Evidence — EU Apex Sequence 2017-2025

A structural synthesis of the continental European apex-court engagement with the parental-alienation construct from 2017 to 2025, compiled from the AntiAlienate knowledge base v2 corpus. CC BY 4.0.

The eight-year arc

Between September 2017 and October 2025, six continental European apex jurisdictions issued landmark decisions engaging the PA / SAP construct or related fact-patterns. The sequence — Spain → Italy (×3) → Germany → Poland — constitutes the principal continental European apex-court doctrinal development on PA in the modern era.

1. Spain — STS 519/2017 (22 September 2017)

Tribunal Supremo, Sala Primera. Confirms custodia compartida supporting itself on parental-manipulation findings without endorsing the SAP syndrome. STS 519/2017 anchors a Spanish apex line that is subsequently codified at statutory level by LOPIVI 2021 Disposición adicional 17ª — the only world statutory PA-inadmission law. 2. Italy — Cassazione Civile Sez. I, ordinanza 13217/2021 (17 maggio 2021)

Italian Court of Cassation, First Civil Section. Foundational Italian apex critique decision: PAS lacks scientific validity and cannot found measures depriving parental relations. 3. Italy — Cassazione Civile Sez. I, ordinanza 9691/2022 (24 marzo 2022)

Italian Court of Cassation, First Civil Section. Consolidating decision: PAS "costituisce il fondamento pseudoscientifico" of harmful measures; ordinary evidential verification is required for any custody / contact restriction. Engages the Strasbourg Article 8 procedural-due-diligence standard (Lombardo/Improta/Strumia triptych) alongside PAS-construct disqualification — the doctrinal articulation of how Italian domestic apex incorporates Strasbourg standards. 4. Germany — BVerfG 17.11.2023 – 1 BvR 1076/23

Bundesverfassungsgericht (Federal Constitutional Court). Constitutional Court qualifies SAP as "veraltet und wissenschaftlich widerlegt" (outdated and scientifically refuted). PAS-based Sachverständigengutachten constitutionally untenable under Grundgesetz Art. 6(2) parental rights + Art. 2(1) children's personality rights. 5. Italy — Cassazione Civile Sez. I, sentenza 4595/2025

Italian Court of Cassation, First Civil Section. Most recent Cassazione PAS-critique decision consolidating the 13217/2021 → 9691/2022 doctrinal line. Combined with the Riforma Cartabia D.lgs. 149/2022 statutory restriction on CTU PAS-based assessments, the Italian apex critique becomes the EU's strongest statute-and-caselaw integrated stance. 6. Poland — Sąd Najwyższy III CZP 20/25 (3 października 2025)

Sąd Najwyższy, Izba Cywilna. FIRST APEX CEE (Central and Eastern European) decision in the sequence. Pro-enforcement stance restoring effectiveness of art. 598¹⁶ § 1 k.p.c. monetary sanctions against alienating parent (narrowing the constitutional immunity Trybunał Konstytucyjny SK 3/20 had carved out in 2022) — WITHOUT engaging the clinical PAS diagnosis. Structural observations

1. EU apex critique-dominant

Five of the six EU apex decisions in this sequence (Italy ×3 + Germany + Spain LOPIVI consolidation) take a critique or middle-with-statutory-inadmission stance. Only Poland operates an enforcement-recognition stance — and Polish doctrine pointedly avoids engaging the clinical PAS diagnosis. Result: continental EU apex-court engagement is structurally critique-dominant in the construct-validity dimension, with enforcement-recognition operating only at the procedural-remedy level (Poland).

2. Spain + Brazil are the world's only two statutory PA jurisdictions

Within the EU sequence, Spain LOPIVI 2021 Disposición adicional 17ª is the only statutory PA-inadmission law worldwide. Outside the EU, Brazil Lei 12.318/2010 is the only world statutory PA-recognition law. The two statutory anchors point in opposite directions — Spanish inadmission via apex line vs Brazilian recognition via apex line. EU continental jurisprudence aligns with the Spanish direction.

3. Italian apex line is doctrinally densest

Three Cassazione ordinanze (13217/2021 + 9691/2022 + 4595/2025) within four years produce the EU's strongest construct-critique line. Combined with Riforma Cartabia D.lgs. 149/2022 statutory CTU restriction and the prior Strasbourg Italian triptych (Lombardo 2013 + Strumia 2016 + Improta 2017) Article 8 procedural-due-diligence standard, Italy operates the EU's most integrated apex-court + statute + Strasbourg multi-layer critique architecture.

4. German constitutional dimension distinct

BVerfG 1 BvR 1076/23 is the only constitutional-court-level construct decision in the EU sequence. Other apex decisions (Italian Cassazione + Spanish Tribunal Supremo + Polish Sąd Najwyższy) operate at civil/supreme-court level. The German constitutional articulation adds a Grundgesetz Art. 6 parental-rights + Art. 2(1) children's-personality-rights dimension absent from the other decisions.

5. Poland's structurally distinctive pro-enforcement biegun

Poland's SN III CZP 20/25 is the only EU apex decision operating a pro-enforcement / not-clinical stance. Polish doctrine narrows the constitutional immunity from monetary sanction that Trybunał Konstytucyjny SK 3/20 (22.6.2022) had carved out — restoring the effectiveness of art. 598¹⁶ § 1 k.p.c. against alienating custodial parents. But Polish doctrine pointedly does not engage the PAS clinical construct: enforcement-recognition + construct-agnostic. This is the structurally distinctive Polish biegun within the EU sequence.

6. First apex CEE

SN III CZP 20/25 is the first apex Central and Eastern European decision in the modern EU PA-apex sequence. Prior EU apex engagement was concentrated in southern/western EU (Italy + Spain) + central EU (Germany). Polish entry extends the sequence eastward.

7. Strasbourg Article 8 procedural-due-diligence cuts across

The Strasbourg Italian triptych (Lombardo 2013 + Strumia 2016 + Improta 2017) establishes the Article 8 procedural-due-diligence standard that operates ABOVE domestic apex decisions. Italian Cassazione 9691/2022 explicitly engages this standard; German BVerfG operates within Convention-conform interpretation of Grundgesetz. 8. Comparative outside the sequence

  • France — Cour de cassation 12-14.392 (2013) is the foundational French Cassation engagement preceding the EU sequence; subsequent CIIVISE Durand 2024 institutional engagement. Cross-link: jurisdiction:france.
