Thailand Civil and Commercial Code Book V (Family) — Amnat Pokkrong and Right of Contact (Verbatim)¶
TL;DR¶
Thailand governs family law under Book V (Family) of the Civil and Commercial Code (ประมวลกฎหมายแพ่งและพาณิชย์ บรรพ 5), enacted 1 October 1935, with the family-authority provisions in the current shape following the 1976 reform and subsequent amendments (notably 1990 which added the right of contact of the non-custody parent at section 1584/1; 2007 and 2012 amendments on gender-equality alignment). Book V, Chapter 2 (Divorce), sections 1520 – 1522 set the post-divorce custody regime and the right of contact. Chapter 6 (Parental Power), sections 1566 – 1584 set the substance of amnat pokkrong (parental power). Four provisions carry the operational anti-alienation weight: section 1520 (post-divorce custody by parental agreement or court decision; parental power designation follows the custody designation); section 1566 (joint exercise by father and mother during the marriage); section 1567 (composite content of parental power — care, discipline, residence, education, employment consent); section 1584/1 (right of the parent not designated for custody to have contact with the child, in accordance with agreed conditions or a court order). The Thai text below is drawn from the consolidated Krisdika (Office of the Council of State) publication; the English is a working translation for research use. The Thai original controls. Thailand acceded to the Hague Convention on the Civil Aspects of International Child Abduction 1980 in 2002, with entry into force 1 November 2002 — the treaty base is therefore live for cross-border cases.

Section 1520 CCC — Custody and Parental Power after Divorce¶
Thai (consolidated text):
ในกรณีหย่าโดยความยินยอมของทั้งสองฝ่าย ให้สามีภริยาทำความตกลงเป็นหนังสือว่าฝ่ายใดจะเป็นผู้ใช้อำนาจปกครองบุตรคนใด ถ้ามิได้ตกลงกันหรือตกลงกันไม่ได้ ให้ศาลเป็นผู้ชี้ขาด

English (working translation):
In the case of divorce by mutual consent of both parties, the husband and wife shall reach a written agreement as to which party is to exercise parental power over any particular child. If no agreement is reached, or if agreement cannot be reached, the court shall determine the matter.
In the case of divorce by court judgment, the court trying the divorce action shall also determine which party is to exercise parental power over any particular child. In its determination, if the court considers that there is a ground for the withdrawal of parental power of that spouse under section 1582, the court may withdraw parental power from the spouse and order that a third person be the guardian. In its determination, the court shall give paramount consideration to the well-being and interests of the child.
Operational note: Section 1520 sets the two-track custody-and-parental-power designation. Track 1 (consensual divorce) requires a written agreement; oral agreements are ineffective. Track 2 (contested divorce) makes the divorce court the parental-power designator by the same judgment — Thailand does not bifurcate divorce and custody. The paragraph-2 final sentence codifies the welfare-of-the-child paramountcy — "ความผาสุกและประโยชน์ของบุตร" (well-being and interests of the child) — which is read by the Thai Supreme Court as the substantive standard controlling all designations under section 1520.
Section 1521 CCC — Modification of Custody and Parental Power¶

ถ้าพฤติการณ์อันเป็นเหตุให้ศาลสั่งเปลี่ยนแปลงตามมาตรา 1520 ได้เปลี่ยนแปลงไป ศาลจะสั่งเปลี่ยนแปลงคำสั่งเดิมเสียใหม่ก็ได้ ทั้งนี้ เมื่อคำนึงถึงความผาสุกและประโยชน์ของบุตรเป็นสำคัญ
English:
If the circumstances which grounded the order of the court under section 1520 have changed, the court may modify the original order. In doing so, the court shall give paramount consideration to the well-being and interests of the child.
Operational note: Section 1521 is the change-of-circumstances modification jurisdiction. Documented obstruction of the non-custody parent's contact right under section 1584/1 is capable of amounting to a change of circumstances warranting modification of the custody designation. The "paramount consideration to welfare and interests of the child" standard operates on modification identically to the original designation.
Section 1522 CCC — Terms of Custody in a Consensual Divorce Agreement¶

ถ้าในสัญญาหย่าโดยความยินยอมมิได้กำหนดเรื่องอำนาจปกครองบุตรและค่าอุปการะเลี้ยงดูบุตรไว้ ให้นำมาตรา 1516 มาใช้บังคับ
English:
If the agreement for a divorce by mutual consent does not provide for parental power over the child or for maintenance of the child, section 1516 shall apply.
Operational note: Section 1522 addresses a common defect in negotiated divorce agreements — silence on custody and maintenance. Where the written divorce agreement is silent, section 1516 (which governs judicial supplementation) applies. This provides a residual court jurisdiction to fill in the custody and maintenance terms without reopening the divorce.
Section 1566 CCC — Nature and Term of Parental Power¶

