Practitioners — Asia (IN/SG/HK/JP) — Lawyers¶
Jurisdictional context¶
This file is a regional aggregate covering Asian lawyer registers across four jurisdictions (India, Singapore, Hong Kong, Japan). The schema requires a 2-3 letter ISO-shape country_code; 'ASI' is used here as a non-ISO regional placeholder and per-entry jurisdictional locus is carried in the entry id prefix (in., sg., hk., jp.) and in stance_notes. India's PA terrain is anchored by the Hindu Marriage Act 1955 and the Family Courts Act 1984 operationalised through the Supreme Court of India and High Court family-bench jurisprudence; the apex parental-alienation authority is Lt Col Vivek Singh v Romani Singh (Civil Appeal 3962/2016, (2017) 3 SCC 231), which holds welfare-of-the-child paramount and names PA as a litigable harm. The Delhi High Court line ABC v XYZ 2023 SCC OnLine Del 6099 and the more recent A v B 2026 SCC OnLine Del 276 have consolidated PA-recognition reasoning at the High Court level, including findings on coached-child testimony and access-enforcement. Singapore's family-justice pipeline runs under the Women's Charter (Cap. 353) and the Guardianship of Infants Act (Cap. 122) through the Family Justice Courts (FJC), with TEN v TEO [2020] SGHCF 20 standing as the flagship parental-alienation appellate authority. Hong Kong custody disputes proceed under the Matrimonial Causes Ordinance Cap. 179, the Guardianship of Minors Ordinance Cap. 13, and the Matrimonial Proceedings and Property Ordinance Cap. 192 (FCO Cap. 192) framework on financial relief; a Re Y / H v W [2021] HKCA 733 line has engaged PA-adjacent reasoning at appellate level. Japan's pre-reform Civil Code Art. 819 (1947) imposed mandatory sole post-divorce parental authority, generating the 子の連れ去り (child abduction by a parent) and 引き離し (forced separation from a parent) discourse; Act No. 33 of 2024 (民法等の一部を改正する法律) amends Art. 819 to introduce joint parental authority (共同親権) effective 1 April 2026, with DV / abuse carve-outs retaining sole-custody pathways.
The Asia recognition-camp apex jurisprudence skews PA-recognition unlike the EU and LATAM registers. India's Supreme Court has explicitly named parental alienation as litigable harm; Singapore's SGHCF has accepted PA as an analytic frame in TEN v TEO; Hong Kong appellate reasoning in H v W has engaged PA-adjacent harm; and Japan's 2024 Civil Code reform institutionalises 共同親権 for the first time since 1947, structurally cohering with the international recognition camp's reform agenda. The critique register is correspondingly thin at the apex-counsel level — there is no Indian, Singaporean, Hong Kong or Japanese senior-counsel cluster comparable to the German Zimmermann / Walper / Fichtner critique camp or the Spanish Vaccaro 'violencia vicaria' coinage. The critique register runs primarily through (a) Indian women's-rights senior counsel whose PA-specific stance is not publicly stated but who anchor the DV-protection frame (Jaising, Grover, Nundy), and (b) the Japan Federation of Bar Associations (Nichibenren / JFBA) institutional position on the 2024 Civil Code reform carrying DV-protection-primacy framing. Cross-jurisdictional bridges to therapists Asia v2 run through court-attached forensic-clinical infrastructure (FJC CAPS, HKFWS PCC, 家庭裁判所調査官) and through women's-rights NGOs (AWARE Singapore, ACSVAW Hong Kong, Japan WAN).
Structural findings¶
- 22 verified v1 practitioners migrated at fidelity across India (7), Singapore (5), Hong Kong (6) and Japan (4); split preserved per v1 summary block.
- Asia recognition-camp dominance: 16 of 22 entries are recognition-stance, anchored by named counsel of record in Vivek Singh v Romani Singh (India SC 2017), TEN v TEO (SGHCF 2020), H v W (HKCA 2021), and the international Japan-Hague / 共同親権 reform discourse — structurally distinct from the EU register where the critique camp carries published-clinician apex weight.
- India apex-court counsel cluster (Luthra, Anand, Anil Malhotra) plus the Chandigarh international-removal duo (Malhotra & Malhotra) carries the strongest single-jurisdiction recognition register in the Asia aggregate; the women's-rights critique-adjacent cluster (Jaising, Grover, Nundy) supplies the DV-protection counterweight without explicit PA-specific public statements.
- Singapore recognition register runs through the named counsel of record in TEN v TEO [2020] SGHCF 20 (Hing Wei Yuen Angelina, Ng Yu Hui Michelle of Integro Law Chambers) plus cross-border Hague-Convention specialists (June Lim, Engelin Teh); no Singapore lawyer-side critique register located beyond institutional NGO channels (AWARE — cross-linked to therapists Asia v2).
- Hong Kong recognition register is firm-led: Rita Ku & Ser's published 'PA = emotional abuse' institutional position, Hugill & Ip's Legal 500 thought-leadership, Withers HK family practice, and BCLP's IBA Family Law Committee output; no HK lawyer-side critique register located beyond institutional NGO channels (ACSVAW — cross-linked to therapists Asia v2).
- Japan register is structurally bifurcated: international PA-recognition advocacy carried by US-bar / academic-lawyer voices (Jeremy Morley NY Bar, Colin Jones Doshisha) plus the Kizuna NGO (John Gomez), and institutional critique-leaning-middle carried by the Japan Federation of Bar Associations on the 2024 共同親権 Civil Code reform — cross-linked to therapists Asia v2 (jp.womens-action-network and jp.jfba-critique-flag).
- Cross-jurisdictional bridges to therapists Asia v2: court-appointed Indian counsellor practitioner:in.kanungo-iti anchors the apex Vivek Singh procedural-counsel infrastructure; HK ACSVAW (practitioner:hk.acsvaw) carries the critique register the HK lawyer file does not; Japan WAN (practitioner:jp.womens-action-network) carries the Japan critique register the JFBA entry partially flags.
