Schweizerisches Zivilgesetzbuch — Art. 273-275a: Personal Relations & Parental Alienation¶
TL;DR¶
Swiss ZGB Art. 273 guarantees the right of personal relations (persönlicher Verkehr / relations personnelles) between child and non-residential parent. Art. 274 obligates both parents to refrain from any conduct that impedes the child's relationship with the other — a near-explicit statutory anti-alienation clause. Since the 2014 joint-custody reform, gemeinsame elterliche Sorge is the legal default. The Bundesgericht has repeatedly held that systematic obstruction of contact violates ZGB Art. 274 and ECHR Art. 8, justifying transfer of residence in severe cases.
Statutory Framework¶
Art. 273 ZGB — Right to Personal Relations¶
"Eltern, denen die elterliche Sorge oder Obhut nicht zusteht, und das minderjährige Kind haben gegenseitig Anspruch auf angemessenen persönlichen Verkehr."
The parent without custody/residence AND the minor child have a mutual entitlement to appropriate personal relations. The child is a rights-holder, not an object.
Art. 274 ZGB — Duty Not to Impair Relations¶
"Vater und Mutter haben alles zu unterlassen, was das Verhältnis des Kindes zum andern Elternteil beeinträchtigt oder die Aufgabe der erziehenden Person erschwert."
Direct translation: Father and mother must refrain from anything that impairs the child's relationship with the other parent or hinders the task of the rearing person.
This is one of the most explicit statutory anti-alienation provisions in any European civil code. Violation is grounds for: - Modification of custody arrangements (Art. 134 ZGB) - Withdrawal of parental authority (Art. 311 ZGB) - Placement of child (Art. 310 ZGB) - Criminal liability under StGB Art. 220 (removal of minor)
Art. 275a ZGB — Information & Consultation Rights¶
Non-custodial parent retains rights to information about the child's significant developments and consultation on major decisions — preventing the residential parent from unilaterally severing informational ties.
2014 Joint Custody Reform¶
Effective 1 July 2014, gemeinsame elterliche Sorge (joint parental authority) became the statutory default for both married and unmarried parents (Art. 296 ZGB). Sole custody is now the exception, requiring proof that joint arrangement contradicts the child's welfare. This reform aligned Switzerland with Sweden, Belgium, and Germany.
Federal Supreme Court Jurisprudence¶
The Bundesgericht (BGer / Tribunal fédéral) has built a substantial body of case law:
- BGE 130 III 585 — Established that persistent contact refusal by the residential parent is grounds for custody reassignment when the child's welfare is at stake.
- BGE 142 III 481 — Reinforced ECHR Art. 8 obligations; courts must take active measures to restore contact when alienation behaviors are documented.
- 5A_793/2020 — Confirmed that mere child resistance (without independent investigation of its origin) does not justify contact suspension; courts must assess whether resistance is induced.
Article 8 ECHR Integration¶
Switzerland ratified the ECHR in 1974. The Bundesgericht treats Strasbourg jurisprudence as binding interpretive authority. Key linkages:
