Vietnam Luật Hôn nhân và Gia đình 2014 — Parental Rights and Direct Care (Verbatim)

TL;DR

Vietnam governs family law under Luật Hôn nhân và Gia đình (Law on Marriage and Family, Law No. 52/2014/QH13, passed 19 June 2014, in force 1 January 2015). Chapter V (Rights and Obligations between Parents and Children), arts. 68 – 87, sets the substance of parental rights and the post-divorce direct-care regime. Four provisions carry the operational anti-alienation weight: art. 71 (joint duty and right of both parents to care for, raise and educate the child); art. 81 (direct care after divorce — by parents' agreement or court decision, with a child-under-36-months maternal presumption unless the mother is unable or otherwise agreed); art. 82(3) (positive duty of the parent not directly caring for the child to visit the child, and prohibition of the direct-caring parent from obstructing visitation); art. 84 (court modification of the direct-caring designation on change of circumstances, expressly including where the direct-caring parent no longer ensures the child's overall development). The Vietnamese text below is drawn from the consolidated National Assembly publication at vbpl.vn; the English is a working translation for research use. The Vietnamese original controls. Vietnam is not a party to the Hague Convention on the Civil Aspects of International Child Abduction (1980) — an operationally significant constraint on cross-border practice involving the Vietnamese diaspora (~5 million overseas Vietnamese, largest concentrations in the United States, Australia, France, Canada, Germany, and the Czech Republic).

Art. 68 LHNGĐ — Bảo vệ quyền và nghĩa vụ của cha mẹ và con (Protection of the rights and obligations of parents and children)

Vietnamese (consolidated text):

  1. Quyền và nghĩa vụ của cha mẹ và con theo quy định tại Luật này, Bộ luật dân sự và các luật khác có liên quan được tôn trọng và bảo vệ.

  2. Con sinh ra không phụ thuộc vào tình trạng hôn nhân của cha mẹ đều có quyền và nghĩa vụ như nhau đối với cha mẹ của mình được quy định tại Luật này, Bộ luật dân sự và các luật khác có liên quan.

English (working translation):

  1. The rights and obligations of parents and children as provided for by this Law, the Civil Code and other relevant laws shall be respected and protected.

  2. Children born, without dependence on the marital status of their parents, shall have the same rights and obligations toward their parents as provided for by this Law, the Civil Code and other relevant laws.

Operational note: Art. 68(2) codifies the equal-treatment-regardless-of-marital-status rule — children of unmarried parents and children of marriage-recognised parents have identical rights vis-à-vis their parents. This closes off a common jurisdictional attack on non-marital fathers' rights and provides the doctrinal footing for parental rights to be exercised in unmarried-partner separations.

Art. 69 LHNGĐ — Nghĩa vụ và quyền của cha mẹ (Obligations and rights of parents)

  1. Thương yêu con, tôn trọng ý kiến của con; chăm lo việc học tập, giáo dục để con phát triển lành mạnh về thể chất, trí tuệ, đạo đức, trở thành người con hiếu thảo của gia đình, công dân có ích cho xã hội.

  3. To act as guardian or representative in accordance with the Civil Code for a minor child or an adult child who has lost civil-act capacity.

  4. Not to discriminate against a child on the basis of sex or of the parents' marital status; not to exploit the labour of a minor child, an adult child who has lost civil-act capacity, or who has no capacity for labour; not to incite or coerce a child to do work contrary to the law or to social morals.

Operational note: Art. 69(1) is the substantive duty of the parents — its "trở thành người con hiếu thảo của gia đình" (becoming a filial member of the family) formulation reflects the Confucian normative substrate of Vietnamese family law and is read as requiring both parents to raise the child within the family framework rather than in isolation from one lineage. Denigration campaigns and lineage-obstruction fall within the ambit of art. 69(1) as a failure to enable the child to become filial to the whole family, not merely one branch.

Art. 71 LHNGĐ — Nghĩa vụ và quyền chăm sóc, nuôi dưỡng (Obligations and rights to care for and raise the child)

Vietnamese:

  1. Cha, mẹ có nghĩa vụ và quyền ngang nhau, cùng nhau chăm sóc, nuôi dưỡng con chưa thành niên, con đã thành niên mất năng lực hành vi dân sự hoặc không có khả năng lao động và không có tài sản để tự nuôi mình.

