Andorra (Principality of Andorra / Principat d'Andorra)

Jurisdiction code: AD · Legal system: civil-law
Language(s): ca

Andorra is a Western European civil-law constitutional co-principality (uniquely co-headed by the Bishop of Urgell in Spain and the President of France as Co-Princes) whose family-law framework operates under the Civil Code (Codi de la Família) and Qualified Law on Marriage 2017 (Llei Qualificada del Matrimoni). Parental authority (potestat parental) and child custody are governed by Civil Code arts. 27-58 and Law 14/2019 on Children's and Adolescents' Rights. The Superior Court of Justice (Tribunal Superior de Justícia) is the apex court for civil and criminal matters; the Constitutional Court (Tribunal Constitucional) operates separate constitutional review. Family-law matters are heard at first instance in the Court of Magistrates (Tribunal de Batlles). Psychology profession is regulated through the Andorran Order of Psychologists. Andorra is silent on 'parental alienation' as a statutory label; courts operate substantively under the superior-interest-of-the-child standard codified in Law 14/2019. Andorra acceded to the Hague Convention 1980 effective 1 July 2011. Andorra is a Council of Europe member subject to ECHR jurisdiction.
