Judicial findings — alienating tactics as direct emotional/psychological abuse¶
Scotland — NF v AF [2025] CSOH 13¶
Lord Stuart, Court of Session Outer House, 5 February 2025. The strongest single Scottish judicial PA finding to date. Lord Stuart held that the defender's knowingly false allegations against the pursuer constituted direct emotional abuse of the children, the abuse arising from the alienating behaviour itself. England & Wales — Re Y [2026] EWFC 38¶
Sir Andrew McFarlane P. While primarily an evaluator-quality decision, Re Y operates within the broader Re-arc (Re A 2019 → Re S 2020 → Re H-N 2021 → Re C 2023 → Re Y 2026) in which sustained alienating conduct can establish emotional-abuse grounds under Children Act 1989 s.31. Northern Ireland — A Father v A Mother (No. 2) August 2022¶
Mr Justice O'Hara, High Court Family Division NI. Found one parent's 'core belief that he had been wronged' incompatible with facilitating contact. Clearest NI judicial engagement with alienating-style dynamic without explicit PA label — substantively a child-emotional-welfare finding.
India — Delhi High Court PA-as-extreme-cruelty line¶
- ABC v XYZ, 2023 SCC OnLine Del 6099 (Delhi HC, Suresh Kumar Kait J. & Neena Bansal Krishna J., October 2023): parental alienation by a non-neglectful parent constitutes an 'extreme act of mental cruelty' under HMA s.13(1)(ia).
- A v B, 2026 SCC OnLine Del 276 (Delhi HC, Anil Kshetarpal J. & Harish Vaidyanathan Shankar J., February 2026): custody transferred to father on findings of 'sustained parental alienation' by the mother — first reported Indian custody transfer on PA grounds in post-Vivek Singh line.

South Africa — T.L.D v B.G [2023] ZAGPJHC 801¶

Singapore — TEN v TEO [2020] SGHCF 20¶
Debbie Ong J, then Presiding Judge Family Justice Courts. Two-limb doctrine: court cannot force children to love a parent BUT expects custodial parent to cease alienating behaviour and support reunification. s.68 Women's Charter maintenance duty independent of access. Strasbourg — Article 8 procedural-due-diligence¶
Lombardo v Italy (2013) + Strumia v Italy (2016) + Improta v Italy (2017). Establishes positive obligation on member states' authorities to take 'adequate and effective measures' to enable parent-child contact restoration — engaging alienating conduct as triggering state Article 8 responsibilities. Statutory characterisations¶
Brazil — Lei 12.318/2010¶
Art. 2 single statutory definition globally: 'considera-se ato de alienação parental a interferência na formação psicológica da criança ou do adolescente promovida ou induzida por um dos genitores'. Brazil is the only world jurisdiction with substantive PA-statute codifying alienating conduct as actionable. Subsequent STJ apex line includes STJ REsp 1859228/SP + 2108750/GO (2024) on procedural application.
Spain — LOPIVI 2021 Disposición adicional 17ª¶
Counterpart statute — only world jurisdiction explicitly inadmitting 'SAP' by name. Frames any reliance on the construct in family-court reasoning as inadmissible. Brazil and Spain are the world's only two statutory PA jurisdictions, pointed in opposite directions (recognition vs inadmission).
Italy — Riforma Cartabia D.lgs. 149/2022¶
Restricts CTU evaluations based on PAS construct. Operationalises the Cassazione critique line (13217/2021 + 9691/2022 + 4595/2025) at statutory-procedural level.
Chile — Ley 21.675/2024 art. 5 (violencia vicaria)¶
Tipifies 'violencia vicaria' — act/omission of aggressor affecting children or other significant persons of the woman. Substantive substitution: violencia vicaria framework operates as the counterpart to PA-as-construct, recognising that alienating-style conduct may instead be characterisation of DV continuation. Functions as the inverse-direction structural alternative to Brazil's Lei 12.318/2010.
Italy / EU — Strasbourg Article 8¶
Positive-obligation doctrine: member states' authorities must take measures to enable parent-child contact restoration. Failure may engage Article 8 violation findings.

Adopts gender perspective citing UN Alsalem A/HRC/53/36 + MESECVI 13.4.2023 Belém do Pará. Critique-of-PAS-as-instrument approach while preserving COLPSIC distinction between SAP (rejected) and AP-as-relational-phenomenon (describable).