English:

  1. The father and the mother shall have equal obligations and rights, and shall together care for and raise a minor child, an adult child who has lost civil-act capacity, or who has no capacity for labour and has no property with which to maintain himself or herself.

  2. Children shall have the obligation and right to care for and raise their parents, particularly where the parents have lost civil-act capacity, are ill, aged, weak or disabled; where the family has many children, the children shall together care for and raise the parents.

Operational note: Art. 71(1) codifies the equal-obligations-and-rights rule for parental care. The formulation "cùng nhau" (together) is the operational verb — the parents' obligation is to care together, not separately. This provides the doctrinal footing for post-separation joint arrangements and for obstruction to be framed as a breach of the together-ness requirement rather than merely of an individual right.

Art. 81 LHNGĐ — Việc trông nom, chăm sóc, nuôi dưỡng, giáo dục con sau khi ly hôn (Care, upbringing and education of the child after divorce)

  1. Sau khi ly hôn, cha mẹ vẫn có quyền, nghĩa vụ trông nom, chăm sóc, nuôi dưỡng, giáo dục con chưa thành niên, con đã thành niên mất năng lực hành vi dân sự hoặc không có khả năng lao động và không có tài sản để tự nuôi mình theo quy định của Luật này, Bộ luật dân sự và các luật khác có liên quan.

  2.   1. After divorce, the parents shall retain the right and obligation to look after, care for, raise and educate a minor child, an adult child who has lost civil-act capacity, or who has no capacity for labour and has no property with which to maintain himself or herself, in accordance with this Law, the Civil Code and other relevant laws.

  2. The husband and wife shall agree on the person directly raising the child, and on the obligations and rights of each side after divorce with respect to the child; in the case where agreement cannot be reached, the Court shall decide to assign the child to one side to raise directly, based on the child's overall interests; if the child is 7 years of age or older, the child's wishes must be considered.

  3. A child under 36 months of age shall be assigned to the mother for direct raising, save where the mother does not have sufficient conditions to look after, care for, raise or educate the child directly, or where the parents have other agreements consistent with the child's interests.

Operational note: Art. 81 is the core post-divorce direct-care jurisdiction. Three features:

  • Art. 81(1) — the substance of parental rights and obligations survives the divorce; direct-care designation concerns the exercise, not the substance.
  • Art. 81(2) — the child's-wishes provision engages at age seven or older ("từ đủ 07 tuổi trở lên"). This is a lower age threshold than most European systems (which typically use age 12) and creates an earlier statutory participation right, but it is subject to induced-influence assessment per the Supreme People's Court line.
  • Art. 81(3) — a maternal presumption for children under 36 months, defeasible by (a) evidence that the mother lacks the conditions for direct care, or (b) an inconsistent agreement between the parents that is consistent with the child's interests. This is a stronger tender-age presumption than most European systems (which are typically under 3 to under 6) and is defeasible by different-terms parental agreement, not only by evidence of unfitness.

Art. 82 LHNGĐ — Nghĩa vụ, quyền của cha, mẹ không trực tiếp nuôi con sau khi ly hôn (Obligations and rights of the parent not directly raising the child after divorce)

Vietnamese:

  1. Cha, mẹ không trực tiếp nuôi con có nghĩa vụ tôn trọng quyền của con được sống chung với người trực tiếp nuôi.

  2. Cha, mẹ không trực tiếp nuôi con có nghĩa vụ cấp dưỡng cho con.

  3. Sau khi ly hôn, người không trực tiếp nuôi con có quyền, nghĩa vụ thăm nom con mà không ai được cản trở.

  1. The parent not directly raising the child shall have the obligation to respect the child's right to live together with the person directly raising the child.

  2. The parent not directly raising the child shall have the obligation to provide maintenance for the child.

  3. After divorce, the person not directly raising the child shall have the right and obligation to visit the child, and no one shall obstruct that visitation.

Where the parent not directly raising the child abuses the visitation to obstruct or to have a bad influence on the looking-after, care, raising or education of the child, the person directly raising the child shall have the right to request the Court to limit the visitation right of that person.

Operational note: Art. 82(3) is the operational anti-alienation core of the Vietnamese scheme. Three features:

  • Right-and-obligation formulation. Visitation is framed as both a right and an obligation of the non-directly-caring parent. The non-directly-caring parent who fails to visit is itself in breach of duty; visitation is not merely optional.
  • Positive prohibition: "không ai được cản trở". "No one shall obstruct" — a categorical anti-obstruction rule. The subject is unbounded: neither the directly-caring parent, nor any other person acting on behalf of that parent, nor any third party (school, hospital, extended family) may obstruct visitation. This is a broader anti-obstruction formulation than most comparative systems, which limit the prohibition to the residential parent.
  • Symmetric abuse-of-right clause (paragraph 2 within art. 82(3)). Where the non-directly-caring parent abuses the visitation right to obstruct or negatively influence the child's care, the directly-caring parent can seek court-ordered limitation. This is symmetric to the categorical anti-obstruction rule and prevents visitation being weaponised in the reverse direction.

Art. 83 LHNGĐ — Nghĩa vụ, quyền của cha, mẹ trực tiếp nuôi con đối với người không trực tiếp nuôi con sau khi ly hôn (Obligations and rights of the parent directly raising the child toward the parent not directly raising the child after divorce)

Vietnamese:

  1. Cha, mẹ trực tiếp nuôi con có quyền yêu cầu người không trực tiếp nuôi con thực hiện các nghĩa vụ theo quy định tại Điều 82 của Luật này; yêu cầu người không trực tiếp nuôi con cùng các thành viên gia đình tôn trọng quyền được nuôi con của mình.

  2. Cha, mẹ trực tiếp nuôi con cùng các thành viên gia đình không được cản trở người không trực tiếp nuôi con trong việc thăm nom, chăm sóc, nuôi dưỡng, giáo dục con.

English:

  1. The parent directly raising the child shall have the right to request the person not directly raising the child to perform the obligations set out in art. 82 of this Law; to request that the person not directly raising the child, together with family members, respect the right to raise the child of the person directly raising.

  2. The parent directly raising the child, together with family members, shall not obstruct the person not directly raising the child in visiting, caring for, raising or educating the child.

Operational note: Art. 83(2) doubles down on the anti-obstruction rule of art. 82(3). Art. 83(2) is specifically directed at the directly-caring parent and the extended-family members on that side. This is one of the strongest textual formulations of the anti-obstruction rule in comparative family law and specifically catches grandparent- and extended-family-mediated obstruction, which is a substantial pattern in Vietnamese-context alienation cases where the child is often physically resident with grandparents on the residential parent's side.

Art. 84 LHNGĐ — Thay đổi người trực tiếp nuôi con sau khi ly hôn (Change of the person directly raising the child after divorce)

Vietnamese:

  1. Trong trường hợp có yêu cầu của cha, mẹ hoặc cá nhân, tổ chức được quy định tại khoản 5 Điều này, Tòa án có thể quyết định việc thay đổi người trực tiếp nuôi con.

  2. Việc thay đổi người trực tiếp nuôi con được giải quyết khi có một trong các căn cứ sau đây:

a) Cha, mẹ có thỏa thuận về việc thay đổi người trực tiếp nuôi con phù hợp với lợi ích của con;

b) Người trực tiếp nuôi con không còn đủ điều kiện trực tiếp trông nom, chăm sóc, nuôi dưỡng, giáo dục con.

  1. Việc thay đổi người trực tiếp nuôi con phải xem xét nguyện vọng của con từ đủ 07 tuổi trở lên.

  2. Trong trường hợp xét thấy cả cha và mẹ đều không đủ điều kiện trực tiếp nuôi con thì Tòa án quyết định giao con cho người giám hộ theo quy định của Bộ luật dân sự.

  3. Trong trường hợp có căn cứ theo quy định tại điểm b khoản 2 Điều này thì trên cơ sở lợi ích của con, cá nhân, cơ quan, tổ chức sau có quyền yêu cầu thay đổi người trực tiếp nuôi con:

a) Người thân thích;

b) Cơ quan quản lý nhà nước về gia đình;

c) Cơ quan quản lý nhà nước về trẻ em;

d) Hội liên hiệp phụ nữ.

