Five-country comparison

The LATAM5 bloc constitutes the densest comparative LATAM institutional landscape on the parental-alienation construct, with each constituent jurisdiction having shipped a dedicated v1.0 jurisdiction sidecar and per-country v2 therapist files (AR + CL + CO + IN — Mexico and Brazil have focused-institutional v2 entries supplementing legacy v1.0 brazil/mexico content).

Structural observations

1. Brazil + Spain are the world's only two statutory PA jurisdictions

Brazil Lei 12.318/2010 is the world's only substantive PA-recognition statute (codifies alienating conduct as actionable). Spain LOPIVI 2021 Disposición adicional 17ª is the world's only PA-inadmission statute (frames PAS as inadmissible). The two statutory anchors point in opposite directions. Brazil is the LATAM5 outlier with statutory PA recognition; the other four LATAM5 jurisdictions operate through indirect statutory hooks + apex doctrine + institutional position.

2. Argentina — institutional inadmission WITHOUT statutory inadmission

Inverse of Spain pattern. Argentina has no statute naming SAP/AP — neither to recognise (Brazil) nor to inadmit (Spain). The institutional inadmission operates through dense colegios profesionales routing: FePRA Pronunciamiento 14.12.2019 + 7 provincial Colegios + ASAPMI + Defensoría del Pueblo CABA. The 2024 Milei restructuring shifted the institutional anchor from federal executive to universities + colegios + civil society. CSJN has not issued an apex PA-specific ruling — Argentine doctrine is institutional/gremial-anchored.

3. Colombia — widest institutional critique coalition in LATAM

Five converging state authorities cited in T-526/2023: COLPSIC (regulator) + ICBF (administrative child-protection) + MinSalud (health regulator) + Procuraduría General + Corte Constitucional (apex). COLPSIC 2017 was recognition-leaning; the 2023 Posición is a deliberate institutional pivot from recognition-camp Concepto Técnico (17.9.2017) to explicit construct critique. T-526/2023 (Diana Fajardo Rivera, Sala Tercera) cites gender-perspective Informe A/HRC/53/36 Alsalem + MESECVI 13.4.2023 — multi-tier international critique anchor convergence.

4. Mexico — proportionalist apex doctrine (figura sí, automatismo no)

SCJN AI 11/2016 (Piña Hernández ponente, octubre 2017) is the LATAM5's only apex constitutional decision with explicit "figura sí, automatismo no" doctrine. Validates legislative recognition of AP as juridically relevant phenomenon BUT invalidates automatic sanction (suspension/loss of patria potestad). Subsequently extended in AI 74/2024 (Tlaxcala, abril 2025). SMP (Sociedad Mexicana de Psicología) is institutionally silent — anomalous within LATAM5. Mexico operates federalism descentralizado + doctrina apex unificada — 32 state Civil Codes coexist with apex SCJN binding precedent.

5. Chile — INVERTED LATAM PATTERN

Structurally distinct from the other LATAM5 jurisdictions. Chile operates the inverse pattern: rejection routes NOT via colegio profesional psicología (CdPCh silent) but via Cámara de Diputadas (rejected Boletín 10.516-18 abril 2024 by 58-45-26 vote) + Ejecutivo Boric-Orellana (Ministra MMEG Antonia Orellana) + ANMM (Asociación Nacional de Magistradas y Magistrados, Verónica Vymazal informe técnico) + Ley 21.675/2024 (violencia vicaria art. 5). DOUBLE INSTITUTIONAL SILENCE: CdPCh + Defensoría de la Niñez (Quesille) — two institutions that in other LATAM jurisdictions would be primary critique anchors are silent. Corte Suprema is NOT a critique anchor — entonces-vocera Ángela Vivanco defended SAP publicly January 2023; CS Sala Cuarta incorporates gender perspective + violencia vicaria via Ley 21.675/2024 WITHOUT proscribing SAP. 6. Recognition pole geographically inverse in Chile

Recognition camp in Chile is geographically decentralized: Zicavo UBB Concepción (ZICAP scale unusually strong recognition instrument development) + Antofagasta + Arica — INVERSE to metropolitan Santiago critique camp pattern. Distinct from the other LATAM5 jurisdictions where recognition is concentrated in metropolitan-axis (CABA Argentina; CDMX Mexico; Bogotá Colombia; São Paulo Brazil).

7. 2017 axial year for apex hispanohablante engagement

Trio apex hispanohablante 2017: STS 519/2017 ES (septiembre 2017) + Vivek Singh v Romani Singh IN (febrero 2017) + SCJN AI 11/2016 MX (octubre 2017). The three apex decisions in 2017 constitute the modern apex-court hispanohablante recognition / proportionalist consolidation. STS + SCJN adopt middle-stance (figura sí, sindromología no); Vivek Singh adopts substantive recognition via counsellor-evaluator route.

8. CEDAW Informe Sombra + Belém do Pará as multi-tier international anchors

Across LATAM5 institutional positions, two international-law anchors recur: CEDAW shadow reports (Argentina FEIM Informe Sombra 2016 Bianco+Correa) + Convención de Belém do Pará / MESECVI Declaración 13.4.2023. Combined with UN Special Rapporteur Reem Alsalem Report A/HRC/53/36 (12.8.2022), these constitute the multi-tier international critique-anchor convergence cited explicitly in Corte Constitucional Colombia T-526/2023 + IEFH/IGVM Belgium Recommandation 2023/001 + multiple LATAM5 institutional positions.