บุตรซึ่งยังไม่บรรลุนิติภาวะต้องอยู่ใต้อำนาจปกครองของบิดามารดา
อำนาจปกครองอยู่กับบิดาหรือมารดาในกรณีดังต่อไปนี้
(1) มารดาหรือบิดาตาย
(2) ไม่แน่นอนว่ามารดาหรือบิดามีชีวิตอยู่หรือตาย
(3) มารดาหรือบิดาถูกศาลสั่งให้เป็นคนไร้ความสามารถหรือเสมือนไร้ความสามารถ
(4) มารดาหรือบิดาต้องเข้ารักษาตัวในโรงพยาบาลเพราะจิตฟั่นเฟือน
(5) ศาลสั่งให้อำนาจปกครองอยู่กับบิดาหรือมารดา

English:
A child who has not attained majority shall be under the parental power of the father and the mother.
Parental power shall be with the father or the mother in the following cases:
(1) the mother or the father is dead;
(2) it is uncertain whether the mother or the father is alive or dead;
(3) the mother or the father has been adjudged by the court to be an incompetent or a quasi-incompetent person;
(4) the mother or the father has to be admitted to a hospital for care due to unsoundness of mind;
(5) the court has ordered that parental power be with the father or the mother;
(6) the father and the mother have agreed as provided by law that they may agree.
Operational note: Section 1566 paragraph 1 codifies the joint-parental-power default during marriage. Paragraphs (1) – (6) are the exhaustive list of grounds on which parental power falls to one parent alone: death, uncertainty of survival, incompetency, hospital admission for unsoundness of mind, court order (typically under section 1520), and mutual agreement authorised by law (typically under section 1520 track 1). Notably, the mere fact of separation is not a listed ground; separation without divorce leaves parental power joint. Paragraph (5) is the anchor for court-ordered sole exercise; paragraph (6) is the anchor for agreement-based sole exercise.
Section 1567 CCC — Content of Parental Power¶
Thai:
ผู้ใช้อำนาจปกครองมีสิทธิ
(1) กำหนดที่อยู่ของบุตร
(2) ทำโทษบุตรตามสมควรเพื่อว่ากล่าวสั่งสอน
(3) ให้บุตรทำการงานตามสมควรแก่ความสามารถและฐานานุรูป
(4) เรียกบุตรคืนจากบุคคลอื่นซึ่งกักบุตรไว้โดยมิชอบด้วยกฎหมาย
English:
The person who exercises parental power shall have the right:
(1) to determine the residence of the child;
(2) to punish the child moderately for the purpose of admonition;
(3) to require the child to work as is suitable to the child's capabilities and station;
(4) to demand the return of the child from any person who unlawfully detains the child.
Operational note: Section 1567 is the composite content of parental power. Paragraph (1) — determination of residence — is the operationally critical element and is the anchor for the section 1584/1 contact right on the other side (the non-custody parent's right of contact exists within the residential parent's power to determine residence, not against it). Paragraph (4) — demand for return from unlawful detainers — is the anchor for domestic and cross-border return applications. In cross-border cases involving Hague 1980, section 1567(4) is the Thai substantive-law anchor for the Hague "rights of custody" concept.
Section 1582 CCC — Withdrawal of Parental Power¶

ถ้าผู้ใช้อำนาจปกครองใช้อำนาจปกครองในทางที่ผิด หรือประพฤติชั่วอย่างร้ายแรง หรือเป็นคนไร้ความสามารถ หรือเสมือนไร้ความสามารถ หรือมีเหตุอื่นที่ทำให้ไม่สมควรใช้อำนาจปกครองต่อไป ศาลจะสั่งเพิกถอนอำนาจปกครองบางส่วนหรือทั้งหมดก็ได้
ในกรณีที่ผู้ใช้อำนาจปกครองถูกเพิกถอนอำนาจปกครองแล้ว ถ้าเป็นการเพิกถอนอำนาจปกครองของบิดา ให้อำนาจปกครองอยู่กับมารดา ถ้าเป็นการเพิกถอนอำนาจปกครองของมารดา ให้อำนาจปกครองอยู่กับบิดา
English:
If the person who exercises parental power exercises parental power wrongfully, or is guilty of gross misconduct, or is incompetent or quasi-incompetent, or there is any other cause rendering it inappropriate that the person continue to exercise parental power, the court may order the withdrawal of the parental power in part or in whole.
Where the person who exercised parental power has had parental power withdrawn, if the withdrawal was of the father's parental power, parental power shall be with the mother; if the withdrawal was of the mother's parental power, parental power shall be with the father.
Operational note: Section 1582 is the withdrawal jurisdiction. The "wrongful exercise" (ใช้อำนาจปกครองในทางที่ผิด) formulation is broad and reaches exercise of parental power that harms the child's development — including through obstruction of the other parent's section 1584/1 contact right where the pattern produces developmental harm. The paragraph 2 automatic-transfer rule is critical: withdrawal from one parent transfers parental power to the other parent by operation of law; the court does not need to make a separate designation. This is a strong statutory route where obstruction is documented and the non-custody parent seeks the exercise transfer.
Section 1583 CCC — Restoration of Parental Power¶