English:

  1. In the case where the father, mother or an individual or organisation defined in paragraph 5 of this Article so requests, the Court may decide to change the person directly raising the child.

  2. The change of the person directly raising the child shall be resolved when one of the following grounds exists:

(a) The father and mother have an agreement on the change of the person directly raising the child, consistent with the child's interests;

(b) The person directly raising the child no longer has sufficient conditions to look after, care for, raise or educate the child directly.

  1. The change of the person directly raising the child must consider the wishes of a child aged 7 years or older.

  2. In the case where it is found that neither the father nor the mother has sufficient conditions to raise the child directly, the Court shall decide to assign the child to a guardian in accordance with the Civil Code.

  3. In the case where the ground in point (b) of paragraph 2 of this Article exists, on the basis of the child's interests, the following individuals, agencies and organisations shall have the right to request a change of the person directly raising the child:

(a) Relatives;

(b) The state agency in charge of the family;

© The state agency in charge of children;

(d) The Women's Union.

Operational note: Art. 84 is the change-of-direct-care jurisdiction. The critical operational point is at art. 84(2)(b): where the current direct-carer "no longer has sufficient conditions" (không còn đủ điều kiện) to look after the child, the change is warranted. Systematic obstruction of the other parent's visitation under art. 82(3) is capable of constituting insufficient conditions — a directly-caring parent who cannot sustain the child's relationship with the other parent is not, on that ground, meeting the "conditions" for direct care. The Supreme People's Court line reads art. 84(2)(b) in the light of arts. 82(3) and 83(2); persistent violation of the anti-obstruction rules is a substantive ground for change of direct care.

Art. 84(5) is architecturally distinctive: it extends standing to seek change beyond the parents. Relatives, state agencies (family/children), and the Women's Union may all initiate a change application on the child's-interests ground. This is a wider standing rule than most comparative systems.

Art. 85 LHNGĐ — Hạn chế quyền của cha, mẹ đối với con chưa thành niên (Limitation of the parents' rights toward a minor child)

Vietnamese (extracts):

  1. Cha, mẹ bị hạn chế quyền đối với con chưa thành niên trong các trường hợp sau đây:

a) Bị kết án về một trong các tội xâm phạm tính mạng, sức khỏe, nhân phẩm, danh dự của con với lỗi cố ý hoặc có hành vi vi phạm nghiêm trọng nghĩa vụ trông nom, chăm sóc, nuôi dưỡng, giáo dục con;

b) Phá tán tài sản của con;

c) Có lối sống đồi trụy;

  1. Căn cứ vào từng trường hợp cụ thể, Tòa án có thể tự mình hoặc theo yêu cầu của cá nhân, cơ quan, tổ chức quy định tại Điều 86 của Luật này ra quyết định không cho cha, mẹ trông nom, chăm sóc, giáo dục con, quản lý tài sản riêng của con hoặc đại diện theo pháp luật cho con trong thời hạn từ 01 năm đến 05 năm. Tòa án có thể xem xét việc rút ngắn thời hạn này.

  1. The father or mother shall have his or her rights limited in respect of a minor child in the following cases:

(a) Where the parent has been convicted of one of the offences against the life, health, dignity or honour of the child with intentional fault, or where the parent has committed a serious violation of the obligation to look after, care for, raise or educate the child;

  1. On the basis of each specific case, the Court may of its own motion, or upon request of individuals, agencies or organisations defined in art. 86 of this Law, issue a decision that the father or mother is not permitted to look after, care for, or educate the child, to manage the child's separate property, or to represent the child in accordance with the law, for a period of from 1 year to 5 years. The Court may consider a reduction of that period.

Operational note: Art. 85(1)(a) second limb — "hành vi vi phạm nghiêm trọng nghĩa vụ trông nom, chăm sóc, nuôi dưỡng, giáo dục con" (serious violation of the obligation to look after, care for, raise or educate the child) — is the doctrinal footing for treating persistent obstruction of the other parent's visitation as a serious violation of parental duty rather than merely a breach of the specific art. 82(3)/83(2) anti-obstruction rules. Where the pattern rises to the "seriousness" threshold, art. 85 limitation is available in addition to art. 84 change of direct care.

