Apex-court positions¶
Recognition pole (apex-court recognises PA as substantive frame)¶
- India — Lt Col Vivek Singh v Romani Singh, (2017) 3 SCC 231 (Supreme Court of India, Chelameswar J. & Sikri J., 13 February 2017). Apex-court decision that expressly defines "The Parental Alienation Syndrome" on the record. The only Indian Supreme Court decision engaging PAS terminology directly. Subsequent Delhi HC line (ABC v XYZ 2023 SCC OnLine Del 6099; A v B 2026 SCC OnLine Del 276) crystallises PA as 'extreme mental cruelty' under HMA s.13(1)(ia). - Singapore — TEN v TEO and another appeal [2020] SGHCF 20 (Debbie Ong J, then Presiding Judge FJC). Two-limb doctrine: court cannot force children to love a parent but expects custodial parent to cease alienating behaviour and support reunification. s.68 Women's Charter maintenance duty independent of access. - South Africa — T.L.D v B.G [2023] ZAGPJHC 801 (Adams J, Gauteng Local Division Johannesburg, 13 July 2023). Leading SA High Court authority crystallising PA as clinically and judicially recognised phenomenon under Children's Act s.7(1)(c) attitude-of-parents factor. - Scotland — NF v AF [2025] CSOH 13 (Lord Stuart, Court of Session Outer House, 5 February 2025). Strongest single Scottish judicial PA finding to date — characterised knowingly false allegations as direct emotional abuse of the child, decided on welfare/abuse grounds rather than contested 'PAS' label. - Poland — Sąd Najwyższy, uchwała III CZP 20/25 z 3 października 2025 r. Pro-enforcement apex stance restoring effectiveness of art. 598¹⁶ § 1 k.p.c. monetary sanctions against alienating parent, without engaging clinical PAS diagnosis. Middle pole (apex-court adopts proportionalist or differential-diagnosis frame)¶
- Mexico — SCJN Acción de Inconstitucionalidad 11/2016 (Oaxaca, ponente Ministra Norma Lucía Piña Hernández, octubre 2017). Doctrina: figura sí, automatismo no. Validates legislative recognition of AP as juridically relevant phenomenon but invalidates automatic sanction (suspension/loss of patria potestad). - Spain — Tribunal Supremo, Sala Primera, STS 519/2017 de 22 de septiembre de 2017. Confirms custodia compartida supporting itself on parental-manipulation finding without endorsing SAP syndrome. Disposición adicional 17ª LOPIVI 2021 — only statutory PA-inadmission law globally (alongside Brazil Lei 12.318/2010 statutory recognition — the two world statutory PA jurisdictions point in opposite directions). Critique pole (apex-court disqualifies PAS construct)¶
- Italy — Cassazione Civile Sez. I, ordinanze 13217/2021 (17 maggio 2021) → 9691/2022 (24 marzo 2022) → 4595/2025. Strongest EU apex critique line: PAS is "pseudo-scientific" and cannot found measures depriving parental relations. - Colombia — Corte Constitucional T-526/2023 (M.P. Diana Fajardo Rivera, Sala Tercera, 30 noviembre 2023). Proscribes SAP as diagnostic instrument citing 5 convergent state authorities (COLPSIC + ICBF + Procuraduría + MinSalud + constitutional analysis). Widest LATAM institutional critique coalition. - Netherlands — NIP + NVvP institutionally silent. Positional weight in three documents (NJI Richtlijn 2020 + Expertteam 2021 + Kinderombudsman KOM003/2014) — not in associations.