เหตุที่ทำให้อำนาจปกครองถูกเพิกถอนตามมาตรา 1582 ได้เปลี่ยนแปลงไปแล้ว ศาลจะสั่งให้อำนาจปกครองที่ถูกเพิกถอนกลับคืนก็ได้
English:
If the ground for the withdrawal of parental power under section 1582 has changed, the court may order that the withdrawn parental power be restored.
Operational note: Section 1583 is the mirror-image restoration jurisdiction. A withdrawal under section 1582 is not permanent; a change of circumstances (typically evidence of rehabilitation or of altered pattern of conduct) supports restoration. The "may" (ก็ได้) formulation preserves the court's discretion — restoration is available but not automatic.
Section 1584/1 CCC — Right of Contact of the Parent Who Does Not Have Parental Power (added 1990)¶
Thai:
บิดาหรือมารดาย่อมมีสิทธิที่จะพบและติดต่อกับบุตรของตนได้ตามควรแก่พฤติการณ์ ไม่ว่าบุคคลใดจะเป็นผู้ใช้อำนาจปกครองบุตรก็ตาม
English:
The father or mother shall have the right to see and to have contact with their child as is appropriate to the circumstances, notwithstanding that any other person is exercising parental power over the child.
Operational note: Section 1584/1 is the operational anti-alienation core of the Thai scheme. Four features:
- The right belongs to the parent, not to the child. The Thai drafting choice is unusual in comparative terms — most modern systems draft the contact right primarily as a right of the child (Estonia § 143, Latvia art. 181, Lithuania § 3.170(2), Ukraine art. 153, Serbia art. 61(2), Peru CNA art. 88). Thailand codifies it as a right of the parent. This is a formal-doctrinal difference; in operational terms the right is enforceable in the parent's own name without needing to reason through the child's separate standing.
- The right operates notwithstanding the parental-power exercise of any other person. The phrase "ไม่ว่าบุคคลใดจะเป็นผู้ใช้อำนาจปกครองบุตรก็ตาม" (notwithstanding that any other person is exercising parental power over the child) is a strong non-derogation formula. Even where parental power has been withdrawn under section 1582 or reassigned under section 1520, the biological parent-child contact right persists as a distinct entitlement.
- The scope is "as is appropriate to the circumstances" (ตามควรแก่พฤติการณ์). This is a substantive standard — the court's task is to fix contact that is appropriate, not to fix a minimalist regime.
- The right is enforceable against the parental-power holder. In pleading practice section 1584/1 is invoked directly against the residential parent's obstruction; it does not require reasoning through section 1567 or through a general child-welfare argument.
Structural Reading¶
Six moving parts:
- Section 1520(paragraph 2 final sentence) — Welfare-of-the-child paramountcy in the custody-and-parental-power designation.
- Section 1521 — Change-of-circumstances modification jurisdiction; documented obstruction under section 1584/1 supports modification.
- Section 1566 — Joint parental power during marriage; exhaustive list of grounds for sole exercise; mere separation is not a listed ground.
- Section 1567 — Composite content of parental power (residence, discipline, work, return from unlawful detention); the "unlawful detention" clause at (4) is the Hague-substantive anchor.
- Section 1582 — Withdrawal for wrongful exercise; automatic transfer to the other parent on withdrawal.
- Section 1584/1 — Right of the non-custody parent to contact, framed as a parental right, operating notwithstanding any other person's exercise of parental power, on the "appropriate to circumstances" standard.
Two distinguishing features of the Thai scheme:
- Parental-right framing of section 1584/1. Contact is framed as a right of the parent, not of the child. This makes it directly enforceable by the parent without the two-step reasoning that many child-right regimes require.
- Automatic transfer on section 1582 withdrawal. Withdrawal from one parent produces an automatic transfer of parental power to the other by operation of law, without a separate designation. This is a strong pathway where the residential parent's obstruction is documented as "wrongful exercise" of parental power.
Supreme Court (ศาลฎีกา — San Deeka) — Interpretive Line¶
The Thai Supreme Court (Dika Court) has a substantial line on parental power and contact rights. Case-identifiers are typically in the format คำพิพากษาศาลฎีกาที่ NNNN/YYYY (Dika judgment number/Buddhist Era year). Doctrinal points:
- Welfare-of-the-child paramountcy as substantive standard. The Dika Court reads "ความผาสุกและประโยชน์ของบุตร" as controlling all designations and modifications under sections 1520 – 1521; formal parent-preference arguments are subordinate to substantive welfare analysis.
- Section 1567(1) residence-determination limited by section 1584/1. The residential parent's power to determine residence does not extend to arrangements that defeat the other parent's section 1584/1 contact right; the two powers must be exercised harmoniously.
- Section 1582 "wrongful exercise" reaches obstructive conduct. The Dika Court has read "ใช้อำนาจปกครองในทางที่ผิด" as capable of reaching a residential parent's systematic obstruction of the non-custody parent's contact under section 1584/1, particularly where the pattern produces documented developmental harm.
- Section 1584/1 "appropriate to circumstances" as substantive. The scope of contact is fixed by reference to the child's development and the pattern of family life; formulaic minimum orders are inconsistent with the "appropriate" standard.
- Child's expressed refusal and induced influence. The Dika Court requires the trial court to independently assess whether an expressed refusal reflects the child's own view, especially in the presence of documented obstruction under section 1584/1.
Constitutional Court Framework¶
Thailand's Constitutional Court has held that the State's obligations under the constitutional protection of the family and of the child run in parallel with the CDN (to which Thailand acceded in 1992). Formally correct orders that are not enforced do not discharge the State's obligation; effectiveness of enforcement is part of the constitutional guarantee.
Cross-Border Framework¶
- Hague Convention on the Civil Aspects of International Child Abduction 1980. Thailand acceded in 2002; entry into force 1 November 2002. Central authority is the Ministry of Social Development and Human Security (MSDHS). Thailand is one of the Southeast Asian States with a live Hague treaty base (the others include the Philippines' absence discussed at /case-law/philippines/family-code-arts-209-233-parental-authority-verbatim/, Singapore's late accession, and Malaysia's non-membership).
- Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in Respect of Parental Responsibility and Measures for the Protection of Children 1996. Thailand is not a party.
- Convention on the Rights of the Child. Thailand acceded 27 March 1992.
- Bilateral cooperation. Thai diaspora concentrations in the United States (~300,000), Australia, the United Kingdom, Germany, Japan, South Korea, Sweden, Denmark and the Middle East; substantial mixed-nationality-family case-flow with each of those jurisdictions. Move-away and unilateral-relocation patterns are common in the Nordic-Thai and Australian-Thai bilateral streams.

