France — Code civil arts. 371–377 + Loi 2024-873 (violence intrafamiliale)
TL;DR¶
France's Code civil arts. 371–377 governs autorité parentale — joint by default for married and unmarried parents alike (since 2002 reform). The 2024 Loi 2024-873 (renforcement de la protection des victimes de violences intrafamiliales) introduces automatic suspension of parental authority in severe domestic violence convictions, and creates dedicated pôles spécialisés (specialized chambers) for violence-affected family cases. Hague 1980 signatory since 1983; Hague 1996 since 2011; Brussels IIb member. Cour de cassation jurisprudence increasingly recognizes aliénation parentale as welfare-endangering conduct.
Statutory framework — Code civil¶
Art. 371-1 (Authority defined)¶
- Parental authority is a set of rights and duties having for finality the interest of the child
- Belongs to parents until child's majority or emancipation
- For protection of safety, health, morality, education of child
Art. 372 (Joint exercise)¶
- Parents exercise authority jointly
- Joint exercise applies to married, unmarried (since 2002 Loi 2002-305), and divorced parents (subject to court orders)
Art. 373-2 (After separation)¶
- Separation of parents does not affect rules of attribution of parental authority
- Each parent must maintain personal relations with child and respect bonds with other parent
- Explicit anti-PA provision: each parent must respect child's bond with other parent
Art. 373-2-6 to 373-2-13 (JAF — juge aux affaires familiales)¶
- Family-affairs judge (JAF) has jurisdiction over residence, contact, financial contribution
- May order résidence alternée (shared residence — equal time)
- May order mediation; suspend authority; transfer authority

Loi 2024-873 (2024 reform on intrafamily violence)¶
Enacted to strengthen victim protection:
- Art. 378-2 Code civil (new): automatic suspension of parental authority for parent under judicial control / detention for serious crime against other parent or child
- Suspension is provisional and may be confirmed/lifted by criminal court
- Pôles spécialisés: dedicated chambers in tribunals judiciaires for cases involving violence
- Mandatory expert evaluation in any case where ordonnance de protection has been granted
- Reinforces interaction between criminal and family proceedings
