Argentina — Código Civil y Comercial 2015 (arts. 638–655) + Buenos Aires Province PA draft
TL;DR¶
Argentina's Código Civil y Comercial de la Nación 2015 (CCyC, in force 1 Aug 2015) modernized family law nationally — arts. 638–655 govern responsabilidad parental, cuidado personal, régimen comunicacional. The CCyC strongly favors shared custody (cuidado personal compartido) and explicitly recognises interferencias parentales as detrimental to children. Buenos Aires Province draft PA bill 2024 would establish explicit Brazilian-style PA statute. Hague 1980 (1991) + Hague 1996 (2011). Mercosur framework supplements bilateral relations.
Statutory framework — Código Civil y Comercial 2015¶
Art. 638 (Responsabilidad parental)¶
- Set of duties and rights of parents over child for child's protection, development, integral formation
- Both parents have responsabilidad parental