English (working translation for pleading-support purposes)¶
"The respondent has systematically and continuously obstructed the applicant from seeing and having contact with the child, in violation of the applicant's right under Civil and Commercial Code section 1584/1. Such conduct amounts to a wrongful exercise of parental power under CCC section 1582 and constitutes a ground on which the court may modify the original order under section 1521. The applicant requests that this Honourable Court (1) determine the right of seeing and having contact with the child as is appropriate to the circumstances under section 1584/1; (2) consider the withdrawal of the respondent's parental power under section 1582 where the ground so warrants, whereupon parental power shall be with the applicant by operation of section 1582 paragraph 2; (3) failing withdrawal, modify the order concerning parental power under section 1521, giving paramount consideration to the well-being and interests of the child."
Pleading Sequence¶
- Anchor the joint-parental-power default via section 1566 — mere separation does not extinguish joint parental power.
- Where the current designation is by court order or by written agreement, identify the section 1520 designation and address the section 1521 modification standard.
- Plead the section 1584/1 contact right as a parental right operating notwithstanding the other parent's parental-power exercise.
- Where the pattern of obstruction is documented, plead section 1582 "wrongful exercise" — the automatic-transfer rule at paragraph 2 is a strong pathway if withdrawal is ordered.
- Where withdrawal is not warranted, seek modification under section 1521 on the change-of-circumstances standard.
- Anchor the paramountcy standard on the "welfare and interests of the child" formulation at section 1520 paragraph 2 final sentence throughout.
- In cross-border cases, run Hague 1980 through the MSDHS central authority; anchor the Hague "rights of custody" concept on section 1567(1) and (4).
