Albania (Shqipëria)

Jurisdiction code: AL · Legal system: civil-law
Language(s): sq

Albania is a Western Balkans civil-law unitary republic whose family-law framework operates under the Family Code (Kodi i Familjes, Law 9062/2003) in force 21 December 2003. Parental responsibility (përgjegjësia prindërore) is governed by Kodi i Familjes arts. 215-255; joint exercise during marriage is the statutory default. The Gjykata e Lartë (High Court of Albania, Tirana) is the apex court for civil and criminal matters; the Gjykata Kushtetuese (Constitutional Court) operates separate constitutional-review and individual-constitutional-complaint jurisdiction. Psychology profession is regulated under Law 40/2016 (On the Profession of Psychologist) establishing the Urdhri i Psikologut (Order of Psychologists) — statutory professional-order regime. Albania is silent on 'parental alienation' as a statutory label; courts operate substantively under the interesi më i lartë i fëmijës (best-interests-of-the-child) standard. Council of Europe member; ECHR Strasbourg jurisprudence applies.
