP-style readings in French academic discourse — Université Paris Nanterre via Andreea Gruev-Vintila (LAPPS EA 4386).
Structural findings¶
- France is institutionally asymmetric, not merely numerically split: no French autorité publique (HAS, Académie nationale de médecine, SFPEADA, CNPE) has ever endorsed SAP as a diagnostic category. The asymmetry is institutional, not a question of headcount, and any directory that frames the French scene as a balanced recognition-vs-critique split misrepresents the institutional terrain.
- The French recognition camp rests on approximately three named clinical voices (Paul Bensussan, Jean-Marc Delfieu, Jacques Biolley) plus one civil-society NGO (ACALPA, Olga Odinetz), with zero university chair, zero société savante endorsement, zero HAS recommandation de bonne pratique, and zero Académie nationale de médecine position paper. By contrast the critique camp is institutionally embedded across CIIVISE, Délégation aux droits des femmes, MIPROF, CNPE, Université Paris Nanterre, the victimologie clinical-academic field, and the médecine légale community.
- MIVILUDES has issued signaux de vigilance on SAP-style framings in its annual reports — weaker than the popular paraphrase 'MIVILUDES a interdit le SAP' (which is incorrect) but still a real and repeated state-vigilance flag against the construct's misuse in family-court proceedings.
- The CIIVISE 2023 Rapport final, loi n° 2024-233 du 18 mars 2024, and the November 2024 non-reappointment of juge Édouard Durand to the reconstituted CIIVISE under Sébastien Boueilh form a single political sequence. Net effect: critique-camp institutional position hardened, personnel politicised — but no restoration of SAP legitimacy.