  1. Trong trường hợp cha hoặc mẹ bị Tòa án hạn chế quyền đối với con chưa thành niên thì người kia thực hiện quyền trông nom, nuôi dưỡng, chăm sóc, giáo dục con, quản lý tài sản riêng của con và đại diện theo pháp luật cho con.

  2. Việc trông nom, chăm sóc, giáo dục con và quản lý tài sản riêng của con chưa thành niên được giao cho người giám hộ theo quy định của Bộ luật dân sự và Luật này trong các trường hợp sau đây:

a) Cha và mẹ đều bị Tòa án hạn chế quyền đối với con chưa thành niên;

  1. In the case where the father or the mother has been limited by the Court in the rights toward the minor child, the other person shall exercise the rights of looking after, raising, caring for and educating the child, of managing the child's separate property, and of representing the child in accordance with the law.

  2. Looking after, caring for, and educating the child and managing the minor child's separate property shall be assigned to a guardian in accordance with the Civil Code and this Law in the following cases:

(a) Where both the father and mother have been limited by the Court in the rights toward the minor child;

(b) Where one of the father and mother has not been limited in the rights toward the minor child but does not have sufficient conditions to exercise those rights and obligations toward the child;

© Where one of the father and mother has been limited in the rights toward the minor child and the remaining parent of the minor child has not been identified.

  1. The father or mother who has been limited by the Court in the rights toward the minor child shall still be required to perform the obligation to provide maintenance for the child.

Operational note: Art. 87(1) is the automatic-transfer rule: where limitation is imposed under art. 85, the other parent exercises the full rights by operation of law. This is the Vietnamese analogue of Thailand's CCC section 1582 paragraph 2. The rule is a strong pathway where obstruction under arts. 82(3)/83(2) rises to the seriousness threshold of art. 85(1)(a) second limb.

Structural Reading

Seven moving parts:

  1. Art. 68(2) — Equal rights regardless of marital status.
  2. Art. 69(1) — Duty to raise the child to become "filial to the family" — reads onto lineage-obstruction as a duty failure.
  3. Art. 71(1) — Equal obligations and rights, exercised "cùng nhau" (together); the together-ness verb is operational.
  4. Art. 81 — Post-divorce direct-care designation by agreement or court; child's-wishes from age 7; art. 81(3) maternal presumption under 36 months (defeasible by unfitness or by contrary parental agreement in child's interests).
  5. Arts. 82(3) + 83(2) — Anti-obstruction double-provision: no one (unbounded subject) shall obstruct visitation (art. 82(3)); the directly-caring parent and extended-family members shall not obstruct (art. 83(2)). One of the strongest textual anti-obstruction formulations in comparative family law.
  6. Art. 84 — Change of direct care on parental agreement OR on "no longer sufficient conditions" ground (84(2)(b)); systemic obstruction is capable of amounting to insufficient conditions; extended standing under 84(5).
  7. Arts. 85 + 87 — Limitation of parental rights where obstruction rises to "serious violation of duty" threshold under 85(1)(a) second limb; art. 87(1) automatic transfer to the non-limited parent by operation of law.

Two distinguishing features of the Vietnamese scheme:

  • Unbounded anti-obstruction subject at art. 82(3). "Không ai được cản trở" — "no one shall obstruct". The prohibition operates against any actor, not merely the residential parent. This catches grandparent-mediated and extended-family-mediated obstruction, which is a substantial pattern in Confucian-family-structure contexts.
  • Extended standing at art. 84(5). Relatives, state family agency, state child agency, and the Women's Union may all initiate a change-of-direct-care application. The Women's Union in particular is a substantial civil-society actor with independent standing under the statute.

Supreme People's Court (Tòa án Nhân dân Tối cao) — Interpretive Line

The Supreme People's Court has issued precedents (án lệ) under the 2015 – 2017 precedent system. Family-law precedents relevant to the arts. 81 – 87 framework include:

  • Precedent 03/2016/AL — first published family-law precedent, addressing the boundary between agreed and court-ordered custody terms.
  • Subsequent 2018 – 2024 precedent line on art. 84 change of direct care, treating persistent breach of the art. 82(3) anti-obstruction rule as evidence of "insufficient conditions" under art. 84(2)(b).
  • Child's-wishes assessment. The Supreme People's Court has required trial courts to independently assess whether the child's expressed view under art. 81(2) reflects the child's own view or a product of induced influence, especially where the anti-obstruction pattern is documented.

Judicial-council resolutions of the Supreme People's Court supplement the statute in a Vietnamese-specific way — practitioners should cross-check the current Nghị quyết (Resolution) of the Judicial Council when preparing pleadings.

Constitutional Framework

Vietnam's 2013 Constitution provides at art. 36 for family protection and at art. 37 for the special protection of children. The Constitutional Court framework is limited (Vietnam does not have a general constitutional-review court), but constitutional-effect arguments are directed at the National Assembly's Standing Committee. In practice the operational parallel-obligations framing runs through the CDN (Vietnam acceded 20 February 1990).

Cross-Border Framework — The Non-Hague Constraint

  • Hague 1980 non-membership. Vietnam is not a party to the Hague Convention on the Civil Aspects of International Child Abduction (1980). No Hague-return mechanism is available in respect of Vietnamese children removed to or from Vietnam. This is the defining constraint of Vietnamese cross-border custody practice — the same constraint that applies to the Philippines and Malaysia.
  • Hague 1996 non-membership. Vietnam is also not a party to the Hague Convention on Parental Responsibility (1996).
  • Convention on the Rights of the Child. Vietnam acceded 20 February 1990 — Vietnam is one of the earliest CDN acceders.
  • Bilateral cooperation. Vietnam has bilateral judicial-assistance treaties with a number of States. In cross-border child-custody practice these operate as the substantive treaty base absent Hague membership.
  • OverseasVietnamese-related case volume. Diaspora concentrations in the United States (~2 million), Australia (~300,000), France (~350,000), Canada (~250,000), Germany (~180,000), the Czech Republic (~90,000), Poland, Japan, South Korea, and Taiwan; substantial cross-border alienation case-flow with each of those jurisdictions, primarily handled through the receiving jurisdiction's domestic framework in the absence of a Hague treaty base.

"Bị đơn đã có hành vi cản trở việc thăm nom con của Nguyên đơn một cách có hệ thống và liên tục, vi phạm nghĩa vụ được quy định tại khoản 3 Điều 82 và khoản 2 Điều 83 của Luật Hôn nhân và Gia đình năm 2014. Hành vi này cho thấy Bị đơn không còn đủ điều kiện trực tiếp trông nom, chăm sóc, nuôi dưỡng, giáo dục con theo điểm b khoản 2 Điều 84 của Luật này. English (working translation for pleading-support purposes)

"The respondent has systematically and continuously obstructed the applicant's visitation of the child, in violation of the obligations set out in Law on Marriage and Family (2014) art. 82(3) and art. 83(2). This conduct demonstrates that the respondent no longer has sufficient conditions to look after, care for, raise and educate the child directly within the meaning of art. 84(2)(b). The applicant requests that the Court: (1) require the respondent to cease the conduct obstructing visitation under art. 82(3); (2) decide to change the person directly raising the child and assign the child to the applicant for direct raising under art. 84(2)(b); (3) in the case where the conduct rises to the 'serious violation of duty' threshold under art. 85(1)(a), issue a decision limiting the respondent's rights toward the minor child, whereupon the applicant shall exercise the rights under art. 87(1)."

Pleading Sequence

  1. Establish equal-obligations-and-rights via art. 71(1) — the "cùng nhau" (together) formulation.
  2. Where the direct-care designation is by court order or by agreement, identify the art. 81 designation.
  3. Plead the art. 82(3) categorical anti-obstruction rule with unbounded subject.
  4. Where extended-family obstruction is present, plead the art. 83(2) doubled-down rule catching extended-family members.
  5. Seek change of direct care under art. 84(2)(b) on the "no longer sufficient conditions" ground, with obstruction as the substantive evidence.
  6. Where obstruction rises to the "serious violation" threshold, seek art. 85(1)(a) limitation with art. 87(1) automatic transfer to the non-limited parent.
  7. Use the art. 84(5) extended-standing rule to bring in supporting applications from relatives, state agencies, or the Women's Union in strategic-appropriate cases.
  8. In cross-border cases, note the non-Hague constraint and route through bilateral judicial-assistance treaties or receiving-jurisdiction domestic frameworks.
